PEDERASYON

INTERNAL RULES OF PROCEDURES

RULE 1
MEMBERSHIP

Section 1: COMPOSITION
The Sangguniang Kabataan Pambayang Pederasyon of Aritao, Nueva Vizcaya, the Legislative Body of
the municipality shall be composed of the Sangguniang Kabataan Pambayang Pederasyon President, the six (6)
elected Officers of Sangguniang Kabataan Pambayang Pederasyon, SK Pambayang Pederasyon Members.

Section 2: TERM OF OFFICE


The Term of Office of the Sangguniang Kabataan Pambayang Pederasyon President and the six (6)
elected SK Pambayang Pederasyon officers shall be two (2) years starting at noon of June 30 in accordance with
the Local Government Code of 1991.

Section 3: OATH OF OFFICE


All members of Sangguniang Kabataan shall upon assumption to office to take oath of office or
affirmation in the prescribed from duly before a person authorized to administer oath.

*Copies of the Oath of Office shall be filed with the Offices of the Sangguniang Kabataan Pambayang
Pederasyon President and the Sangguniang Kabataan Pambayang Pederasyon Vice-President and a copy be
furnished to the Office of the Human Resource and Management Officer.

RULE 2
OFFICERS OF THE SANGGUNIANG KABATAAN FEDERATION, THEIR RIGHTS AND DUTIES

Section 1. OFFICERS. The Officers of the Sangguniang Kabataan Pambayang Pederasyon of Aritao, Nueva
Vizcaya shall be the following:

1. The Presiding Officer. The duly elected SK President shall be the Presiding Officer of the
Sangguniang Kabataan Pambayang Pederasyon, and as such, shall have the following rights and
duties;
a. To preside over the sessions of the Sangguniang Kabataan Pambayang Pederasyon;
b. To exact from all the members, present during the session proper deportment and decorum;
c. To enforce the Internal Rules of Procedures of the Sangguniang Kabataan Pambayang
Pederasyon;
d. To maintain order during sessions and render a ruling on questions of order, subject to appeal
by the member concerned to the August body for final decision;
e. To sign all the legislative documents, papers or checks requiring his signature;
f. To declare a recess during recess anytime he deems it necessary provided that the duration of
the recess is less than fifteen (15) minutes;
g. To declare the session adjourned to some other date, time and place in cases of extreme
emergencies, serious and uncontrollable disorder, public disturbances and other unavoidable
circumstances;
h. To make brief remarks, comments or clarificatory questions on any measure pending
deliberation by the body provided that he shall not express himself either for or against said
measure or question;
i. To vote but only to break a tie. Hence, he cannot vote in order to create a tie. His right to vote
break a tie is compulsory. He may or may not exercise it;
j. To relinquish the Chair to any member of the Sanggunian who shall act as “Temporary
Presiding Officer” but only if he is going out of the session hall for whatever reasons.
Note: The Regular Presiding Officer shall not be a chairman of any standing committee. He may,
however be elected as chairman of any special or ad-hoc committee which the Sangguniang
Kabataan Pambayang Pederasyon may organize for specific purposes.

2. The Temporary Presiding Officer. There shall be a Temporary Presiding Officer to be elected from
among the members by a majority vote of the Sangguniang Kabataan Pambayang Pederasyon who,
without losing his status as a regular member including his rights and prerogatives, shall temporarily
exercise all the powers, duties and functions of the Regular Presiding Officer.

In the event of the inability of the Regular Presiding Officer to preside over the Sangguniang
Kabataan Pambayang Pederasyon Session, the members present thereby constituting a quorum shall
elect from themselves a “Temporary Presiding Officer”.

The Temporary Presiding Officer shall certify within the (10) days from the passage of ordinance
enacted and resolution adopted by the Sanggunian in the session over which he temporarily presided.

While presiding, The Temporary Presiding Officer shall have no right to vote even if there is a tie.

The Temporary Presiding Officer may motu propio, relinquish the Chair temporarily to any member
of the Sangguniang Kabataan Pambayang Pederasyon if he would like to go down the floor and
participate in the deliberation in his capacity as a regular and constituent member.
3. The Secretary. The appointment of the Sangguniang Kabataan Pambayang Pederasyon Secretary
shall be in accordance with civil service law, rules and regulations. His compensation, allowances and
other emoluments shall be determined by law or ordinance.

