No. AX13/RFP/2023-24 - 7 Date: 04/05/2023 Notice for Empanelment of Architects and Interior / Furnishing / Electrical Works, Data Cabling Work, and Air Condition Work Contractors for Civil Bank of Maharashtra Zonal Office, Kolhapur is in the process of preparing panel of Architects /Contractors for doing Civil / Interior / Furnishing / Electrical works, Data Cabling work and Air Condition Work and invites sealed applications from eligible Architects / Contractors / Vendors in the above mentioned fields for empanelment. 1, The interested parties may collect the empanelment formats from Bank of Maharashtra, Zonal Office, Kolhapur at address mentioned above or the empanelment forms can be downloaded from our website. 2. Cost of empanelment Document/Form: Rs. 1000/- (Rs. One Thousand only-non-refundable) to be paid in the form of Demand Draft /PO favoring ‘Bank of Maharashtra” payable at KOLHAPUR. 3. Date of Issue of empane!ment notice. + 04/05/2023 4, 5. Last date of submitting the empanelment Application : 20.05.2023 up to 5.00 p.m. at Bank of Maharashtra, Zonal Office, KOLHAPUR. 6. Sealed empanelment Application should be submitted, super scribing the work/purpose “Empanelment for work” and with full contact details of the applicant. If application is downloaded from internet than DD/PO of Rs.1000/- being application money should be submitted in a separate cover along with application, 7. Bank of Maharashtra reserves the right to reject any or all empanelment applications without assigning any reason whatsoever. = Place: KOLHAPUR Zonal Manager (+ ) Date: 04/05/2023 KOLHAPUR Zone Page 3 of 30FOR EMPANELMENT Bank of Maharashtra is in the process of preparing panel of Professionals/Contractors & Service providers (vendors) and invites sealed applications from eligible & reputed Contractors & Service providers in the field of civil, electrical /furniture/interior, maintenance work, Data cabling work, air condition work and Architects for empanelment, having valid registration with Nationalized Banks or PWD/MES/PSUs/ Govt. Sector, in appropriate class. Professionals/Contractors & Service providers shall apply for empanelment in prescribed format. The application forms/ documents are also available on our website. This can be used for purpose of submitting the application for empanelment along with prescribed fee which is non-refundable. Application forms are also available at above-mentioned address between 10:00 am to 05:00 p.m. on all working days except Sundays & holidays (from 04/05/2023 to 19/05/2023.) INSTRUCTIONS TO APPLICANTS: - Intending professional/ contractors/vendors are requested to furnish details about their firm, technical experience, competence and evidence of their financial standing as per enclosed format for considering their names for empanelment. ‘The professional/ contractors/vendors should have minimum Two years of experience in the respective field. The professional/ contractors/vendors applying for electrical works should have valid electrical licenses, The professional/contractors/vendors who intend to apply for more than one category have to apply for each category separately using appropriate application form by paying requisite fee which is non-refundable. Intending professional/ eontractors/vendors are requested to read the format carefully before filling the particulars. Incomplete applications will not be considered. Bank of Maharashtra shall approach the professional/ contractor’s/vendor’s clients, corporations, organizations, ete. to verify their general reputation / competence. Selection of contractors will be based on the ability and competence required for good quality jobs to be performed by them. ‘The empanelment shall be made for a specific category. However, professional/ contractors/vendors empancled in higher category shall be eligible for the works in the lower category. If the space provided in the format is insufficient for giving full details, the same may be given on a separate sheet of paper. Information/details furnished by selected professional/ contractors/vendors, if found to be false at any time in future or any information affecting empanelment is willingly /unwillingly withheld & if it comes to the notice of the Bank at any point of time, the empanclment of professional/ contractors/vendors ean be cancelled immediately. Where copies of documents are required to be furnished, these should be certified true copies. Application form is not transferable.The evaluation will be based on the experience of the Professional/Contractors/vendors and their financial capabilities and may also include inspecting the works furnished by them for which, necessary co-ordination shall be made by them, Based on the details furnished and inspection of works, eligibility criteria, professional/ contractors/vendors will be empaneled. Decision of the Bank regarding selection / rejection for ‘empanelment will be final and binding and no further correspondence will be entertained. The ‘empancled contractors will only be informed by post. Empanelment of the firm, if selected, will be valid for one year and subject to review, bank may decide to extend it for another 2 years or as decided by the bank. Information furnished to Bank will be kept strictly confidential, The application shall be signed by the person/s on behalf of the organization having necessary Authority/ Power of Attorney to do so. Each page of the application shall be signed as token of acceptance of the contents mentioned therein and copy of Power of Attorney / Memorandum of association (Wherever applicable) shall be furnished along with application. Completed