From of Agreement to be executed before drawing an Advance for the purchase of a
motor vehicle
AN AGREEMENT made on ---------------------------------------------- day of two thousand and
twenty two (2022).
BETWEEN Shri Dillip Kumar Sahoo, Section Officer (hereinafter called the borrower which
expression shall include his heirs, administrators, executors and legal representative) of the
one part and the GOVERNOR OF ORISSA herein after called to Governor which expression
shall include his successors and assignee is of the other part;
WHEREAS the Borrower has under the provision of the Orissa General Financial Rules
(hereinafter referred to as the said Rules which expression shall include any amendments
thereof for the time being in force) applied to the Governor for a loan of Rs. 15,00,000/-
(Fifteen Lakhs Only) for the purchase of a Motor Vehicle;
AND WHEREAS the Governor has agreed to lend the said amount to the Borrower on the
terms and conditions hereinafter contained;
NOW IT IS HEREBY AGREED between the parties here to that in consideration of the sum of
Rupees 15,00,000/-(Fifteen Lakhs Only) to be paid by the Governor to the Borrower, the
Borrower here by agrees with the Governor (1) to pay to the Governor the said amount with
interest calculated according to the said Rules by monthly deductions from his salary as
provided for in the said Rules by monthly deductions from his salary as provided for in the
said Rules and hereby authorities the Governor to make such deductions and (2) within one
month from the date of payment of the said sum to expend the full amount of the said loan
in the purchase of a Motor Vehicle or if the actual price paid is less than the loan to rapay
the difference to the Governor forthwith and (3) to execute a document hypothecating the
said Motor vehicles to the Governor as security for the amount to be lent to the Borrower as
aforesaid and interest in the form provided by the said Rules;
AND IT IS HEREBY LASTLY AGREED AND DECLARED that if the Motor Vehicle has not been
purchased and hypothecated as aforesaid within one month from the date of the payment
of the said sum or if the borrower within that that period becomes insolvent or quits the
service of Government or dies, the whole amount of the loan and interest accrued thereon
shall immediately become due and payable.

Sir,
In inviting a reference to the above cited subject, it is to state that Government in
Finance Department, Odisha vide O.M No. 3201 Dt. 30-01-2023 have framed the scrapping
policy for condemned Government vehicles wherein the life span of Government vehicles has
been fixed at 15 Years or 250000 kms (Distance travelled), which occurs earlier. Further, it
has also been mandated that disposal of such vehicles, shall be ensured through the
Registered Vehicle Scrapping facility and the vehicles declared condemned or reaching 15
years of life span whichever is earlier shall not be sold through auction to pursue environment
friendly practices towards reduction of pollution and optimum usage of fuel efficiency.
In the above context, the Additional Chief Engineer, Mechanical (R&B) Circle,
Bhubaneswar have furnished a list of Government motor vehicles (16 Nos.) with life span of
15 years and above along with the officers using the vehicles in the interest of Government
works (Annexure-I). The Superintending Engineer, Mechanical (R&B) Division,
Bhubaneswar have also furnished a detailed information regarding the date superannuation of
the concerned drivers driving the aforementioned Government vehicles (Annexure-II).
In view of the facts stated above, it is requested that necessary permission may please
be granted for procurement of new motor vehicles / hired vehicles against the aforesaid
condemned Government vehicles used by the entitled officials and instruction may also be
communicated to the undersigned regarding engagement of the drivers of the said condemned
vehicles for their remaining period of Government service.