The regular duties and functions of the Secretary shall be to take charge of the Office of the
Secretary to the Sangguniang Kabataan Pambayang Pederasyon and shall:
a. Attend session of the Sangguniang Kabataan Pambayang Pederasyon and keep the
minutes of its proceedings;
b. Record in a book kept for the purposes, all ordinances and resolutions enacted or adopted
by the Sangguniang Kabataan Pambayang Pederasyon with the dates of their enactment
and publication thereof;
c. Forward to the Sangguniang Bayan and Municipal Vice-Mayor, Municipal Mayor for
appropriate action ordinances and resolutions enacted or adopted by the Sangguniang
Kabataan Pambayang Pederasyon which have been certified as such by the Presiding
Officer within ten (10) days after their enactment or adoption;
d. Keep the Official Seal of the Local Government Unit and affix the same with his
signature to all ordinances, resolutions and other official acts of the Sangguniang
Kabataan Pambayang Pederasyon and present the same to the Presiding Officer for his
signature;
e. Attest to all ordinances and resolutions approved by the Sangguniang Kabataan
Pambayang Pederasyon and signed by the Municipal Mayor.
f. Forward to the Sangguniang Panlalawigan for review copies of duly approved resolutions
and ordinances within seventy-two (72) hours after the approval;
g. Translate into the local dialect used by the majority of the people of the municipality of
all ordinances and resolutions immediately after their approval, and have the translation
posted, together with original version at the main entrance of the municipal hall and into
other conspicuous public places in the area;
h. Upon request, furnish certified true copies of all records and documents in his custody
not otherwise classified as confidential, upon payments to the Municipal Treasure of such
fees as maybe prescribed by an ordinance;
i. Keep records in his office which are not confidential character open to public inspection
during business hours;
j. Act as custodian of the public library and archives, if any and annually account for
properties therein; and
k. Exercise such other powers and perform such other functions as may be prescribed by
law or ordinance.
The inherent functions and duties of the Secretary to the Sangguniang Kabataan Pambayang
Pederasyon shall:
1. Call the roll of the members at the start of the session and during nominal vote;
2. Read minutes of the previous session;
3. Read before the Sangguniang Kabataan Pambayang Pederasyon all submitted and
received proposed ordinances, resolutions and other papers;
4. Assign numbers to draft and approved ordinances and resolutions;
5. Distribute proposed ordinances and resolutions and transmit other papers and records to
the proper committee;
6. Notify committees of their appointment or creation;
7. Send out notices or called meetings and public hearings;
8. Furnish the members with copies of approved ordinances, resolutions and other official
acts of the Sangguniang Kabataan Pambayang Pederasyon;
9. Provide technical Support to the Sangguniang Kabataan Pambayang Pederasyon as a
body and the individual members of the Sanggunian in the performance of the legislative
functions; and
10. Conduct researches in aid of legislation.

If the Sangguniang Kabataan Pambayang Pederasyon Secretary is absent or hindered by physical reasons
from performing some of his duties, such as reading of minutes, resolutions, ordinances, communications
and other documents or papers, the same may be performed by a substitute secretary who may be
designated for the purpose by the Presiding Officer.

RULE 3
POWERS, DUTIES AND FUNCTION OF THE SANGGUNIANG KABATAAN PAMBAYANG
PEDERASYON

Section 1: The powers, duties and function of the Sangguniang Kabataan Pambayang Pederasyon shall be
provided for under Rule 17 of the Rules and Regulation Implementing the Local Government Code of 1991.

RULE 4
DUTIES AND RESPONSIBILITIES OF INVIDUAL SANGGUNIANG KABATAAN PAMBAYANG
PEDERASYON MEMBERS

Section 1: Every member of the Sangguniang Kabataan Pambayang Pederasyon shall make a full disclosure of
his financial and business interests as required of him under Article 104, Rule 17 of the Implementing Rules and
Regulation of the Local Government Code of 1991.

Section 2: Every member shall attend all the sessions of the Sangguniang Kabataan Pambayang Pederasyon
unless he/she is prevented from doing so by reason of sickness or other unavoidable circumstances provided that,
as general rule, previous notice shall be sent to the Sangguniang Kabataan Pambayang Pederasyon members thru
the Presiding Officer or the Secretary.

Section 3: As a general rule, every member is required to vote on every question or proposed measure being
voted upon by the Sanggunian. Abstentions may only be allowed if it can be shown that the member concerned
has a pecuniary interest, either directly or indirectly on the matter being acted upon the body.
Section 4: Every member shall observe proper deportment and decorum during session.

RULE 5
COMMITTEES

Section 1: CREATION OF COMMITTES. The following rules shall be observed in the creation of the
committees:
a. A regular or standing committee may be created or re-organized by a majority vote of all the
members of the Sanggunian;
b. The Presiding Officer may recommend the creation or re-organization of any regular or standing
committee. The Sangguniang shall act on his/her recommendation without debate and act it
immediately;
c. Special or Ad-Hoc Committees may be created upon the initiative of the Chair or thru a motion by
any member, subject however, to the affirmative votes of a majority of the members present, there
being a quorum.

Section 2: STANDING COMMITEES. The Sangguniang Kabataan Pambayang Pederasyon of Aritao, Nueva
Vizcaya shall elect the Chairperson and members of the following committees, the general jurisdiction of which
shall be as hereunder provided:

1. COMMITTEE ON EDUCATION AND CULTURE – Responsible for overseeing all SK matters, that
is, policy and programs or projects related to education and culture. Mainly, the committee is tasked to
ensure that education is a matter of priority and culture is kept alive among the youth and community as a
whole.