empanelment application/ document shall be submitted by 5.00 pm on 19/05/2023 to the Zonal Manager, Bank of Maharashtra, Zonal Office, Kolhapur. If downloaded from the internet, each application/form must accompany Pay Order / Demand Draft Favoring Bank of Maharashtra payable at KOLHAPUR for Rs.1000/-. It is necessary that professional/ contractors/vendors must haye full office set up at city/town in Maharashtra State or a full-fledged branch office at city/town in Maharashtra State if its head/registered office is somewhere else. The BIDDER further confirms and declares to the BANK that the BIDDER is the original ‘manufacturer/integrator and not engaged any individual or firm or company whether Indian ot foreign to intercede, facilitate or in any way to recommend to the BANK or any of its functionaries whether officially or unofficially to the award of the contract to the BIDDER, nor has any amount been paid, promised or intended to be paid to any such individual firm or company in respect of any such intercession facilitation or recommendation. ‘The BIDDER, either while presenting the bid or during pre-contract negotiations or before signing the contract shall disclose any payments he has made is committed to or intends to make to officials of the BANK or their the contract and the details of family members, agents, brokers or any other intermediaries in connection services agreed upon for such payments. ‘The BIDDER will not collude with other parties interested in the contract impair the transparency fairness and progress of the bidding process, bid evaluation contracting and implementation of the contract. ‘The BIDDER will not accept any advantage in exchange for any corrupt practice unfair means and illegal activities. The BIDDER shall not use improperly, for purposes of competition or personal gain, or pass on to others any information provided by the BANK as part of business relationship, regarding plans, technical proposals and business details including information contained in any electronic data cartier. The BIDDER also undertakes to exercise due and adequate care lest any such information is divulged. The BIDDER commits to refrain from giving any complaint directly or through any other manner without supporting it with full and verifiable facts. ‘The BIDDER shall not instigate or cause to instigate any third person to commit any of the actions mentioned above. Ifthe BIDDER or any employee of the BIDDER or any person acting on behalf of the BIDDER either directly or indirectly, is a relative of any of the officers of the BANK, of alternatively, if any relative of an officer of the BANK has financial interest/stake in the BIDDER’s firm, the same shall be disclosed by the BIDDER at the time of filing of tender. ‘The term ‘relative; for this purpose would be as defined in Section 6 of the Companies Act 1956/Section 2 (77) of the Companies Act, 2013 3.13. The BIDDER shall not lend to or borrow any money from or enter into any monetary dealings or transactions, directly or indirectly, with any employee of the BANK. Previous Transgression 4.1, The BIDDER declares that no previous transgression occurred in the last three years immediately before signing of this Integrity Pact, with any other company in any country in respect of any corrupt practices envisaged hereunder or with any Public Sector Enterprise in India or any Government Department in India that could justify BIDDER’s exclusion from the tender process. 4.2. The BIDDER agrees that if it makes incorrect statement on this subject, BIDDER can be disqualified from the tender process or the contract, if already awarded, can be terminated for such reason, Earnest Money (Security Deposit) 5.1. While submitting commercial bid, the BIDDER shall deposit an amount Rs 40,000 (to be specified in RFP) as Earnest Money Deposit/ Security Deposit, and ‘Tender fee of Rs 1,000/- with the BANK through any of the following instruments: 5.1.1.Bank Draft or Pay Order in Favor of Bank of Maharashtra 5.1.2.A Confirmed guarantee by an Indian Nationalized Bank, promising payment of the guaranteed sum to the BANK on demand within three working days without any demure whatsoever and without seeking any reason whatsoever. The demand for payment by the BANK shall be treated as conclusive proof of payment. 5.2. The Eamest Money/Sccurity Deposit shall be valid up to a period of one year or the complete conclusion of the contractual obligations to the complete satisfaction of both the BIDDER and the BANK, including warranty period, whichever is later. ‘Tender fee will be non-returnable once paid to the Bank. 5.3. In case of the successfull BIDDER a clause would also be incorporated in the Article pertaining to Performance Bond/performance security deposit for the said work that the provisions of Sanctions for Violation shall be applicable for forfeiture of performance Bond/performance security deposit in case of decision by the Bank to forfeit the same without assigning any reason for imposing sanction for violation of this Pact. 5.4. No interest shall be payable by the Bank to the BIDDER in Earnest Money/Security Deposit for the period of its currency. Sanctions for Violations: 6.1. Any breach of the aforesaid provisions by the BIDDER or any one employed by its or action on its behalf (Whether with or without the knowledge of the BIDDER) shall entitled the Bank to take all or any one of the following actions, wherever required :- 6.1.1. To immediately call of the pre contract negotiations without assigning any reason or giving any ‘compensation to the BIDDER. However, the proceedings with the other BIDDER(s) would continue. 