ACE LEGACY ASSOCIATION, an association of Spanish nationality with registered office at
World Trade Center Barcelona, Edificio Este, Planta 5, Moll de Barcelona, s/n, 08039, Barcelona
and with NIF G72425770 ("ACE" or the "Association") has been recognized as the organizing
entity of the XXXVII America's Cup in Barcelona ("AC37" or the "Event"), declared of exceptional
public interest, and constituted with the objective of, among others, managing all aspects related
to volunteering associated with the Event including recruiting volunteers under the following:
GENERAL TERMS AND CONDITIONS:
1. Incorporation
The incorporation of volunteers will be done on an altruistic basis and without receiving any
financial compensation, except for meals as agreed in the commitment between the volunteer and
the Association, which shall be signed once the selection process has been completed.
2. Rights of volunteers
In accordance with the applicable legislation, volunteers shall have the right to:
a) Obtain from the Association information on the mission, purpose and operation of the
same, on the meaning and development of the volunteer action and on the role and
itinerary they have within the entity.
b) Receive the necessary training for the performance of the assigned activity, as well as the
means required for this purpose, to be informed of the design of the training itinerary
within the framework of the project they are developing and to be able to participate in
it.
c) Be treated without any type of discrimination and with respect regardless of their
condition and beliefs.
d) Have accreditation or identification as volunteers.
e) Obtain a certificate of their participation in the corresponding programs of the Event,
which shall state the nature of the volunteer action and the period and total number of
hours in which it has been developed.
f) To participate in the elaboration, planning, execution and evaluation of the programs and
activities in which they collaborate, in accordance with the nature and internal dynamics
of the Association.
g) To receive information on the safety, hygiene and health conditions appropriate to the
nature and characteristics of the volunteer activity, and to carry out their task under such
conditions.
h) To receive insurance coverage for risks derived from the activity they carry out as
volunteers and for damages they may unintentionally cause to third parties as a result of
their activity.
Other rights recognized by current applicable legislation.
3. Obligations of the volunteers
Volunteers shall:
a) Cooperate in achieving the objectives of the Association, properly carrying out the
assigned activities, in accordance with the instructions and values of the Association.
b) Actively participate in the training provided by the Association for the correct
development of the assigned activities, attending all the sessions for which they have
been summoned.
c) Carry out the activity in which they participate with responsibility, diligence and
competence, and respect the internal rules of operation of the Association, as well as the
applicable legislation and the health and safety measures of the Event (including any
instructions provided).
d) Respect the rights and dignity of Event participants, attendees and other volunteers.
e) Take the necessary measures to ensure their own safety, as well as that of third parties,
use the materials in accordance with the instructions provided, and make the necessary
communications regarding their state of health and ability to perform the functions
entrusted to them.
f) Have, at all times, the proper authorizations, permits and licenses to carry out the
assigned activities.
g) Use the means and equipment provided by the Association properly and only for the
designated functions. At the end of each activity, volunteers must return any means and
equipment provided by the Association.
h) Wear, at all times, the corresponding accreditation in a clear and visible manner and not
lend or give it to anyone under any circumstances.
i) Inform the corresponding supervisor of their availability, arrival and exit from the
corresponding venue, as well as take all breaks within the indicated periods of time.
j) Take care of the spaces where the activities are carried out, leaving them, as much as
possible, in the same state in which they were found.
k) Maintain the confidentiality of the information received and known in the development
of their activity. Said duty shall extend to the termination of the commitment with the
Association.
4. Prohibitions
Volunteers:
a) Shall not participate in activities or perform functions for which they have not been
expressly authorized.
b) Shall not wear, on their uniform, distinctive signs or accessories that may be associated
with any brand or company.
c) Shall not participate, by themselves or through third parties, in any advertisement,
marketing campaign, promotion or any other activity that may create an association
between them (or any third party) and the AC37 or any of its organizing entities.
d) Shall not use their accreditation as an entrance to the Event’s hospitality or other reserved
areas.
e) Shall not smoke, outside the areas set aside for this purpose, or drink alcohol during the
time they are performing their duties.
f) Shall not take pictures of participants or VIP attendees at the event, acting, in any case,
with the utmost discretion and adhering to the instructions of the Association.
