I acknowledge that in connection with my application for employment or subsequent employment, 24 Hour Fitness may collect, assemble, evaluate, compile, report,
transmit, transfer or communicate information on my character, general reputation, personal characteristics or mode of living which are matters of public record without
using a third party investigative consumer reporting agency. Matters of public record are defined as records documenting an arrest, indictment, conviction, civil judicial
action, tax lien, or outstanding judgment. I understand that such public record information generally must be disclosed to me within seven days of the date the
information is received, regardless of whether it is received orally or in writing. I understand that I may waive my right to receive such information.

APPLICANT'S CERTIFICATION

I certify that the facts contained in this application are true and complete to the best of my knowledge. I understand that any false statement, omission, or
misrepresentation on this application, my resume or any other supplementary materials is sufficient cause for refusal to hire, or dismissal if I have been employed, no
matter when discovered by 24 Hour Fitness.

I authorize 24 Hour Fitness to thoroughly investigate all statements contained in my application or resume. Furthermore, I authorize my former employers and
references to disclose information regarding my former employment, character, and general reputation to 24 Hour Fitness or its agents without giving me prior notice of
such disclosure. In addition, I release 24 Hour Fitness, any former employers, and all references listed above from any and all claims, demands or liabilities arising out
of or related to such investigation or disclosure.

I understand and agree nothing contained in this application, or conveyed during my interview, is intended to create a contract for employment for a fixed term. I further
understand and agree that if I am hired, my employment will be "at will" and without fixed term, and may be terminated at any time, with or without cause and without
prior notice, at the option of either myself or 24 Hour Fitness. I understand that no representative of 24 Hour Fitness is authorized at any time to alter this provision. I
further understand that no promises regarding employment have been made to me, and that no such promise or guarantee is binding upon 24 Hour Fitness unless
made in writing.

ARBITRATION AGREEMENT

24 Hour Fitness and I agree that ALL CLAIMS OR DISPUTES, PAST, PRESENT, AND FUTURE (excluding claims for worker's compensation benefits, state disability
insurance, and unemployment insurance benefits or benefits under any benefit plan covered by ERISA or funded by insurance), THAT 24 Hour Fitness MAY HAVE
AGAINST ME OR THAT I MAY HAVE AGAINST 24 Hour Fitness, SHALL BE DECIDED BY AN ARBITRATOR THROUGH FINAL AND BINDING ARBITRATION, AND
NOT BY A JUDGE OR JURY, including without limitation all common law and statutory claims for discrimination, harassment, retaliation, wages or other compensation
or monies claimed to be owed, and all claims or disputes related to or arising out of my application for employment and, if employed, my employment and/or my
termination of employment. This Arbitration Agreement is governed by the Federal Arbitration Act. Except as provided in this Arbitration Agreement, the JAMS
Employment Arbitration Rules & Procedures will apply and are available at the www.jamsadr.com or by calling 1.888.256.5485, ext. 3339. This Arbitration Agreement
does not prevent the making of a report or filing a claim or charge with a government agency, including the Equal Employment Opportunity Commission, U.S.
Department of Labor, Securities and Exchange Commission, Occupational Health and Safety Administration, or National Labor Relations Board.

Any covered claim or dispute must be brought in arbitration on an individual basis only, and there will be no right or authority for any claim or dispute to be brought,
heard or arbitrated as a class or collective action ("Class Action Waiver"). Notwithstanding any other provision in this Arbitration Agreement or the JAMS rules, any
dispute as to the enforceability, validity, interpretation, and applicability of the Class Action Waiver may only be determined by a court and not the Arbitrator. In the
event a final judicial determination is made that the Class Action Waiver is unenforceable, any class or collective action must be brought in court and not in arbitration.

This Arbitration Agreement is not a mandatory condition of this application or employment. If you do not wish to be bound by this Arbitration Agreement,
you must submit a signed and dated statement that includes your name and work location and states your desire not to be bound by this Arbitration
Agreement. In order to be effective, the signed and dated statement must be received by the Legal Department at fax number 925.543.3358 within 30 days
after signing/submitting your application. If you opt out within thirty (30) days, it will not affect your application for employment, you will not be subject to any
adverse action as a consequence of that decision, and neither you nor 24 Hour Fitness will be bound by this Arbitration Agreement.

NOTE FOR CALIFORNIA APPLICANTS: Under California Labor Code § 432.6, an applicant cannot be required to waive any right, forum, or procedure for a violation
of the California Fair Employment and Housing Act or the California Labor Code unless the waiver is enforceable under the Federal Arbitration Act. The Company
maintains that this Arbitration Agreement is enforceable under the Federal Arbitration Agreement and thus all applicants should opt out using the process outlined
above if they wish not to be bound by this Agreement. However, to the extent a court of competent jurisdiction finds this Agreement is not enforceable under the
Federal Arbitration Act, the Company acknowledges that California applicants are not required to opt out of this Agreement in order to bring claims, civil actions, or
complaints governed by California Labor Code § 432.6 in an appropriate forum of their choosing

This notice is intended to provide you with important information required by the Electronic Signatures in Global and National Commerce Act (E‐Sign Act).
Consent: By entering your name, you consent to submit your employment application and all related forms, documents and information electronically. You further
