Visitor None ORDINANCE NO. 2022 - 2297 AN ORDINANCE APPROVING THE FIRST LAGUNA FEDERATION IN LOS BANOS TRICYCLE OPERATORS AND DRIVERS ASSOCIATION, INCORPORATED (FLFILBTODA, INC,) MINIMUM FARE GUIDE WITH A MINIMUM FARE INCREASE FROM TEN PESOS (PHP 10.00) TO FOURTEEN PESOS (PHP 14.00) IN THE BIUNICIPALITY OF LOS BANOS. Alipon, REE, RMP, MPA WHEREAS, municipalities and cities, through their respective sanggunians, are granted the power to regulate the operation of tricycles and grant franchises within their respective jurisdictions subject to the guidelines prescribed by the Department of Transportation and Communication (DOTC) pursuant to Sections 447 (3) (vi) and 458 (3) (vi) of the Local Government Code of 1991: WHEREAS, the Sangguniang Bayan of Los Bafios enacted Municipal Ordinance 2011- 1082 dated October 17, 2011 entitled “New Municipal Ordinance on the Franchise and Operation of Motorized Tricycles in Los Bafios, Laguna to be known as the "New Ordinance for Tricycles in the Municipality of Los Bafios’! Bagong Kautusang Pambayan na Nagsasaad ng Pagpapaprangkisa at Pamamahala ng Operasyon sa Lahat ng Traysikel na may Motor sa Bayan ng Los Bafios, Laguna na Tatawaging “Bagong Ordinansa para sa mga Traysikel sa WV Hee2.00 Ordinance No. 2022-2297 04/01/2022 WHEREAS, Ordinance No. 2011-1082 and Executive Order No. 149 Series of 2019 both state the powers and functions of the Municipal Tricycle Pedicab Franchising and Regulatory Board (MTPFRB) as a policy making body and define the Tricycle Regulatory Unit (TRU) as the implementing body of the Board under the management and supervision of the Office of the Municipal Mayor; WHEREAS, the Municipal Goverment appreciates the role of the First Laguna Federation in Los Bafios Tricycle Operators and Drivers Association, Incorporated (FLFILBTODA, Inc) in providing transport service and its support in maintaining peace and ‘order and public safety in the locality; WHEREAS, the FLFILBTODA, Inc. submitted their request for tricycle fare increase to the Board through Kapasyahan Big. 1 Serye 2022 dated March 6, 2022, “Kapasyahan Pinagtibay ng mga Tagapanguna ng Samahan_o First Laguna Federation in Los Baflos Trieycle Operators and Drivers Assocication (FLFILBTODA), Inc. na Humiling sa Ating mga Nanunungkullan na Dagdag Pamasahe sa Kadahilanang Mataas na ang Presyo ng Produktong Petrolyo at Iba Pang Gamit o Materyales (Spare Parts) ng Traysikel”. Accordingly, the august body was furnished a copy of the MTPFRB Resolution formally accepting the request for information and appropriate action; WHEREAS, prices of gasoline, diesel and kerosene continue to increase amid the ‘ongoing Russia-Ukraine conflict. Further, the federation cited that prices of spare parts have also increased for the period 2018 to 2022. Price hike of petroleum products and spare parts have dramatically decreased the income of tricycles and operators in the municipality thereby affecting the quality of life of their respective families; WHEREAS, a Public Hearing was conducted to evaluate the implications of the proposed fare increase of tricycles in the municipality, led by the Sangguniang Bayan Committee on Transportation and Communication; WHEREAS, upon careful perusal on the issue at hand, the august body deemed it proper and timely to grant the request of the FLFILBTODA, Inc.; NOW THEREFORE, on motion of Honorable Councilor Marlo PJ A. Alipon, duly seconded by Honorable Councilor Geronimo A. Ciceron and approved by all councilors present; BE IT ENACTED BY THE SANGGUNIANG BAYAN OF LOS BANOS IN SESSION DULY ASSEMBLED THAT: SECTION 1. SHORT TITLE - This Ordinance shall also be known as “THE NEW a FARE GUIDE OF 2022 OF THE MUNICIPALITY OF LOS BaANos”. SECTION 2. —TRICYCLE FARE RATES: A. AMOUNT OF FARE - The minimum fare increase from Ten Pesos (Php 10.00) to Fourteen Pesos (Php 14.00) is hereby approved: KINDS OF TRIP AMOUNT OF FARE ‘Regular Trip Php 14.00/passengerftrip for the first km. and additional One Peso (Php 1.00) for every km in excess hereof Special Tip (@) Regular Route - Amount equivalent to one (7) Trp or the amount equivalent to 4 passengers (Regular Fare x 4 passengers); (b) ‘Agreed Amount by both Parties. All tricycles for hire with franchise in the Municipality of Los Bafios shall post the New Tricycle Fare Matrix Inside the tricycle sidecar within the passenger's view upon ‘the implementation of this Ordinance. LOWER FARE RATES. The Sangguniang Bayan, upon its discretion and proper notice, may lower foregoing fares in the interest of the general welfare of the public. IMPLEMENTATION. The Tricycle Regulatory Unit (TRU) is hereby authorized to implement the provisions of this Ordinance. REPEALING CLAUSE. All ordinances, rules and regulations or parts, not consistent with any provision of this Ordinance are hereby repealed, amended or modified accordingly. SEPARABILITY CLAUSE. if, for any reason, any part or provision of this Ordinance be declared invalid, any part or provision not affected thereby, shall remain in full force and effect. EFFECTIVITY.