2. COMMITTEE ON ENVIRONMENTAL PROTECTIO, CLIMATE CHANGE ADAPTION


(CCA), AND DISASTER RISK REDUCTION AND RESILIENCY (DRRR) – Responsible for all
SK matters related to environment and disaster preparedness. The committee is tasked to ensure that the
youth are made aware of and capacitated regarding protection of the environment and preparedness in
times of calamities.

3. COMMITTEE ON YOUTH EMPLOYMENT, AND LIVELIHOOD – Responsible for all SK affairs


related to promoting employment and livelihood opportunities for the youth.

4. COMMITTEE ON HEALTH, HEALTH SERVICES, AND REPRODUCTIVE HEALTH –


Responsible for all SK matters related to the health of youth.

5. COMMITTEE ON ANTI-DRUG ABUSE AND SOCIAL PROTECTION – To safeguard the welfare


of the youth, anti-drug and social protection committee should be created.

6. COMMITTEE ON GENDER AND DEVELOPMENT – This committee manages ass SK matters


concerned with gender and development (GAD).

7. COMMITTEE ON SPORTS DEVELOPMENT - This committee is in-charge of managing all SK


matters related to sports development among the youth and among community members as a whole.

8. COMMITTEE ON RULES, PRIVILEGE AND LEGAL MATTERS – All matters related to the
conduct, rights, safety, dignity, integrity and reputation of the Sanggunian and its members. Also, all
matters related to the discharge of the quasi-judicial power of the Sanggunian are referred to this
committee. The same shall also consider the legality of proposed resolutions, ordinances, actions and all
documents, deeds, petition, communication and papers submitted by lower LGU’s, and need to be acted
upon; all matters affecting the Sangguniang Kabataan Pambayang Pederasyon Internal Rules of
Procedure and violation thereof; Order of Business and Calendar of Business; and all issues which affect
the privileges of the members.

Section 3: MEMBERSHIP OF THE STANDING COMMITTEE. Each Standing Committee shall have a
Chairperson, a Co-Chairperson and members whose selection shall be determined by the Sangguniang
Kabataan Pambayang Pederasyon, provided that the sectoral representatives shall chair the committees
corresponding to their respective sector. Every Sangguniang Kabataan Pambayang Pederasyon member is
entitled to be a member of three (3) standing committees unless otherwise authorized by the majority of the
members.

Within one (1) week after the adoption of the new Internal Rules of Procedure, the Sangguniang Kabataan
Pambayang Pederasyon shall elect the Chairperson of the different committees by “viva voice” vote. The
elected Chairperson shall choose from the members of the Sangguniang Kabataan Pambayang Pederasyon the
Co-Chairperson and the members thereof.

Section 4: LIMITATIONS. No Sangguniang Kabataan Pambayang Pederasyon Members shall be a


Chairperson of more than two (2) standing committees, unless authorized by the majority of the Sangguniang
Kabataan Pambayang Pederasyon.

No member of a particular committee shall act upon or participate in any manner in which he has a special or
direct substantial interest.

Section 5: SPECIAL COMMITTEE. The Sangguniang Kabataan Pambayang Pederasyon may organize
special committees as it may deem necessary. The Chairperson, Co-Chairperson and member of a Special
Committees shall likewise be elected by a majority vote of all the Sangguniang Kabataan Pambayang
Pederasyon Members.

Ad-Hoc Committee. From time to time, as may agree upon the Sanggunian and approved by the
Presiding Officer, Ad Hoc Committee may be created for the sole purpose or particular function to be defined
by the Sanggunian herewith that upon the submission of the Committee Report, such Committee shall cease
to exist automatically.

Section 6: FILLING UP OF VACANCY. Whenever a vacancy occurs or is declared to exist in any of the
committees, the same shall be filled up by election of the Sangguniang Kabataan Pambayang Pederasyon
Members.

Section 7: COMMITTEE MEETING OR HEARING. The committee shall determine the frequency of
their meetings or hearings, provided they meet at least once a month. A majority of all the members of the
committee shall constitute a quorum. Committee meetings or hearings shall be held on in public buildings.

Section 8: COMMITTEE REPORTS AND ORDERS. Committee Reports and Orders on any ordinance or
resolution shall be considered in formal meetings and shall not be submitted to the Sangguniang Kabataan
Pambayang Pederasyon unless accompanied by the minutes of the meeting or hearing of the committee which
adopted them. Securing signatures of committee members in lieu of a formal meeting is prohibited.
When a committee submits a report, the members thereof shall be presumed to have concurred in the report;
the members thereof shall be precluded from opposing the same, unless they have entered their objection
thereto during the committee meeting.
Committee Reports shall be rendered first by the standing committee in the order they are listed in the Internal
Rules of Procedure of the Sangguniang Kabataan Pambayang Pederasyon then by special committee in the
order of their creation.

The report, an official written account consisting of the finding and recommendations of the majority
members of the committee, shall be made by its Chairperson, or he/she dissents with the majority opinion, by
any committee member concurring therein and duly designated for the purposes. If the recommendation is
favorable, the Committee on Rules shall calendar it for Seconded Reading; otherwise, it shall be considered
laid on the table.

