SUBJECT : Implementing Guidelines of COMELEC Resolution Number
10924 Re Reassignment and Detail of Uniformed Personnel
during the Election Period

1. Reference: Memorandum from TDPRM dated July 28, 2023 with the same
subject stated above.
2. This pertains to the prohibited acts during the election period constituting
election offense as provided under section 261(h) of the Omnibus Election Code:
Sec. 261 Prohibited Acts — The following shall be guilty of an election offense:
(@)...
(h) Transfer of officers and employees in the civil service. — Any public official
who makes or causes any transfer or detail whatever of any officer or employee
in the civil service including public school teachers, within the election period
except upon prior approval of the Commission.
3. Consequently, the COMELEC promulgated Resolution No. 10924 on June
7, 2023 granting the PNP the conditional authority to transfer or detail uniformed
personnel during the election period as well as setting the guidelines requiring the PNP.
to submit its request for authority to make or cause any transfer or detail of uniformed
personnel.
4. In this regard, the following shall be the implementing guidelines in the
processing of reassignment and/or detail of uniformed personnel during the election
period (September 30, 2023 to November 6, 2023) based on COMELEC Resolution
No. 10924:
2. ) How to file Request for Authority to Transfer or Detail. Requests for
authority to make or cause any transfer or detail of uniformed
personnel shall be:
1.) in writing;
2. ) indicating the office and place to which the personnel is proposed
to be transferred or detailed;
3. ) stating the reasons for the transfer or detail; and
4. ) all other data or information as the agency may deem important or
necessary regarding the same.

b. ) Where to File. Requests for authority to make or cause any transfer or
detail of uniformed personnel shall be filed in:
1. ) Law Department, COMELEC — when the transfer or detail is inter-
regional, both intra and inter-regional, involves 3 Level PCOs or
the personnel is assigned at the National Headquarters; and
2. ) Office of the Regional Election Director — when it involves intra-
regional transfer/detail of 2"! Level Uniformed Personnel.
c. ) Conditions for the Grant of Continuing Authority to Transfer or
Detail. Transfer or detail orders may be issued without prior request for
authority from the Commission subject to the following conditions:
1. )Itis essential to the proper functioning of the office and shall not in
any manner influence the conduct of the Barangay and
Sangguniang Kabataan Elections (BSKE);
2. ) The authorization shall be in prospective in application and without
prejudice to the applicable Civil Service Law, rules and regulations
on personnel actions/movement;
3. ) It shall not involve promotion and giving of any increase of salary or
remuneration or privilege during the forty-five (45) days period
before the conduct of BSKE which is prohibited; and
4, ) They shall notify the Commission, in writing, within three (3) days
from the date of transfer or detail through the Legal Department as
follows:
a. ) the office and place where the officer came from and the
office/place to which said officer is transferred, detailed or
otherwise moved;
b. ) justifications and reasons for said transfer or designation; and
c. ) all necessary data or information regarding the same. Likewise,
the written notice shall be sent to the Law department via email
at law@comelec,qov.ph as well as through registered
mail/recognized courier service.
5. Further, all request for the issuance of reassignment or detail orders
submitted to this Office must state clearly the justifications and must satisfy the
conditions set forth by the COMELEC and this Directive. In order to determine the
application rules, all requests must indicate the projected designation, the location
of such whether it will involve a change in the geographic location of the
concemed personnel,
6. Finally, all personnel are reminded that issuance of antedated orders which
in effect shall bypass the statutory prohibition is not allowed. Such act will be dealt with
accordingly and may give cause for criminal prosecution for election offense. Submit
your weekly report of reassignment and detail, following the attached format, to this
Office (Attn: Placement Section) every Wednesday during the election period via
signed scanned and editable copy.