6.1.2. The Eamest Money Deposit (in pre-contract stage) and for Security Deposit / Performance Bond Jperformance security deposit (after the contract is signed) shall stand forfeited either fully or partially, as decided by the Bank and the Bank shall not be required to assigning any reason therefore. 6.1.3. If any outstanding payment is due to the BIDDER from the BANK. in connection with any other contract for any other project g payment could also be utilized to recover the aforesaid sum and interest, 6.1.5. To encash the advance Bank guarantee and performance bond/warranty bond, if furnished by the BIDDER, in order to recover the payments, already made by the Bank, along with interest. 6.1.6. To cancel all or any other Contracts with the Bidder. The Bidder shall be liable to pay compensation for any loss or damage to the Bank resulting from such cancellation/rescission and the BANK shall be entitled to deduct the amount so payable from the money(s) due to the Bidder. 6.1.7. To debar the BIDDER from participating in future bidding processes of the Bank for a minimum period of five years, which may be further extended at the discretion of the BANK. 6.1.8. To recover all sums paid in violation of this Pact by Bidder(s) to any middleman or agent or broker with a view to securing the contract. 6.1.9. Inccases where irrevocable letter of credit have been received in respect of any contract signed by the BANK with the BIDDER, the same shall not be opened 6.1.10. Forfeiture of Performance Bond in case of a decision by the BANK to forfeit the same without assigning any reason for imposing sanctions for violation of this Pact. 7. Fail Clause: TA. The Bidder undertakes that it has not supplied / is not supplying similar products/systems or subsystems! services at a price lower than that offered in the present bid in respect of any other Ministry/department of the Government of India or PSU and if it is found at any stage that similar products/systems or sub systems was supplied by the Bidder to any other Ministry/Department of Government of India or a PSU at a lower price, then that very price, with due allowance for elapsed time, will be applicable to the present case and the difference in the east would be refunded by the BIDDER to the BANK, if the contract has already been concluded. 8. Independent Monitors: 81. 82, 83. 84, 85. ‘The BANK has appointed Independent Monitors i) Shri Nilmoni Bhakta ‘Address: A/801,PBCL CHS Ltd, Plot No.3 ,Sector 46A,nerul.navi Mumbai-400706 \Shri Madan Lal Sharma ‘Address: K/23, Jangpura Extension, New Delhi (Hereinafter referred to as Monitors) for this Pact in consultation with the Central Vigilance Commission. ‘The task of the Monitors shall be to review independently and objectively whether and to what extent the parties comply with the obligations under this Pact. ‘The Monitors shall not be subject to instructions by the representatives of the parties and performs their functions neutrally and independently. Both the parties accept that the Monitors have the right to access all the documents relating to the project/procurement, including minutes of meetings. ‘As soon as the Monitor notices, or has reason to believe, a violation of this Pact, he will so inform the Authority designated by the BANK. 1¢ BIDDER(s) accepts that the Monitors has the right to access without restriction to all Project documentation of the BANK including that provided by the BIDDER. The BIDDER will also grant the Monitor upon his request, sted and unconditional access to his pocket documentation. The Monitor shall be under contractual obligation to treat the information and documents of the BIDDER/subcontract(s) with confidentiality. 8.7. The BANK will provide to the Monitor sufficient information about all meetings among the parties related to the Project provided such meetings could have an impact on the contractual relations between the parties. The parties will offer to the Monitor the option to participate in such meetings. 8.8. The Monitor will submit a written report to the designated Authority of BANK in the Department/within 8 to 10 weeks from the date of reference or intimation to him by the BANK/BIDDER and, should the occasion arise, submit proposals for correction problematic situations. 9, Facilitation of Investigation | Incase of any allegation of violation of an provisions of this Pact or payment of commission the BANK or its agencies shall | be entitled to examine all the documents including the Books of Accounts of the BIDDER and the BIDDER shall provide necessary information and documents in English and shall extend all possible help for the purpose of such ‘examination. | | | 10. Law and Place of Juri This pact is subject to Indian Law. The place of performance and juris jon is the seat of the Pune. LL, Other Legal Actions: The actions stipulated in this Integrity Pact are without prejudice to any other legal action that may follow in accordance with the provisions of the extant law in force relating to any civil or criminal proceedings. 12. Validity: 12.1. The validity of this Integrity Pact shall be from date of its signing and extend up to 2 years or the complete execution of the contract to the satisfaction of both the BANK and the BIDDER/Seller, including warranty period whichever is later, in case BIDDER is unsuccessful, this Integrity Pact shall expire after six months from the date of the signing of the contract. 12.2.Should one or several provisions of this pact turn out to be invalid; the remainder of this Pact shall remain valid. cease, the parties will strive to come to an agreement to their original intentions.
