In this case, please refer to this office NOC issued u/no.


FBM/S/507/05 dated 12/04/2008 for the construction of Highrise
Residential Building, No. 1, comprising of 02 wings, designated as Wing 'A’ &
‘B', having ground floor part on stilts + 1st to 11th upper floors with the total
height of 36.70 mtrs, measured from general ground level up to the terrace
level.
Further, please refer to this office amendment NOC issued u/no.
FBM/S/507/700 dated 20/08/2008 for the construction of Highrise
Residential Building, No. 1., comprising of 02 wings, designated as Wing 'A’
& ‘B', having Single Basement + Ground floor part on stilts + 1st to 10th
upper floors (10th Pt.) with the total height of 32.80 mtrs. Measured from
general ground level up to the terrace level.

Further, please refer to this office amendment NOC issued u/no.


FB/HR/R-III/276 dated 16/09/2015 for proposed amendment in
construction of Highrise Residential Building, No. 1, comprising of 02-wings,
designated as Wing 'A’ & ‘B', having Single Basement + Ground floor part on
stilts + 1st to 10th upper floors (10th part for Wing ‘A’) with the total height of
32.80 mtrs. Measured from general ground level up to the terrace level. The
Mini Rotary Car Parking Tower has proposed on South-East side courtyard
of the building with a total height of 16.80 mtrs. Up to top of the level.

Now, Architect has submitted amendment plans with the following


proposed amendments/ modifications: -
1) Architect has proposed to shift the society office at ground floor in
wing ‘A’ in stilt portion and entrance lobby has been proposed at it’s
place as shown in the amended plans.

2) Pump room is now proposed in stilt portion of wing ‘B’.
3) Fitness Centre & meter room are now proposed in stilt portion of wing
‘B’ by removing the car parking space, as shown in the amended
plans.
4) Purpose U.G. tank in basement as shown in the amended plans.
5) Changes in the parking layout in basement as shown on the amended
plan.
6) Architect proposed changes in joint refuge area layout, calculations as
shown on the plan which are as follows:

In addition to above, terrace of the building will be treated as refuge
area. Refuge area calculation shall be verified by E.E.B.P. (W.S.).
Excess refuge area shall be counted in FSI as per DCPR 2034.

As per the Architect, there are no any other changes except above
mentioned amendments.

The proposal has been considered favourably taking into consideration


the following:
i) N.O.C. from this department for above mentioned building was already
issued u/no FBM/S/507/05 dated 12/04/2008, FBM/S/507/700
dated 20/08/2008 & FB/HR/R-III/276 dated 16/09/2015 and this
requirement letter is only for some amendments.
i) The site abuts on 18.30 mtrs wide 1st Road on West side as shown on
the plan.
ii) As per Architect letter dated-25.05.2023, Full C.C. has been granted
on dated 17.4.2013 for height upto 36.90 mtr. + LMR + OHT, as per
the approved plans dated 08.3.2013. 3. & client has constructed the
said building under reference ie. wing ‘A’ = upto 10th (pt.) upper floors
+ LMR + OHT, and wing ‘B’ = upto 10th upper floors + LMR + OHT.

iii) The fire-fighting measures are already recommended for the said high
rise building vide earlier issued fire safety requirement letter.
iv) Feasible active and passive fire protection and firefighting
requirements or any additional fire recommendation/requirements if
any for proposed building will be recommended in future from Mumbai
Fire Brigade Officer before final occupation.

In view of above, as far as this Department is concerned, this fire
safety requirement letter is issued from fire safety point of view for the
above-mentioned amendments for the High-Rise Residential Building, No. 1,
comprising of 02-wings, designated as Wing 'A’ & ‘B', having common
basement whereas wing ‘A’ comprising of ground + 1st to 9th & 10th (pt.)
upper floors & wing ‘B’ comprising of (pt.) ground + (pt.) stilt + 1st to 10th
upper floors with the total height of 32.80 mtrs. Measured from general
ground level up to the terrace level along with the Mini Rotary Car Parking
Tower on South-East side courtyard of the building with a total height of
16.80 mtrs. Up to top of the level as per the details shown on the enclosed
plan signed in token of approval subject to satisfactory compliance of the
following requirements:

1) All the requirements stipulated vide this office N.O.C. issued earlier
U/No. FBM/S/507/05 dated 12/04/2008, FBM/S/507/700 dated
20/08/2008 & FB/HR/R-III/276 dated 16/09/2015 shall be strictly
adhered to for the entire building with the following additional fire
safety requirements:

ADDITIONAL REQUIREMENT:

2) HOSE & HOSE BOXES: (For each wing)


Hose Box, with two hoses of 15mts. length of 63mm dia along with
branch shall be provided near wet riser landing valve on ground floor
as well as alternate floor level.

3) AUTOMATIC SMOKE DETECTION SYSTEM: (For each wing)


Automatic smoke detection system shall be installed in society office,
fitness center, electric meter room, in lift machine room & in pump
room of the building as per IS specifications with main console panel
at ground floor level.

