• Nutritional Labeling and Education Act provides the FDA with specific
authority to require nutrition labeling of most food regulated by the agency

• No preclearance labeling requirements or certificate of label approvals for


FDA regulated food products
 Manufacturers are responsible for ensuring their labels conform to applicable
FDA labeling laws and regulations.

• Project managers at Eurofins are available to assist with inquires regarding


nutrition labeling requirements and general information about the CFR
FDA Updates

•Initially proposed in May 2016 for compliance in July


2018/2019

•Proposed rule by FDA in September 2017 for


extension of compliance dates to January 2020

Added Sugars

Sugars” -- Sub-category of Total Sugars
• Definition
“Added sugars are either added during the processing of foods, or are
packaged as such, and include sugars (free, mono- and disaccharides), sugars
from syrups and honey, and sugars from concentrated fruit or vegetable juices
that are in excess of what would be expected from the same volume of 100
percent fruit or vegetable juice of the same type, except that fruit or vegetable
juice concentrated from 100 percent juices sold to consumers, fruit or vegetable
juice concentrates used towards the total juice percentage label declaration.

• FDA will begin enforcing new regulations for menu labeling on May 5th, 2018
• Who has to comply?
 Restaurants and similar retail food establishments that are part of a chain of 20 or
more locations doing business under the same name (e.g. franchises), and any
establishment offering for sale restaurant-type foods.

• Who is exempt?
 Anyone may voluntarily register to menu label enforcement, however, food trucks,
sidewalk carts, trains/airline, chains with fewer than 20 locations are exempt.