Section 9: PERSONAL APPEARANCE. A committee may request, through the Presiding Officers, the
appearance before it of any chief of office or any official of the municipality over which the Sangguniang
Kabataan Pambayang Pederasyon exercises jurisdiction. Any person or official may appear at a committee
meeting or hearing and present his views on any matter of vital import to the committee at such time as the
committee may designate.

Section 10: REPORT ON REFERRALS. All committees shall report on the next regular session to the
Sangguniang Kabataan Pambayang Pederasyon on every matter referred to them by the Presiding Officer.
When a measure is referred to two (2) or more standing committees, the committees concerned may submit a
joint or separate report thereon.

Section 11: SUBMITTAL OF COMMITTEE REPORTS TO COMMITTEE ON RULES. A committee


reporting out a proposed ordinance or resolution, shall submit a copy of its report and a copy of the proposed
ordinance or resolution to the Committee on Rules which shall calendar the same for Second Reading. Copies
thereof shall also be furnished to every Sangguniang Kabataan Pambayang Pederasyon member preparatory
to its consideration on the floor.

Section 12: PARTICIPATION OF NON-MEMBER TO COMMITTEE HEARINGS. Participation of a


non-member of a committee to committee meetings may be allowed, provided, he/she is not allowed to vote
on the subject matter.

RULE 6
SESSIONS

Section 1: REGULAR SESSIONS. The regular sessions of this Sangguniang Kabataan Federation shall be once
a month to be held at the Municipal Function Hall on the first (1st) Friday of the Month and shall start at exactly 9
in the morning. The session shall be held at the Sangguniang Kabataan Session Hall, unless otherwise agreed
upon by the majority of the members.
Any members who arrives thirty (30) minutes after the designated time shall be considered late, and shall be
reflected on the first page of the minutes. However, if a member is committed to an equally important matter prior
to the start of the session, he/she may notify the Presiding Officer through the Secretary, of the same.

Section 2: SPECIAL SESSIONS. Special Sessions is a session which may be called by the Sangguniang
Kabataan Pambayang Pederasyon President or by a majority of the Sangguniang Kabataan Pambayang
Pederasyon Members when public interest so demands.

In special session, a written notice to the Sangguniang Kabataan Pambayang Pederasyon member, stating the
date, time and purpose of the session, shall be served personal at the member’s usual place of residence at least
twenty-four (24) hours before the special session is held.

Unless otherwise agreed upon by two-thirds (2/3) vote of the members present, there being a quorum, no other
matters may be considered at a special session except those sated in the notice.

Section 3: CALL TO ORDER. The Presiding Officer shall open the session by calling the Sangguniang
Kabataan Pambayang Pederasyon to order.

On the first Session day of each month, the National Anthem shall be sung, followed by a one-minute silent
prayer or mediation, or the discretion of the Presiding Officer, an invocation by any Sangguniang Kabataan
Pambayang Pederasyon Members designated to him/her.
Section 4: ATTENDANCE IN SESSION. Every member of the Sangguniang Kabataan Pambayang Pederasyon
shall be present in all sessions, unless expressly excluded by it or necessarily prevented by doing so by sickness or
other unavoidable circumstances duly reported to the Sangguniang Kabataan through the Secretary to the
Sangguniang Kabataan Pambayang Pederasyon.

Section 5: OPEN TO THE PUBLIC. Sangguniang Kabataan Pambayang Pederasyon sessions or meetings or
any committee hearing thereof shall be open to public unless a closed-door session is decided or ordered by an
affirmative vote of a majority of the members present, there being a quorum, in the interest of security decency or
morality or for reasons affecting the dignity of the Sangguniang Kabataan Pambayang Pederasyon or any of its
members, or when confidential matters are being considered.

On a motion to hold a closed-door session duly approved, the Presiding Officer shall the session hall cleared by
the public and the doors closed thereafter.

Only the Secretary to the Sangguniang Kabataan Pambayang Pederasyon and such other persons as are
specifically authorized by the Sangguniang Kabataan Pambayang Pederasyon shall be admitted to the closed-door
session. They shall preserve the secrecy of whatever may be read or said at the session.

Section 6: SUSPENSION AND ADJOURNMENT OF SESSION. Sessions of the Sangguniang Kabataan


Pambayang Pederasyon shall not be suspended or adjourned except upon motion, but the Presiding Officer may,
in his declaration, declare a recess of short intervals.

Section 7: OPENING AND ADJOURNMENT TO BE ENTERED IN MINUTES. The exact time of opening
and adjournment of a session shall be entered in the minutes.
RULE 7
QOURUM

Section 1: NUMBER TO CONSTITUTE A QOURUM


A majority of all the members of the Sanggunian “who have been elected and qualified” shall constitute a
quorum to transact official business. (Sec. 53, RA 7160)
Should a question of a quorum be raised during a session, the Presiding Officer shall immediately proceed
to Call the Roll of the members and there after announce the results.
When there is no quorum, the presiding officer may declare a recess until time a quorum is constituted.

