(A) DECLARATION
19. Publication of declaration and summary of Rehabilitation and Resettlement. –
(1) Upon satisfying the necessity of a particular land for a public purpose after considering the report
under subsection (2) of section 15, the appropriate Government shall issue a declaration to that effect.
This declaration, along with the identification of a resettlement area for the rehabilitation and
resettlement of affected families, shall be endorsed by the Secretary to the Government or any duly
authorized officer.
(2) The Collector will publish a summary of the Rehabilitation and Resettlement Scheme alongside the
declaration as mentioned in subsection (1). This publication must occur only after the summary of the
Rehabilitation and Resettlement Scheme is made public alongside the declaration. Furthermore, the
Requiring Body must deposit an amount as prescribed by the appropriate Government towards the
acquisition cost before the declaration is made. The Requiring Body should make this deposit
promptly to enable the Government to publish the declaration within twelve months from the date of
the preliminary notification under section 11.
(3) In projects where land acquisition occurs in stages, the application for acquisition may specify
different stages for rehabilitation and resettlement, and declarations will be made accordingly.
(4) Declarations referred to in subsection (1) shall be published:
(a) In the Official Gazette.
(b) In two daily newspapers circulated in the locality, one of which must be in the regional language.
(c) In the local language at the Panchayat, Municipality, or Municipal Corporation offices, as well as in
the offices of the District Collector, Sub-Divisional Magistrate, and Tehsil.
(d) On the website of the appropriate Government.
(e) In the affected areas as prescribed.
(5) Each declaration under subsection (1) shall specify:
(a) The district or territorial division where the land is situated.

(b) The purpose for which it is needed and its approximate area.
(c) Where applicable, the location where the land plan can be inspected without cost.
(6) The declaration under subsection (1) is conclusive evidence of the land's necessity for a public
purpose. Following this declaration, the appropriate Government may acquire the land as specified
under this Act.
(7) If no declaration is made under subsection (1) within twelve months from the date of the
preliminary notification, the notification will be considered rescinded. However, periods during which
acquisition proceedings were halted due to court orders will be excluded when calculating this period.
The appropriate Government may extend the twelve-month period if deemed necessary, with such
decisions recorded in writing and published on the concerned authority's website.
20. Land to be marked out, measured and planned including marking of specific areas. –The Collector
shall thereupon cause the land, unless it has been already marked out under section 12, to be marked
out and measured, and if no plan has been made thereof, a plan to be made of the same.
(C) NOTICE TO PERSON INTERESTED
21. Notice to persons interested. –
(1) The Collector is mandated to publish a public notice on their official website and post it at
convenient locations near the land earmarked for acquisition. This notice shall inform the public about
the Government's intention to take possession of the land and invite claims for compensation, as well
as rehabilitation and resettlement for all parties with interests in the land.

(4) Additionally, the Collector must serve notice to the occupier, if any, of the land, and to all individuals
known or believed to have an interest in the land, or authorized agents acting on their behalf, residing
or having authorized agents within the revenue district where the land is located.
(5) In cases where an interested party resides outside the revenue district and lacks a local agent, the
Collector must ensure that the notice is sent to them via post at their last known residence, business
address, or place of business. Furthermore, the notice should be published in at least two national
daily newspapers and also on the Collector's official website.

FOR COMPANIES
Under the Land Acquisition Act of 2013, companies can acquire land for various purposes, including
infrastructure development, industrial projects, urbanization, and public welfare projects. Getting the
approval of 80% of the project’s affected individuals is necessary for some instances. These include
