28) Tracing of Title:-

1 The security property is agriculture land in S.No.39/3C,39/5, 39/6A,


39/12, 39/13, 39/14 at Podampatti Village Aruppukottai Taluk morefully
described above.

2) The land measuring 75 Cents in S.No.39/3C (ie) 1 st item of 1st


Schedule, Measuring 98 Cents in S.No. 39/12 (ie) 1 st item of 2nd schedule
originally and ancestrally belonged to Azhagarsamy Naicker, Duraisamy Naicker,

Seeni Naicker, Ramsamy Naicker. The said Ramasamy had died long back
leaving behind his son Pavunraj as his legal heirs. The said Azhagarsamy
Naicker and his brother Duraisamy Naicker forself and as guardian of minor son
Dhanushkkodi, and his brother Seeni Naicker for self and as guardian of minor
son Marichamy, Pavunraj S/o. Ramasamy Naicker had jointly sold the said
security properties a registered sale deed dated 02.03.1988 in Doc.No.84/1988
to seethalakshmi for valuable consideration (Doc.No.1).

3) The land measuring 73 Cents in S.No.39/5, and 62 cents in S.No.39/6A


(ie) 2nd item of 1st schedule its originally vellaiyammal. The said Vellaiayammal
had died long back leaving behind his son chellaiah as his legal heirs. The said
Chellaiah for self and as guardian of his minor children namely Manjuladevi,
Murugeswari had sold the said land a registered sale deed dated 07.03.1988 in
Doc.No.93/1988 to Seethalakshmi for valuable consideration (Doc.No.2).

4) the land measuring 70 Cents in S.No. 39/14 (ie) 3 rd item of 2nd


schedule its originally and belonged belonged to Perumal Moopar. The said
Perumal Moopar had sold the said land a registered sale deed dated 03.03.1988
in Doc.No.89/1988 to Seethalakshmi for valuable consideration (Doc.No.3).

5) The land Measuring 48 Cents in S.No.39/13 (ie) 2 nd item of 2nd


schedule its originally and ancestrally belonged to Muthuraj. The said Muthuraj
for self and as guardian of his minor sons Azhagarraj, Jakkaiyan had sold the
said land a registered sale deed dated 02.03.1988 in Doc.No. 85/1988 to
seethalakshmi for valuable consideration (Doc.No.4)

6) Hence the said seethalakshmi became the owner of above said


measuring 75 Cents in S.No.39/3C, measuring 73 Cents in S.No.39/5, 62 cents
in S.No.39/6A, 70 Cents in S.No. 39/14, 48 Cents in S.No.39/13 thro” above
doc.no. 1 to 4. While so the said Seethalkshmi had died on 12.11.1988 leaving
behind her children Sundralakshmi and Muthukani as her legal heirs. The Death
and Legal Heirship certificate of Seethalakshmi are produced as Doc.No.9 and
10. The said Sundralakshmi had died on 15.04.2014 leaving behind her children
namely Rajagopal, Saravankumar, Gurusanthi, Sivaganeshan as her Legal heirs.
The Death and Legal Heirship certificate of Sundralakshmi are produced as
Doc.No.11 and 12. The patta was also transferred. The said 10 (1) adangal for
the above said lands (ie)S.No.39/13, 39/3C in th name of Muthukani1, Rajagopal,

Sarvanakumar, Gurusanthi, and Sivagansan. Is produced as Doc.No.13. The


said Saravanakumar had executed a registered general power deed dated
12.07.2018 in Doc.No,23/2018 for valuable consideration (Doc.No.5). The said
Gurushanthi had executed a registered general power deed dated 12.07.2018 in
Doc.No,23/2018 for valuable consideration (Doc.No.6).

7) Similarly the said Muthukani Jaiganesh Seetharaman Rajagopal forself


and as power agent of Saravanakumar, and Gurushanthi, had joinly sold the
security properties (ie) to gathering totally measuring 2 Acres 10 Cents in S.No
39/3C, 39/5, 39/6A a registered sale deed dated 20.08.2018 in Doc.No.
1085/2018 to R.Mariyammal for valuable consideration (Doc.No. 7).
Subsequently the said Muthukani Jaiganesh Seetharaman Rajagopal forself
and as power agent of Saravanakumar, and Gurushanthi, had joinly sold the
security properties (ie) to gathering totally measuring 2 Acres 16 Cents in S.No.
39/12, 39/13, 39/14 a registered sale deed dated 20.08.2018 in
doc.No.1086/2018 to R.Mariyammal for valuable consideration (Doc.No. 8). After
purchase patta also transferred to the name of R.Mariyammal. The said 10 (1)
adangal, Cultivation Agangal, Kist Receipt for the above said lands (ie) security
properties in the name of R.Mariyammal is produced as Doc.No.14 to 16. The
said FMB Sketch for the security properties is produced as Doc.No.17. The title
holder further states that there is no lispendences or encumbrance over the
security property. Hence the said S.Mariyammal W/o. Sakkaraipandi is lawfully
entitled to the security property as absolute owners.

28A) Tracing of Possession:-


The applicant has produced the 10 (1) adangal, Cultivation Agangal, Kist
Receipt as doc.No.14 to 16 to prove possession.
28B) Tracing of Encumbrance:-
The online Encumbrance dated 27.12.2023 for the security is for the
period from 01.01.1987 to 26.12.2023 issued by the SRO Sub Registrar,
Pandalkudi regarding the security property. The said certificate discloses only the
above document No.1 to 4,7 and 8 are discussed with above. Hence there is
no subsisting encumbrance over the security property upto 26.12.2023.
CERTIFICATE
In view of the foregoing, I certify that the title deeds intended to be
deposited, relating to the property and offered as security by way of equitable
mortgage and the documents of title referred to above are perfect evidence of the

title and that if the said equitable mortgage is created in the manner required by
Law, it would satisfy the requirements of creation of equitable mortgage.
In view of the foregoing, I certify that the title deeds intended to be