Section 2: MEANING OF THE TERM


“Elected and qualified”. Other interpretations to the contrary not with the standing, the term “elected and
qualified” shall be construed for purposes of this Rules, to include not only the seven (15) members.

Section 3: COMPUTING THE QOURUM


In computing the presence of a “quorum” the term “majority” shall be based on the actual membership or
incumbents in the Sanggunian which shall exclude the following:
a. Regular Presiding Officer (SK Federation President)
b. A member who is abroad or on official leave of absences;
c. A deceased member;
d. A member who has resigned;
e. A member who has been suspended or expelled or removed by final judgement.

Section 4: CALLING THE SESSION TO ORDER


When the appointed time has come to start the session. The Presiding Officer (Regular or Temporary, as
the case maybe), shall call the session to order, with or without quorum.
In the absence of the quorum after calling the session to order, the Presiding Officer may perform any of
the following:

1. He/she may adjourn the session from hour to hour if he/she would like for other members
who may be late in coming the session;
2. He/she may adjourn the session from the day and compel the attendance of absent members
in order to obtain the presence of a quorum;
3. He/she may adjourn the session for lack of quorum.

Section 5: WITH QOURUM AT THE START BUT NO QOURUM DURING THE LATER PART OF
THE SESSION
During the session which was started with a quorum and a question on the lack of a quorum is raised by
any member, the Presiding Officer shall cause the reading of the roll of members and announce the result thereof.
In the absence of the quorum, the Presiding Officer “motu propio” may declare a recess of not more than
one (1) hour, or a majority of the member presents may adjourn from hour to hour, or day to day, and compel the
attendance of the absent members.
If there is still no quorum despite the enforcement of the above remedial measures, no business shall be
transacted. The Presiding Officer, “motu propio”, or upon proper motion duly approved by the members present,
shall then declare the session adjournment for lack or quorum.
If there is still no quorum despite the enforcement of the above remedial measures, the body then declare
the session adjourned for lack of quorum.

RULE 8
ORDER OF BUSINESS

Section 1: ORDER OF BUSINESS. The Order of business of the Sangguniang Kabataan Pambayang
Pederasyon shall be a follows:
a) Call to Order
b) Opening Ceremonies(optional)
c) Roll Call
d) Reading and Approval of the Minutes
e) Reports of Officers and Committees
f) Standing Committees
g) Special Committees
h) Unfinished Business
i) New Business
j) Program
k) Announcement
l) Adjournment

Section 2: THE CALENDAR OF BUSINESS. Shall be prepared by the Committee on Rules and a copy thereof
shall be furnished to every member of the Sanggunian not less than one (1) day before the date of the regular
session. The Presiding Officer shall cause the Secretary to the Sangguniang Kabataan Pambayang Pederasyon to
provide the necessary administrative support or secretarial to the Committee o Rules and other standing or special
committees.

Section 3: THE CALENDAR OF BUSINESS SHALL CONTAIN THE FOLLOWING:

a. UNFINISHED BUSINESS – refers to proposals or measures that have been left enacted upon,
postponed or left unfinished during the previous meeting or session. This also includes items of
business left unfinished or enacted upon the end of the term of the previous administration.
b. BUSINESS OF THE DAY – refers to proposals or measures that have been left not enacted
upon, postponed or left unfinished during the previous meeting or session. This also includes
items of business left unfinished or not acted upon the end of the term of the previous
administration.
c. UNASSIGNED BUSINESS – refers to pending matters or measures including new ones arising
out during the deliberation, or those administration measures coming from the Chief Executive
but not yet assigned or referred to any committee for appropriate action.

Section 4: DISTRIBUTION OF CALENDARS. The Calendar shall be distributed each day of session, unless
there will be no addition to the previously distributed, in which case a note to this effect on the Order of Business
shall be sufficient.

Section 5: INCLUSION OF THE AGENDA. The agenda shall only include those received by the Secretary to
the Sangguniang Kabataan Pambayang Pederasyon before noon of Thursday prior to the regular session.
Communications not listed in the agenda shall not be read, it shall be included in the agenda of the next session
unless the Presiding Officer r a majority of the member’s desires otherwise. Communications received before end
of office hours on Fridays prior to the regular session which are considered as urgent are exemptions to this
Section.

RULE 9
PROCEDURES OF ORDINANCES, RESOLUTION AND OTHER LEGISLATIVE MEASURES

Section 1: ORDINANCE AND RESOLUTIONS, DISTINGUISHED. Legislative actions of general and


permanent character shall be enacted in the form of ordinances while those which are of temporary character shall
passed in the form of resolutions. Matters relating to proprietary functions and to private concerns shall also be
acted upon by resolutions.

Section 2: DENOMINATION. Every ordinance and resolution presented for consideration shall be respectively
denominated as “Draft Ordinance” and “SKPP Ordinance” or “Draft Resolution” and “SKPP Resolution” as the
case may be. Other resolutions shall be called “Referral Resolution”.

