INTRODUCTION

Document is questioned because its origins, its contents, or the

circumstance and story regarding its production arouses suspicion as to its
genuineness or it may adversely scrutinize simply because it displeases
someone. It is also said to be questioned when it is disputed or attacked,
either in whole or in part as to its date or age, as to its source or origin, as to
the material used in their production, and as to its relation in some other
document.

In addition, document can be considered questioned if the facts

appearing therein are not true, and are contests either in whole or in part
with respect to its authenticity identity, or origin. It may be a deed, contract,
will, election ballots, marriage contract, check, visas, application from,
check writers, certificates, etc.

A document examiner usually observes a scientific approach in the

examination of the disputed writing. The possibility that handwriting being
identifiable and separated from others largely depends on any individuals
who have developed the complex structural product of modifying normal
practice and adopting to the needs and abilities.

Further, before one could make a comparison and proper evaluation

of the characteristics of handwriting, he must know first how to observe or
recognize these writing characteristics. The following are the writing
characteristics in relation to handwriting examination:

a. Recognition of handwriting characteristics - One must acquire the

ability to distinguish what are the style and individual
characteristics. Distinguish characteristics which are normal and
disguise.

b. Comparison of handwriting characteristics - Make allowance to

the presence of natural variation in handwriting.

 c. Evaluation of handwriting characteristics for opinion purposes. -
Evaluate the significance and number of similarities and
dissimilarities in handwriting.

COLLECTION, PRESERVATION AND PROPER HANDLNG OF PHYSICAL

EVIDENCE

EVIDENCE is a proof of allegation. Under the Rules of Court, EVIDENCE

is defined as a means, sanctioned by this rules, of ascertaining in a judicial
proceeding the truth regarding a matter of fact.

PHYSICAL EVIDENCE is anything that has material importance which

can be used to help establish the nature of the crime/offense committed
or establish the identity of the perpetrator of the crime and maybe
presented in court for proper consideration.

SEARCHING FOR THE PHYSICAL EVIDENCE

All your knowledge as to the actual practice of forensic photography

must be applied in collecting and/or searching for the physical evidence.
Even before reaching the crime scene where you are assigned to collect
physical evidence you should have an idea of what crime may have been
committed. Prepare yourself on what physical evidence you’re going to
searched and the information it can give you in relevance to the crime
committed and ultimately identify the perpetrator of the crime. Always
bear in mind that there is only one chance to search the crime scene
properly; so a cautious approach must be conducted, search first on the
visible areas, avoiding evidence loss or contamination, then conduct a
vigorous search on the concealed area.

KINDS OF PHYSICAL EVIDENCE:

 FIXED - are those evidence that cannot be moved and/ or

impossible to collect in its entirety for delivery in the
laboratory and subsequently presentation in court.

 MOVABLE - can be collected or moved and deliver to the

laboratory for examination and can be presented in court
in its original form.

USES OF PHYSICAL EVIDENCE:

1. To identify persons involved in the crime. Before going to the crime

scene, think of what are some of the physical evidences that would
most probably identify the person who committed the crime.
Fingerprints found in the crime scene or even footprints. Traces of
blood stains which can be seen as a brownish stain on the floorings,
walls or some objects which are part of the crime scene.

2. To reconstruct a crime scene.

3. To discredit alibis

SEARCHING/ COLLECTING PHYSICAL EVIDENCE

The crime scene should be searched methodically, carefully,

thoroughly and orderly. Use the four (4) W’s - what, where, when, why and
the one (1) H - how and WHEN is the perfect time to collect these physical
evidences. Upon searching for these physical evidence. WHAT - is the right/
correct evidence that you can collect that would help in the identity of the
perpetrator of the crime. WHERE - can you find/ locate these of pieces of
physical evidence. WHY - are you collecting this physical evidence? And
lastly, how are you going to collect them.

 Here are some of the basic considerations to a good search and a
good method of collection:

1. Photograph the whole crime scene in full view. This will preserve the
initial condition or appearance of the crime scene or the physical
evidences in the crime scene. Photograph all items before collection
and take note of the location where it was found.

2. Use appropriate tools and materials in collecting physical evidences.

3. Collect sufficient samples for complete examination. Obtain known

standards like hair, blood samples from victim and suspect.

4. Mark each evidence collected for identification and seal the

evidence package. Ensure all evidences are secured. Make sure that
hiding places or difficult access areas have not been overlooked.

5. Photograph the scene showing final condition after collection of

physical evidences.

MAINTENANCE OF CHAIN OF CUSTODY OF ALL PHYSICAL EVIDENCES

COLLECTED

Each person handling the evidence is responsible to the proper chain

of custody. Whenever the evidence is to transfer possession from one
person to another, the person receiving it must properly acknowledge it a
receipt. The most ideal is to maintain a short chain of custody is to let the
expert collect the necessary evidence in the scene of the crime and
directly bring it to laboratory for examination. But if it cannot be avoided
that an Investigating agent or a police officer is to collect the evidence in
the crime scene, and then they must be the one to hand carry it to the
laboratory.

