and LARGE ORDER TAKE-OUT

CONTRACT OF SERVICES

1. Reservation shall be made at least two (2) weeks before the date of the scheduled
birthday party. The customer shall make an initial down payment upon reservation. McDonald’s
reserves the right not to accept a birthday party reservation or in case a reservation has been
made to cancel if conditions in the store do not warrant holding said party at a particular date and
time. McDonald’s shall refund the customers down payment subject to the provisions of this
agreement.

2. In the event of a price increase from the time of reservation by the customer up to the
time the party is held, the customer agrees to pay for the food ordered at the prevailing prices at
the time the birthday party is held. The deposit made for the cake or food (in case of down
payment) shall not be construed as a commitment on the part of McDonald’s to deliver the cake
and food at prices prevailing at the time payment is made. In such case the store Manager /
Store Marketing Manager or designated store personnel will advise the Customer of the change
in price during the party itself.

3. For take-out parties or large food orders, a 50% down payment on the total amount of
food ordered shall be made by the Customer upon signing of this document. Full payment of the
balance shall be paid upon delivery of the food to the Customer. In case of payment through
PERSONAL CHECK, clearing of check and/or full payment of the total party bill or food bill must
be settled at least 5 days before the party date.

4. For take out parties or large food orders; the cost of transportation shall be for the
account of the customer if the store will provide the vehicle. If the customer will provide the
transportation, arrangements shall be made for the pick-up of the staff and food.

5. In cases where the Customer postpones or cancels the party reservation or large food
orders, the customer should provide the store with a WRITTEN NOTICE seventy two (72) hours
prior to the scheduled party/large food order date. If the party or food order is not cancelled
within the specified period, an amount equivalent to the total committed expenses made by the
store at the time of preparation shall be deducted from the pre-paid fees. Balance of the fees as
well as the prepared materials will be refunded/ turned over to the customer.

6. No refund or adjustments shall be made if the actual number of guests falls below the
contracted number of guests at the time of confirmation.

There will be a Free McDonaldland Character/s appearance for in-store party. However, parties
outside the premises of the restaurant are not entitled to a character appearance. McDonald’s
has sole discretion as to number and character type appearances for the in-store party. The
McDonaldland Characters shall be under the direct supervision of McDonald’s store personnel.

7. For take out parties, service by McDonald’s staff at the customers’ premises shall be
limited to a maximum of two (2) hours from the agreed pick up time.

8. No other food or beverages including birthday party cakes other than those provided for
by McDonald’s be will allowed within the premises of the store. No other characters/ mascots
shall be allowed within the store’s premises other than the McDonaldland Characters.

9. The Customer is held responsible and liable for any damage to McDonald’s facilities/
equipment caused by them or their guests.

10. The Customer shall be responsible for the safety and security of their guests and their
belongings and shall not hold McDonald’s responsible for any damage or loss arising from
negligence on the part of the customer or their guest.

11. For take-out parties and large food orders, the customer shall take the following steps as
follows: (a) Be sure that anyone serving or handling the food has thoroughly washed his or her
hands; and (b) Serve all food products as quickly as possible and (c) food products taken outside
and consumed outside the store must be consumed within thirty (30) minutes from actual delivery
or pick-up time. The delivery or pick-up time shall be as indicated in this agreement and shall not
revised or changed unless in writing and agreed to by the parties.

12. The customer shall hereby release and discharge Golden Arches Development
Corporation (GADC) or any of its affiliates or subsidiaries herein referred to as “McDonald’s”,
together with its officers, directors, agents or employees, of and from any manner of action or
actions due to causes not attributable to McDonald’s nor for failure to comply with any or all of the
terms of this Agreement due to fortuitous event or any other causes beyond its control.

13. The Customer warrants and represents that he/ she has read and fully understood, and
hereby accepts, the foregoing terms and conditions and agrees to comply with them.
