I: Introduction

Education is one of the biggest part of a child’s

life, seeing that it can shape their own future because of
learning with the use of their full understanding. Every
child has the right to receive an education despite of
having any disabilities and special needs with the
presence of special and inclusive education. The issue in
this kind of matter has been running for so many years
and for this reason, inclusion was being practiced in the
states which means that all students and learners shall
be included in the school community as valued members
of the school regardless of their own disability and
needs.

II: Content

Specifically in the USA, these acts were introduced

with the implementation of inclusive education:

REPORT Education for All Handicapped Children Act 1975

CONTENTS:
(EAHCA)
President Gerald Ford signed this into law under
the constitution guaranteeing free, appropriate public
education, to each child with a disability in every state
and locality across the country. Public schools are
required to assess and evaluate children with physical
and mental disabilities create an educational plan with
parent input that would emulate as closely as possible
the educational experience of non-disabled students.

The law was passed to meet four huge goals:

1. To ensure that special education services are

available to children who need them.

2. To guarantee that decisions about services to

students with disabilities are fair and appropriate.

3. To establish specific management and auditing

requirements for special education.

4. To provide federal funds to help the states educate

students with disabilities.
Individuals with Disabilities Education Act 1990
(IDEA)

IDEA was previously known as the Education for All

Handicapped Children Act (EAHCA) from 1975 to 1990.
IDEA is the nation’s special education law. It gives rights
and protections to kids with disabilities. It covers them
from birth through high school graduation or age 21.
Parents and legal guardians also have rights under the
law.

It was common for states to place kids with

disabilities in separate schools or in separate classrooms
away from their peers. Their education was often poor
and underfunded.

IDEA places two big responsibilities on states and their

public schools.

1. Kids must learn side by side with peers as much

as possible something called the “Least Restrictive
Environment” that was also considered as LRE.

2. IDEA gives parents specific rights and protections

with the use of procedural safeguards.

Effects of IDEA to the Educational System of USA

 By 2003 only 25% of deaf or blind children were

educated at state institutions.

 As of 2006, more than 6 million children in the

U.S. receive special education services through
IDEA

 In 2018–2019, around 7.1 million students ages 3

to 21 received special education services under
IDEA and it is 14% of all public school students.

Article 24 Convention on the Rights of Persons with

Disabilities (CRPD)

Recognize the right of child with disabilities to

education with a view to realizing this right without
discrimination and on the basis of equal opportunity in
 attending school.

III. Conclusion / Takeaways

We really cannot remove people born with

disabilities and needs in this world and for this
particular reason, the world will take adjustments not to
treat them as special but to make us all equal. Laws and
constitutions were formulated for them be in a safe place
while they are learning and it is for the sake of their own
purposes and for them to find attending school as a
paradise. Inclusive education are helping all learners to
grow and foster in their own way along with breaking a
lot of barriers and hindrances that they are facing in
terms of their own education that was the bridge for
their future, that is why the foundation of special and
inclusive education is very much important.