Section 3: ESSENTIAL PARTS OF ORDINANCES AND RESOLUTIONS. Proposed ordinances and


resolutions shall be in writing and shall contain an assigned number, a title or caption, an enacting or ordaining
clause, and the date of its proposed effectivity. In addition, every proposed ordinance shall be accompanied by a
brief explanatory note containing the jurisdiction for its approval.

It shall be signed by the author or authors and handed over to the Secretary for inclusion in the agenda of the next
session for first reading and referral to the proper committee.

The author of an ordinance or resolution who formally prepared such measure, in accordance with this Section,
and presented for legislative consideration shall be the Sangguniang Kabataan Pambayang Pederasyon Members
who introduced, moved and supported the measure for legislative decision or action. The author or sponsor shall
be properly indicated in all approved ordinances and main resolutions.

Section 4: ENACTMENT OF ORDINANCES AND RESOLUTIONS.


a. An ordinance shall undergo the Three-Reading-Principle.
b. Resolution are not required to pass the Three-Reading-Principle except for resolutions partaking the
nature of law of which case; it shall be determined by the majority.
Section 5: FIRST READING. The Secretary to the Sangguniang Kabataan Pambayang Pederasyon shall report
all submitted and received proposed ordinances and resolutions to the Sangguniang Kabataan Pambayang
Pederasyon members for First Reading at least three (3) days before the regular session or special session.
The First Reading of a proposed Ordinance or Resolution shall only be by title. No discussion or debate on the
proposed measure is allowed. However, the author or sponsor may be allowed five (5) minutes to support his
proposition. Thereafter, the same shall be referred to the appropriate committee.

The sponsor may move for the urgency of a resolution not partaking the nature of law upon approval by the
majority and be tackled under the Unassigned Business.

An erroneous referral of a proposed Ordinance or Resolution may be corrected any day after the approval of the
minutes.

Only the Chairperson or Co-Chairperson of the Committee to which a propose Ordinance or Resolution was
erroneously referred, as well as the Chairperson or Co-Chairperson of the Committee claiming jurisdiction over
the proposed ordinance or resolution, may move that the referral be declared erroneous and ask for its correction.

Section 6: PERIOD OF REPORT. The committee shall dispose-off proposed ordinance or resolution within
thirty (30) days after it has been referred to it.

If the Committee Report on proposed ordinance or resolution is favorable, it shall include in the Calendar of
Business.

If the Committee action on proposed ordinance and resolution is unfavorable, it shall be laid in the table and
within ten (10) days, notice of the action taken will be furnished to the author or authors concerned stating the
reasons for such actions: Provided, that within five (5) days after receipt of the notice, the Sangguniang Kabataan
Pambayang Pederasyon may reconsider the committee recommendation.

RULE 10
MINUTES

Section 1: MINUTES OF SESSION. The Sangguniang Kabataan Pambayang Pederasyon shall keep, the
minutes of its proceedings which shall comprise a succinct and exact account of the business transacted and the
actions taken thereon. The minutes must clearly show the following: nature of the session, whether regular or
special, and if special, a copy of the call for such session, date, time, and the place of the session; names of the
members present and absent; whether the minutes of the previous session were read and approved, citing
corrections, if any; every resolution and ordinance, in full; if the resolution or ordinance was not approved
unanimously, a brief statement of the majority opinion; nominal voting; all main motions, except those
withdrawn; points of order and appeals, whether sustain or lost; veto message of the Mayor, in full; and time of
adjournment.

Section 2: READING AND APPROVAL OF MINUTES. The minutes of the previous session shall be ready at
noon of Friday following the regular session.
Section 3: POSTPONEMENT OF READING. The reading of the minutes cannot be dispensed with but may be
postponed to a later time or session, and no motion to amend it shall be entertained after it has been read and
approved.

RULE 11
DECORUM AND DEBATE

Section 1: DECORUM AND DEBATE. These mean courtesy in speech and propriety of action. Both are vital to
the preservation of order, decency and harmony among the Members to ensure the regularity of their proceedings
and earn for themselves and the Sangguniang Kabataan Pambayang Pederasyon the trust and respect of the public.
Towards this end, the following rules and formalities are prescribed:

a. All remarks of the speakers should be addressed to the Chair.


b. Officers should be addressed by their proper titles and members should be referred to in the third person,
identifying them preferably by the constituency they represent.
c. Debates must be impersonal, a Members motives in relation to a pending question must not be inquired
into or remarked upon; and offensive language and unparliamentarily expression must be avoided.
d. Members not engaged in debates must keep to their places and shall not walk across the session hall or
create any noise or disturbance during the proceedings.

Section 2: MANNER OF ADDRESSING THE CHAIR. When a member desires to speak, he/she shall rise and
respectfully address the chair, “Mr. Chair”, or “Mr. Presiding Officer” or “Madam Presiding Officer” as the case
may be.

Section 3: RECOGNITION OF MEMBERS TO SPEAK. When two or more members rise at the same time,
the Presiding Officers shall determine and recognize the member who is to speak first.