5. Liability and waivers
The volunteers, to the fullest extent permitted by law, waive any and all right to claim any
liability, cost, expense, loss and/or damage of any nature whatsoever from the Association
and/or AC37 and unconditionally agree to indemnify, defend and hold harmless the Association
and/or AC37 (and all its organizing entities) from any claims, fines, losses, liabilities, expenses
and penalties arising in connection with their actions and the performance of their role during
the Event or the breach of any of the obligations and prohibitions set forth in this commitment.
6. Intellectual Property
All volunteers grant, on an exclusive basis, to the Association all exploitation rights over any
materials and works created, individually or collectively, in the development of the activity
provided to the Association, without time limit and with a global territorial scope, with
sublicensing capacity, in its original support or any other future one, with no other limitations
than those imposed by the applicable regulations. Likewise, the volunteers consent to the use by
the Association of said creations for the purposes that the Association considers appropriate for
the development of its social purpose and/or for the promotion of the Event or future events.
Additionally, all volunteers agree not to file any claim in relation to such creations.
For the purposes of this Agreement, intellectual and industrial property rights shall mean each
and every one of the rights recognized by intellectual and industrial property legislation that are
of a proprietary nature or are susceptible of exploitation for any purpose and for any form of use,
including, in all cases, the right to request the appropriate registrations and inscriptions to obtain
or protect these rights.
All volunteers agree and acknowledge that no remuneration or compensation shall be due to
them in connection with the provisions of this section.
Volunteers are informed that the Event is a public event and that as an integral part of it they may
be photographed or recorded in the context of the media, promotional or film coverage carried
out by ACE and entities of the group or associates. To this end, ACE may require the volunteer
to sign the necessary documents for the peaceful exploitation of the content generated.
7. Data protection
ACE LEGACY ASSOCIATION, shall act as data controller of the personal data you provide us
through the application form for registration in the volunteer program.
For what purpose do we process your personal data?
The Association will process the personal data of volunteers on the basis of their application for
registration in the volunteer program in order to evaluate their application and, in case of
selection, to manage the participation of volunteers in the volunteer program of the Association
and the organization of activities around the Event.
Likewise, taking into consideration the entity and the public nature of the Event, it is possible
that the personal data of volunteers may be processed in order to comply with legal obligations
relating to the maintenance of public safety during the celebration of volunteer activities.
What personal data of volunteers do we process?
Through the registration application form, the following information is collected from volunteers:
• Identification data (name, surname, ID, photograph, age, name and surname of the
person identified as emergency contact, etc.).
• Contact information (address, e-mail and telephone).
• Academic data and qualifications (languages spoken and possession of a boat skipper's
certificate).
• Special categories of data:
o In compliance with the provisions of Law 45/2015, of October 14, on Volunteering,
volunteers will be asked, at the time of registration, to make a liable statement of not
having a criminal record for crimes against life or physical or moral integrity,
freedom or for crimes of terrorism.
o One of the objectives of the volunteer project is for the volunteer team to be inclusive,
therefore information regarding disability is requested on a voluntary basis. The fact
that the Volunteer provides us with this information, in no case will give rise to
discrimination contrary to the principle of equality.
With whom do we share the volunteers' personal data?
The Association has the support of other entities, which will act as data processors, who will
participate in the management of the volunteer selection process.
The personal data of the volunteers will be kept under strict security measures that guarantee the
confidentiality and security of the same and will not be transferred to third parties except to the
Administrations and Public Bodies in compliance with the regulations in force that apply to the
Association, as well as to the State Security Forces in order to guarantee the security of the Event.
How long will we keep the volunteers' data?
Volunteers' personal data will be kept for the duration of the Event and for an additional sixty
days after the end of all activities related to the volunteer program.
What are the rights of volunteers as holders of personal data?
Volunteers may excercise, at any time and without any associated cost, the rights recognized by
the data protection regulations. Specifically, they are entitled to exercise the rights of access,
erasure, objection, rectification, portability and restriction in the terms recognized in the General
Data Protection Regulation (EU) 679/2016.

The Volunteer declares that he/she has read, understood and agrees with the terms and
conditions set forth in this document.
