NAPOLCOM Memorandum Circular (MC) No. 2010-003 entitled: “Establishing a Delinquency Reporting System in the Philippine National Police and Institutionalizing Community Service as an Integral Component Thereof’ dated September 30, 2010”; (TAB A) b. PNP MC No. 2015-001 entitled: “Supplemental Guidelines on the Delinquency Report System (Strengthening the Disciplinary Authority of Chief of Police)"; (TAB B) c. PNP MC No. 2015-033 entitled: “Amending Sub-Paragraph G, of Paragraph 4 PNP MC No. 2014-025 dated July 28, 2014 entitled “Delinquency Report System (Strengthening the Disciplinary Authority of Chiefs of Office)” and Sub-Paragraphs A(1) and A(2) of Paragraph 6, PNP MC No. 2015-001 dated February 16, 2015 entitled “Supplemental Guidelines on the Delinquency Report System.” (TAB C); and d. PNP MC No. 2014-025 entitled: “Delinquency Report System (Strengthening the Disciplinary Authority of Chiefs of Office).” (TAB D) 2. This pertains to the reimplementation of the Delinquency Reporting (DR) system and incorporation of fatigue duty as sanction for erring personnel of the Philippine National Police (PNP). It aims to respond to the growing demands for a just and expeditious manner of on-the-spot corrections of misdemeanors or minor infractions involving breach of internal discipline without the need for a full blown summary hearing proceedings and to address the increasing number of pending administrative cases. 3. All Chiefs/Heads of Offices are directed to implement the DR System against erring PNP personnel following the herein guidelines on the minor offenses involving breach of internal discipline covered with corresponding demerits and the prescribed fatigue duty hours: (AN ALA oTeDs 01021!BO vapar 2 Bac eas rev > L ae as fowaya. The list of offenses and number of demerits as provided in PNP MC No. 2014-025 and PNP MC No. 2015-001 are adopted, to wit: Offenses No. of | Fatigue Duty Demerits Hours A. Violation of “Tamang Bihis” of uniformed 3 | 1% hours personnel such as: a.1 Unauthorized or improper wearing of uniform 3 1% hours insignias and accoutrements ‘a.2 Unauthorized/improper haircut 3 1% hours .3 Dirty shoes/unauthorized shoes 3 1% hours a.4 Dirty uniformiwearing of faded/tucked out athletic uniform/wearing of colored rubber 3 1% hours shoes - | a.5. Unshaved mustache/improper shaving 3 1% hours a.6 Improper haircut/nail polish/long and dirty | finger nails 3 | 1% hours 2.7 Not wearing haimets during command activities ee 3 1% hours 2.8 No hanky/tickler /Miranda warning card (as, required during inspection) 3 1% hours B. For NUP b.1 Non-compliance with the approved and 3 1% hours prescribed NUP uniform for Monday, Wednesday, and Friday b.2 Wearing the following prohibited attire when 3 1% hours performing official functions in the workplace during Tuesdays and Thursdays; b.2.1 Gauzy, transparent or net-like shirt or blouse 3 1% hours b.2.2 Sando, tank-tops, strapless or spaghetti strap blouse (unless worn as undershirt) and blouse 3 | 1% hours with over-plunging necklines b.2.3 Micro-mini skirt, walking shorts, cycling 3 1% hours shorts, leggings, tights, jogging pants jo b.2.4 Rubber sandals, rubber slippers, bakya 3 1% hours b.2.5 Dangling earrings, flamboyant accessories, 3 1% hours heavy make-ups _ b.2.6 Mustache and visible tattoos 1% hours C. Tardiness in reporting for duty/office work 2% hours D. Tardiness in reporting to command activities 2% hours E. Smoking while on duty 5 | 2% hours F. Violation of traffic, pedestrian, and parking 5 2% hours regulations within the camp G. Violation during troop formation/parade: 5 2% hours g.1 Moving in ranks 5 2% hours g.2 Speaking during formation 5 2% hours "9.3 Use of cellular phones during formation 5 2% hours 9.4 Walking or roaming around while program is 5 2% hours‘on-going a 9.5 Standingononeleg 5 2% hours H. Use of vulgar or insulting language or exhibit similar rudeness to the public. aan 7 3 % hours I. Spitting or littering in public areas 7 3 % hours J. Urinating in places other than the designated areas (restroom, public urinating area) 10 5 hours K. Dozing on post 10 5 hours L. Not observing courtesy to officers/senior officers inside and outside the office/not saluting senior 10 5 hours PCOs a M. Loafing 40 5 hours N. Leaving post while on duty for more than five minutes 15 7% hours ©. Absent in formation or command activities 20 10 hours Only ranking Police Commissioned Officer (PCO) or Police Non- Commissioned Officer (PNCO) who witnessed the commission of any infraction may cite/report the minor offense involving breach of internal discipline to their respective Chiefs of Offices/Units and conduct on- the-spot correction A delinquency report form (DR Form) shall be used to report the offense which must be signed or acknowledged by the violator. The reportee shall note on the DR form if the violator refused to sign/acknowledge his/her violation. The form shall be immediately submitted to the PNP office/unit where the violator is assigned within 24 hours. |. For this purpose, all PNP personnel are required to bring DR forms as part of the uniform to ensure the immediate recording and reporting of the infraction they witnessed. . Administrative Officers shall be in charge of the evaluation of the violator’s explanation and submit the same with recommendation to the Chief of Office/Unit within 24 hours from receipt of the DR form. The Chief of Office/Unit, upon approval of the recommendation, shall give demerits based on the points allocated and direct the personnel to render fatigue duty within their office or camp for a period not exceeding four hours in a day. It shall be understood that in the implementation of fatigue duty, every point of demerit incurred shall be equivalent to 30 minutes of the task. The sanction imposed for incurring demerits is by rendering fatigue duty inside the office or within the premises of a camp. |. HSS or its equivalent office/unit shall submit a report of compliance of violators to the concemed office/unit of the reportee. If a personnel incurred more than 20 demerits in a month or committed a single offense with more than 20 demerits, he/she shall be charged for less grave neglect of duty under NAPOLCOM Memorandum Circular No. 2016-002; If more than 30 demerits in one semester, had been incurred, the following shall be observed: ia. The personnel concerned shall be rated poor in his/her Performance Evaluation Rating for the particular rating period; He shall be recommended to undergo FORM POLICE training or any other equivalent values and reformation trainings; and ic. The demerits shall be considered as an aggravating circumstance and a factor in his/her reassignment. The Administrative Officers/Chiefs, Administrative, Records and Management Division/Branch or Section shall serve as the official repository and record-keeper of the number of demerits earned by the members of the unit. It shall be the duty of the Administrative Officer to furnish the Chief of Office of a monthly report of the demerits earned by the personnel, which shall be used as reference in the rating of IPER. In case of transfer, the Administrative Officer shall ensure that the demerits earned by the personnel shall be formally communicated to the Administrative Officer of the unit where the personnel have transferred. 4.
