Case Study Project Update – 1 March 2021

The new hotel project continues to proceed well. The client has continued to instruct Wendy
Warner of W2 Designs Ltd. Wendy was appointed as the Principal Designer for CDM purposes. As
noted in a previous email from the client, they went for the “hotel only” option (no conference
centre or health club).

You and Wendy guided the client through the tendering process and, after a fair and careful scrutiny
of the bids, determined that Carlton Construction Ltd presented the most economically
advantageous tender. The project will use a JCT MW 20161 contract, including the following details:
 The recitals record that the Employer is SleepGood Hotels Development Ltd and the
Contractor is Carlton Construction Ltd.
 Article 2: £7,825,000
 Article 3: Wendy Warner of W2 Designs Ltd, 42 Designer Square, Bristol, BS1 1AA
 Particulars:
o The Supplemental Provisions do not apply, save for Provision 6 which does. Zara
Abidi‐Harris is the Employer’s nominee and Andrew Hannity is the Contractor’s.
o Article 7 and Schedule 1 do not apply
o Works commencement date: 15 February 2021
o Date for Completion: [see footnote below]2
o Liquidated damages: £1,650 per day
o Contractor’s Public Liability Insurance: £10,000,000
o Insurance: 5.4A applies
o NB: For all other particulars, the default provisions apply
The final contract documents were collated and the contract was formally signed on 8 Feb 2021. All
planning conditions have now been discharged, with appropriate mitigations etc all agreed.

Wendy has continued to work closely with Earthmovers Engineers (“EE”) the civil engineering firm
who the client appointed at an early stage. They worked out a plan to level the rolling hills (including
the area near the M5) such that no net movement of material will be required to or from the site
prior to erection of the hotel building. Whilst the testing confirmed that the waste building material
in the north corner of the site was not hazardous, the client accepted EE’s advice that the cost to
remove it was minimal for the certainty it would bring, so around 20‐25m3 will be removed
(including that material and soil embedded with it). EE also planned the traffic mitigation steps
required by the local council for planning purposes. Consideration was given to having EE undertake
these works directly, as a first phase under a separate contract, but in the end it was agreed that
Carlton Construction would do the work, with EE acting as a consultant. Carlton’s tender (and
ongoing plans) fully reflect all of these considerations.

The hotel will have a main entrance in the front section and guest bedrooms on two floors, arranged
in a rectangle around a central courtyard. The front section of the building will include the main
reception area and lounge. The lounge has a small bar for guests, connecting into the kitchen which
itself links to the restaurant area. Offices and maintenance facilities are also here. The main
entrance will have a small canopy outside, and a large curtain glass wall to the reception area. A
section of the roof over the reception area will also be glass, to maximise natural lighting. Most of
the rest of the exterior will be a standard plaster render finish.

Carlton took possession of the site and work has started as planned.

In practice, the JCT MW contract form would not likely be advisable for a project of this size and scope. If
using a JCT contract, the IC or SBC forms would likely present a more proportionate and risk‐balanced option.
The MW form is being used in this exercise for reasons of expediency and practicality. Students do not need to
raise this as a concern with the client.
