WHEREBY IT IS AGREED AS FOLLOWS:

1. APPOINTMENT AND PERIOD OF CONTRACT

1.1 The terms and conditions of this fixed-term contract of employment shall apply with
effect from …15TH October 2022…………….… and end on ……14th October 2024

1.2 Termination of this contract before the date of its expiry shall be in accordance with
the Employment Act 1995.

1.3 This contract is only legally binding when the parties have entered their signatures and
when there is evidence that the Competent Officer has attested this contract of
employment.

2. ENGAGEMENT, DUTIES AND WORKING HOURS.

2.1 it is understood and accepted that the Employee;

2.1.1 shall be employed in the post of ……Mason ……………, whereby the employee
will be required to work …48.. Hours per week.

2.1.2 Working time shall be from …8. Am to 5… pm per day.

2.1.4 Is entitled to 24 consecutive hours’ rest in any period of 7 days.

entire break will be paid and counted as working time.

2.1.6 Maybe required to perform a maximum overtime of 15 hours/week or 60
hours/month

2.1.7 Shall perform only the duties and role mentioned in the attached job description
under the Title of annex 1.

3. PLACE OF WORK

3.1 It is understood and accepted that the Employee will perform his duties at the
employer’s worksite/s

4. REMUNERATION AND DISBURSEMENTS

4.1 The Employer shall pay the Employee a net salary of …Rs…8000.00….….. in
Seychelles Rupees per month subject to the National Minimum Wage Regulation,
2007 and any other statutory deductions that are in force now or that may rise in future.

4.2 The Employee shall be paid overtime (if required at clause 2.1.6 ) at the rate of 1.5 or 2
or 3 subject to the nature of occupation and the conditions set under the Employment
Regulations 1991.

5. SICKLEAVE

5.1 The Employee shall be entitled to an aggregate maximum of 21 days’ paid sick leave; It
is understood that where the employee is under a contract for fixed term and the
duration of the contract is of less than 12 months, the eligibility to sick leave under 5.2
and 5.3 is of a number of days bearing the same proportion to the term of the contract
as the periods of sick leave bear to 12 months, but in any case ends upon the date of
expiry of the contract.

5.2 If the employee is required by a medical practitioner to be confined to a hospital,


similar institution or at home for a continuous period which extends beyond the
unexhausted part the 21 days’ paid sick leave referred to in in clause 5.1, the employee
is entitled to a further maximum 30 days’ paid sick leave

5.3 An employee is entitled to an aggregate maximum of 60 days’ unpaid sick leave after
the exhaustion of paid sick leave under the Employment Regulation.

5.4 Whenever the employee is, for reasons attributable to sickness, unable to report for
work, the worker shall so inform the employer within 24 hours if practicable, or as soon
as possible thereafter.

6. BOARD AND LODGING

6.1 The Employer shall provide the Employee with proper housing with basic facilities for
the period of this contract. However the cost associated with the accommodation will
be agreed upon between the employer and the employee in accordance with the
Employment Act 1995 and Regulation.

6.2 Upon termination of the employee’s contract of employment by the employer the
employee may initiate the grievance procedure. Under these circumstances the
employer shall continue to provide the employee with food and shelter while the
grievance of the employee is being dealt with by the Competent Officer or the
Employment Tribunal.

7. ANNUAL LEAVE

7.1 The Employee shall be entitled to 1.75 days annual leave for every completed month
in the employer’s employ.

7.2 Annual leave entitlement is taken each year by mutual arrangement between employer
and worker unless the worker has, under the mutual arrangement, agreed to
accumulate his/ her leave entitlement.

7.3 Where it is mutually agreed between an employer and a worker, the leave entitlement
of the worker in any year may be converted into cash payable in that year.

8. HEALTH AND SAFETY

The Employee and the employer will abide to the provisions set down in the
Occupational Safety and Health Decree 1978.

9. MISCELLANEOUS

9.1 Any changes/variations by the employer to the employee’s Job description or this
contract will be subject to the consent of the employee accompanied with attestation
by the Competent Officer before any performance of the intended change is executed.

9.2 The employer will provide the employee with passage fair to repatriate the
worker to his homeland upon the end of the worker’s contract of employment or
in circumstances where the employer has breached the employee’s contract of
employment

9.3 The parties understand that the Competent Officer attests only the legal names of the
parties to this contract and the particulars provided for in 1. to 9.1. Any provision that
may be included by the parties beyond 9.4 is not attested by the Competent Officer.

9.4 Nothing in this contract derogates from the authority of the Employment Act 1995 or
any laws of Seychelles in respect of the construction and legality of a contract.

This is to confirm that both parties being the undersigned clearly understood the terms laid
down under this contract and accepts all liability of it.