EVIDENCE SUBMISSION AND REQUESTING FOR EVIDENCE EXAMINATIONS

All requests for evidence examinations should be in WRITING, addressed

to the NBI/ PNP Forensic Laboratory and should contain the following
information:

 The submitting contact person’s name, agency, address and

telephone number.

 Description of the nature and the basic facts concerning the case as
they pertain to the laboratory examinations.

 The name or names of and descriptive data about the individual or

individuals involved (subject, suspect, victim or a combination) and
the agency assigned case identification number.

 A list of the evidence being submitted herewith (enclosed) or under

separate paper/ cover.

 Herewith is limited to small items of evidence that are not

endangered by transmitting in an envelope. Write all
marking in the envelope before placing evidence inside to
avoid damaging or altering the evidence. The written
communication should state: Submitted herewith are the
following items of evidence for examination.

 Separate cover/paper is used to ship numerous or bulky

items of evidence. Include a copy of the communication
requesting for examinations. The written communication
should state: Submitted under separate cover by (state the
method of shipment) are the following items of evidence.
(Clearly describe each evidence)

 State what types of examinations are requested.

  State where the laboratory report should be sent.

 If immediate result is needed, state the reason or reasons for an

expeditious examination.

CARE, HANDLING AND PRESERVATION OF DOCUMENTS

Serious curtailment of a certain technical examination is caused by

improper or careless handling of a disputed document. This conditions most
frequently brought about by ignorance of the consequences of
mishandling. The simple act of repeatedly removing and replacing the
letter in its envelope can cause a noticeable determination.

The following are the DO’s and DON’T’s in the care on handling and
preservation of documents:

DO’s

1. Keep the documents unfolded in prospective envelopes.

2. Take disputed papers to Document Examiner’s Laboratory at the first

opportunity.

3. If storage is necessary, keep in dry place away from excessive heat

strong light.

DON’T’s

1. Do not handle disputed papers excessively or carry them in pocket for a

long time.

2. Do not mark disputed documents, either by consciously writing

instruments or dividers.

3. Do not mutilate or damage repeated refolding, creasing, cutting,

tearing or punching for filing purposes.

4. Do not allow anyone, except qualified specialist to make chemical or
other tests and do not treat or dust for latent fingerprints before
consulting a document examiner.

A disputed document subject to scientific examination certainly

deserves better than average care. It generally keeps a paper in good
conditions and prevents damage or deterioration between the time it first
comes under suspicion and when it is turned over to the document
examiner.

Charred documents which are extremely fragile must be handled as

little as possible and transporting them to the laboratory required extra-
ordinary care. With forethought and caution they can be brought from the
distant fire scene to the laboratory. It should be moved in the container in
which they are found whenever possible. When the fragments are not
packed tightly, it should be padded with lightweight absorbent cotton. If
jarring cannot be entirely eliminated, jarring the box must be kept to a
minimum. Transferring the fragments to another container should be done
by an experienced person. No attempt should be made to unfold the burnt
papers or to flatten curled sheets. Decipherment of a charred document
which has been shattered into small fragments is almost impossible.

Thus, every precaution must be taken in handling and transporting

the charred residue in order to prevent the large pieces from becoming
unnecessarily and badly broken. The fragment must be hold firmly without
crushing and present movement or shifting when finally packed in a sturdy
container.

CARE AND PRESERVATION OF QUESTIONED DOCUMENTS

1. Preserve the document precisely in the condition in which it was

originally received.

2. Do not underscore, make careless markings, fold, erase, impress rubber
stamps, sticker, write on, or otherwise alter any handwriting.

3. Do not smear with fingerprints power or chemicals.

4. Do not carry handwriting document carelessly in wallet, note book or

brief case in grounds of interviews.

5. Do maintain in consequential document, unfolded and in transparent

plastic envelope or evidence preserver.

THE CARE OF DISPUTED DOCUMENTS AND DOCUMENTARY EVIDENCE

a. It is a basic requirement, not only a common sense principle, that

when a document becomes disputed and deposited in court or with
the attorney, in order to maintain its original condition, it should be
kept unfolded and in a separate proper size envelope or folder. This
is true not only for the disputed documents, but for many other
important documentary evidence.

b. It is also advisable and preferable in all instances that right after the
document becomes disputed, questioned or important, to make not
only the usual photo static copy, but also a proper photograph or
photo-enlargement done, it is possible by the document expert or
under the supervision of the document expert.

c. When working in the preparation of case, it is often necessary for the

lawyer or court to handle repeatedly the disputed document. Should
this be necessary, instead of handling and working with the original
document, the photograph should be used.

d. Every touching, folding, refolding or pointing to certain parts of a

document, it can change the physical condition of the case. For
example, touching with wet hands or fingers can leave marks that

 create a suspicion of previous pencil marks, or experiments as proof
of attempted forgery.

e. Pointing a document with any other instruments, such as sharp stick,

can cause slight damage with although it cannot be seen by the
naked eye, can show definite marks under the microscope or on the
enlarged photograph.

f. No test should be made to alter the condition of the document; for

example, the old-fashioned ink test, which was used to determine the
age of the ink-writing.

g. Should any test be necessary, insist that it should be done in the

presence of a chemist, or in court, or in front of both parties involved
the case.