4) PANEL BOARD OF FIRE-FIGHTING SYSTEM: (For each wing)


Fire alarm system, public address system, Alternate supply, etc.
panels shall be installed on ground floor at the suitable location &
which shall be manned 24 hours.

5) SIGNAGES: (For each wing)


i. Self-Glowing / Fluorescent exit signs in ‘Green’ color shall be provided
in passage area of the building showing the direction of Escapes /
Staircase / Exits etc.
ii. All the exit routs shall be marked with fluorescent/radium painted &
exits signs at strategic locations.

6) PUBLIC ADDRESS SYSTEM: (For each wing)
The building shall be provided with public address system as per the
rules with main control operator at console panel at ground floor.

7) TRAINED FIRE STAFF/SECURITY GUARDS: (For each wing)


The trained fire staff / Security guards having basic knowledge of
firefighting & fix firefighting installation shall be posted in the building.

8) FIRE DRILLS / EVACUATION DRILLS:


Fire Drills and evacuation drills shall be conducted regularly and log of
the same shall be maintained.
Earlier, the party has paid capitation fees of Rs. 53,000/- vide receipt
no. 676987 dated 09/04/2007 on the total gross built-up area as 5300.00
sq. mtrs as certified by the Architect vide his letter dated 24/03/2007.

Further, the party has paid capitation fees of Rs. 26,800/- vide receipt
no. 0394643 dated 13/08/2008 (Sap Doc No. 1000130914) on the total
gross built-up area as 7980.00 sq. mtrs as certified by the Architect vide his
letter dated 04/08/2008. (Additional gross built up area of 2680.00 sq. mtrs)

Further, the party has paid capitation fees of Rs. 1,24,800/- vide
receipt no. 3373325 (Sap Doc No. 10001969893) dated 30/12/2014 on the
total gross built-up area as 6600.00 sq. mtrs as certified by the Architect.

Further, the party has paid capitation fees of Rs. 26,400/- vide receipt
no. 1474400 (Sap Doc No. 1002274382) dated 14/09/2015 on the total
gross built-up area as 6600.00 sq. mtrs as certified by the Architect.

Now, the Architect vide his letter dated 15.05.2023. Has certified the
gross built up area as 70000 sq. mtrs for the said high rise building and the
party has paid additional scrutiny fess of Rs4,90,000 vide Online Receipt No.
0586318-19-20. Dated 18.05.2023.
However, E.E.B.P.(W.S.) is requested to verify the gross built up area
and inform this department if the same is found to be more for levying the
additional scrutiny fees if any.
As per MFS & LA 2006, u/s. 11(1) & as certified by the Architect in the
classification of building stated in schedule II/part I/ part III, the party has
paid fire service fees of Rs. 49,000/- vide receipt No. 25/05/2023/00533
dated -24/05/2023 on the total gross built-up area of 7000.00 sq. mtrs.

Note for the ARCHITECT/LS/E.E.B.P.(W.S.):


1. The fire-fighting installation shall be carried out by Govt. of Maharashtra
approved Licensing Agency

2. The width of abutting road & open spaces is mentioned in plans as
submitted by the L.S. attached herewith and these parameters shall be
certified by the L.S.
3. E.E.B.P.(W.S.) shall verify the proposal in context with the relevant
Regulations of DCPR-2034.
4. The schematic drawings/plans of automatic sprinkler system, automatic
smoke detection system, wet riser system, public address system, manual
fire alarm system shall be got approved from CFO.
5. The area, size, etc. for the sprinkler system, detection system, fire alarm
system, wet riser system, public address system, Fire duct, electrical duct
etc. to be verified & examined by MEP Consultant.
6. Separate necessary permission for any licensable activity shall be obtained
from concerned authorities of MCGM/CFO’s department, till then shall
not be allowed to use.
7. There shall be no any tree located in the compulsory open spaces or in the
access way near the Entrance gates.
8. This recommendation letter is issued only from Fire Protection & Fire-
Fighting requirements point of view on behalf of the application from L.S.
If any matter pertaining to authenticity or legality shall be cleared by
concerned Owner/Occupier/Developer/L.S., etc
9. The plans approved along with this approval are issued from Fire Risk &
Life Safety point of view only. Approval of these plans does not mean in
any way of allowing construction of the building. It is L.S./Developers
responsibility to take necessary prior approval from all concerned
competent authorities for the proposed construction of the building
10. As per section 3 of Maharashtra Fire Prevention and Life Safety Measures
Act 2006, it is the liability of Owner/Occupier to provide the Fire
Protection measures & Fixed Fire Fighting Safety system installations and
shall be maintained in good working order & in efficient condition all the
time, in accordance with the provisions of Maharashtra Fire Prevention
and Life Safety Measures Act or the rules.
11. This approval is issued without prejudice to legal matters pending in court
of law, if any.
