Order of Recusal

The Administrative Judge of the Fifth Judicial Administrative District has recused all judges of the Fulton County Superior Court from presiding over the case of Donald J. Trump v. Fani Willis, Robert McBurney. The case has been assigned to the Seventh Judicial Administrative District for the appointment of a non-Fulton County judge to preside. The Clerk of Fulton County Court is directed to submit certified copies of the case record and all future filings to the appointed judge. The parties must also provide courtesy copies of any new filings to the assigned judge.

ORDER RECUSING ALL JUDGES OF THE


FIFTH JUDICIAL ADMINISTRATIVE DISTRICT

Upon a review of the above-captioned matter, the undersigned Administrative Judge of

the Fifth Judicial Administrative District hereby determines that all active Judges of the Fulton

County Superior Court Bench should be recused.

Pursuant to the procedures outlined in Uniform Superior Court Rule 25.7 and the Judicial

Qualifications Commission of Georgia’s Opinion No. 220, the matter is hereby assigned to the

Seventh Judicial Administrative District “for the appointment of a judge who is not a member of

the district” to preside over the case. Ga. Unif. Super. Ct. Rule 25.4.1 The assigned judge may

contact David Summerlin, the Fulton County Superior Court Administrator, at (404) 612-4518 to

arrange courtroom space, if needed, at the Fulton County Superior Court.

The Clerk of Fulton County Court is directed to submit a certified copy of the entire record

as it currently exists, and a certified copy of all documents filed in the same case after the date of

this order to the judge to whom the Seventh Judicial Administrative District appoints, at such time

that the appointment is made. The parties are further directed to provide courtesy copies of any

filings after the date of this Order to the judge assigned to preside over this matter.