Section 4: TIME LIMIT FOR SPEECHES. No member shall exceed more than five (5) minutes in debate on
any question or speak more than once on any question without the consent of the Presiding Officer. The period of
interpolation shall not be counted against the time of the member being interpolated. A member exceeding the
time may motu propio or upon motion, be ordered by the Chair to yield the floor.

Section 5: SPONSOR TO OPEN AND CLOSE DEBATE. The Members reporting a measure under
consideration from a committee may open and close debate thereon. If the debate extends beyond one session day,
he shall be entitled to an additional fifteen (15) minutes to close.

Section 6: DECORUM TO OPEN AND CLOSE DEBATE. In all cases, the member who has obtained the
floor shall confine himself to the question under debate, avoiding personalities. He shall refrain from uttering
words or performing acts which are inconsistent with decorum.
If it requested that a member be called to order for words spoken in debate, the member making such request shall
indicate the words except to, and they shall be taken down in writing by the Secretary to the Sangguniang
Kabataan Pambayang Pederasyon and read aloud. The member who uttered such words shall not be held to
answer, nor be subject to censure by the Sangguniang Kabataan Pambayang Pederasyon, if further debate or other
business has intervened.

Section 7: SMOKING NAD DRINKING ALCOHOL INSIDE SESSION HALL PROHIBITED. Smoking
and drinking alcoholic beverages shall not be permitted inside the session hall.

Section 8: USE OF CELLPHONES. All cellphones and other communication devices shall be in silent mode
during sessions and committee meetings.

Section 9: PROPER ATTIRE. The male shall wear Barong Tagalog and dark colored slacks during regular and
special sessions. Female members shall wear Filipiniana during regular and special sessions.

RULE 12
DISCIPLINARY ACTIONS

Section 1: PENALTY. For purposes of this Section, JUSTIFIED ABSENCE would mean non-attendance to a
Session, Committee Meeting or Hearing with just, valid and legitimate reason.

UNJUSTIFIED ABSENCE, on the other hand, means non-attendance without just, valid and legitimate
reason.

Any member who commits an act in transgression of the foregoing Internal Rules of Procedures shall be
penalized with corresponding penalties prescribed hereunder, to wit:

Section 2: REQUITIES. The penalty of suspension or exclusion to be imposed shall require the concurrence of
at least two-thirds (2/3) vote of all members of the Sanggunian. For other kinds of penalty only a majority vote of
all the Sangguniang Kabataan Pambayang Pederasyon members shall suffice.

Section 3: INITIATION OF ACTION AND CONDUCT OF INVESTIGAION. The Committee on Rules


shall take organize of all the offenses enumerated in the proceeding Section committed by any member of this
Sanggunian, whether composite member or constituent member, including the regular Presiding Officer, and shall
initiate the necessary disciplinary actions. It shall forthwith conduct the necessary fact-finding investigation and
thereafter shall submit its Committee Report together with the corresponding recommendation for consideration
of the Sangguniang Kabataan Pambayang Pederasyon sitting end banc.

For purposes of this Section, only a fact-finding investigation and NOT an “Administrative Investigation” shall be
conducted, and thus, the technical rules of court practice, procedure and evidence shall not be applied. However,
the substantive due process requirement of fairness and reasonableness shall be observed.

Should any member of the Committee on Rules be the respondent, the Presiding Officer (regular or temporary
presiding officer, as the case may be) shall designate a replacement to complete the membership thereof but only
in so far as the conduct of the fact-finding investigation is concerned. In performing the other function of the said
committee, the respondent is still a member of that committee.

Section 4: COLLECTION OF FINES AND ITS DISPOSITION. The Secretary of the Sangguniang Kabataan
Pambayang Pederasyon shall collect the fines as may be imposed by this Sanggunian and shall take custody
thereof as a private trust fund. In the disposition or disbursement of the said fund, the Sanggunian shall convert
itself into a “Committee of the Whole” and then decide upon a majority vote of all its members how and what
purpose the said fund would be spent.

RULE 13
VOTING AND MOTIONS

Section 1: A TIE ON APPEAL. A tie vote on appeal from the ruling of the Chair sustains the decision of the
Chair.

Section 2: WHO MAY VOTE. When a motion, report or proposed measure is adopted or lost, it shall be in order
for a member who voted with the majority to move for the reconsideration thereof on the same session day.

Such motion shall take precedence over all other questions, except a motion to adjourn, to raise a question of
privilege and call to order.

Section 3: RECORDING OF MOTIONS. Every motion shall be entered in the minutes with the name of the
Member making it, unless it is withdrawn on the same day.
Section 4: READING AND WITHDRAWAL OF MOTION. When a motion is made, he Presiding Officer
shall state it before any action will be taken. A motion may be withdrawn any time before its approval or
amendment.

Section 5: PRECEDENCE OF MOTION. When a question is under debate, no motion shall be entertained
except to adjourn, raise question of privilege, declare a recess, a lay on the table, or postpone to a certain day
(which motion shall be decided without debate) refer, amend or postpone indefinitely (which motion shall be
decided subject to the five-minute rule). Said motion shall have precedence in the foregoing order. No motion to
postpone to any certain date, or defer or postpone indefinitely, having failed passage, shall be allowed on the same
day.

Section 6: AMENDMENTS. When a motion or proposition is under consideration, a motion to amend and a
motion to amend that amendment shall be in order. It shall also be in order to offer further amendment by
substitution, but it shall not be voted upon until the original motion or proposition is perfected. Any of said
amendments may be withdrawn before a decision is made thereon.

Section 7: RIDER PROHIITED. No motion or proposition on a subject different from that under consideration
shall be allowed for amendment.

Section 8: MOTION TO COVER ONE SUBJECT MATTER. No motion shall cover more than one subject
matter.

Section 9: AMENDMENT OF TITLE. Amendments of the title of a proposed ordinance or resolution shall not
be in order until after the next thereof has been perfected. Amendments to the title shall be decided without
debate.

Section 10: CALL TO ORDER. A motion to read any part of his Internal Rules of Procedure is equivalent to a
call to order and takes precedence over any motion other than to adjourn.

Section 11: QUESTIONS OF PRIVILEGE. Questions of privilege are those affecting the right of the
Sangguniang Kabataan Pambayang Pederasyon: its safety, dignity and the integrity of its members; and those
affecting the rights, reputation and conduct of the members, individually, in their capacity as such member.

Section 12: PRIVILEGE QUESTIONS. Privilege question are those motions or subject matters which, under
the rules, take precedence over motion and subject matters.

RULE 14
SUSPENSIONS OF THE RULES

Section 1: WHO CAN MOVE. The Chairperson or his absence, the Co-Chairperson, or in the absence of both,
any member of the Committee on Rules shall move for the suspension of the parliamentary rules. However, any
member may move for the suspension so long as supported by majority.
Section 2: VOTE REQUIRED. No Rules shall be suspended except by two-third (2/3) vote of the Members, a
quorum being present.

Section 3: INTERRUPTION OF MOTION. When a motion to suspend the Rules is pending, one motion to
adjourn may be entertained. If it is lost, no similar motion shall be entertained until voice taken on the motion to
suspend.
Section 4: EFFECT ON SUSPENSION. If the Sangguniang Kabataan Pambayang Pederasyon members vote to
suspend the Rules, it shall forthwith proceed to consider the measure with two-thirds (2/3) vote, a quorum being
presented.

RULE 15
OFFICIAL SEAL

Section 1: THE OFFICIAL SEAL. The Sangguniang Kabataan Pambayang Pederasyon of Aritao, Nueva
Vizcaya adopted the Official Seal of the Local Government Unit of Aritao. Its symbolism is a shield inscribed
with the land map of Aritao depicting the topography of the municipality with the mountain ranges devoted to
animal industry and agriculture indicating the two major source of livelihood of the people. Around the map are
shown figure of palay, onions and tomatoes representing the basic products of the municipality together with
figures of heads of carabao, cow, goat and pig representing the animal industry.

The shield is encircled twice and in between these circles, the words “BAYAN NG ARITAO” are inscribed at
the upper portion and the words “LALAWIGAN NG NUEVA VIZCAYA” are inscribed at the lower portion
representing the municipality and province respectively.

RULE 16
AMENDMENTS OF THE RULES

Section 1: AMENDMENTS. These Internal Rules of Procedures may be amended at any regular session by a
two-thirds (2/3) vote of all members of the Sangguniang Kabataan Pambayang Pederasyon, provided that notice
of the proposed amendment has been given at any session previous to the one at which said amendment is to be
considered.

Section 2: PROHIBITION. No provision of these Rules which is prescribed by or based on statutory law or any
other higher authority may be amended or revised.

RULE 17
TRANSITORY PROVISION
Section 1: TRANSITORY PROVISION. The Internal Rules of Procedure of the Sangguniang Kabataan
Pambayang Pederasyon adopted by the Honorable Members during the presiding administration shall apply until
the updated edition is approved and adopted.

Section 2: PENDING LEGISLATIVE MEASURE. Legislative measures that are entered during the transition
period and overtaken by the new Sangguniang Kabataan Pambayang Pederasyon will be considered at the
Unfinished Business in the Calendar in the Calendar of Business as embodied in the Internal Rules of Procedure.

RULE 18
SUPPLEMENTARY RULES

Section 1: SUPPLEMENTARY RULES. The rules, procedure and parliamentary practices of the Philippine
Congress, and books dealing on this subject written by Filipino authors, particularly by Dr. Antonio Orendain,
Prof. Reynaldo T. Fajardo and Reverendo M. Dihan, shall serve as supplementary authorities of the Sangguniang
Kabataan Pambayang Pederasyon of Aritao, Nueva Vizcaya but only insofar as they are no incompatible with the
rules and procedures adopted herein.

Section 2: EFFECTIVITY. This Internal Rules of Procedure shall take effect on the date of its adoption.
