EMPLOYMENT CONTRACT

This EMPLOYMENT CONTRACT is made and entered into this ___________________ in Quezon City, Philippines by
and between:
GABAGROUP CONSUMER GOODS TRADING, a domestic sole
proprietorship company duly organized and existing under and by virtue of the
laws of the Republic of the Philippines with office address at No.11 Pasian
Street Quezon City, hereinafter referred to as the “Employer”;
- and -

1. APPOINTMENT - employee is hereby appointed from ___________ up to ______________under contractual


status for as six (6) months reckoned from the 1st day of actual report for work. Said employee has the following
duties and responsibilities agrees that he/her may be assigned with other tasks, duties and responsibilities that are
related, incidental and/or necessary to the performance of his functions:

2. COMMENCEMENT OF EMPLOYMENT - Employee shall commence employment on given effective period and
thereafter unless sooner dismissed/terminated for lawful causes.

3. COMPENSATION PACKAGE AND PAYROLL SCHEDULE - Employee will receive a gross basic daily rate of
Php____________, SSS, Pagi big, PhilHealth contributions, and government required deductions to be borne by
Employee. In addition, Employer will pay the mandatory 13th month salary at the end of each calendar year and
the EMPLOYER share for all mandatory contributions. Salary pay day will be released every 5th and 20th of the
month.

4. REGULARIZATION OF EMPLOYMENT - by or before the end of the six-month probationary period, depending
on the recommendations of the immediate supervisor/manager, Employee will become a regular employee of the
company entitled to all company benefits and privileges enjoyed by a regular employee.

5. VACATION AND BENEFITS – “Service Incentive Leave Pay is an employee benefit that enables them to take or
avail of leave with pay for five (5) days provided the worker has rendered service for at least one year.

- Article 95 of the Labor Code mandates employers to give their employees a yearly service incentive
leave of five days with pay. The SIL shall be granted to a worker who has been in service within 12
months, whether continuous or broken, reckoned from the date the employee started working, including
authorized absences and paid regular holidays.
- Personal leave: a maximum of 6 days may use for range of contract of the six months and need ger the
approval from supervisor
- Sick leave: Need to submit an original copy of hospital doctors’ certificate, payment proof from
hospital/clinic/selfie with back group of hospital/clinic, and medical diagnostic statement, the part of sick
leave are counted by no work no pay
- If just not feeling well,want to take rest at home/dorm only, it is calculated on the basis of personal
leave

6. WORK SCHEDULE/PLACE OF WORK/OFFICE EQUIPMENT/OFFICE RULES/DORMITORY RULES AND


REGULATIONS
6.1 WORK SCHEDULE
- Unless informed, otherwise, Employee’s official working days shall be Six (6) working days. Subject to
change prior review of operations.
- Over time is required (if needed)
- lives streamer position, taking leave on working days, you must go to work on your rest day to supply
your leave
6.2 PLACE OF WORK: Unless informed otherwise, Employee shall hold office at No.11 Pasian Street Quezon City. If
the company address has changed the employees are willing to follow the company to work at a new address.
6.3 OFFICE EQUIPMENT: any office equipment is not allowed to bring home or dormitory unless it is required for
work and advice/approve by supervisor.
6.4 OFFICE RULE
- During work hour, it is forbidden to talk or chat with work partner on topics are not related to work
- Personal phone is strictly not allowed use in the work area,unless work’s need and that is advice from
team leader
- Taking selfie pictures or videos InSite the work area is not allowed and not allowed to post in social
media
- No music in the work area
- No earphone/blue tooth headset during the work hour
- No smoking during work hour
6.5 DORMITORY RULE
- No family members/ friends /relatives and or resigned employee visit
- No pets allowed
- No alcohol drink when the next day has work
- Personal electric bicycles are prohibited from charging in the company
- Office equipment cannot be taken home, unless it is work needs and it is advice from team leader
- It is forbidden to do other work of part-time during the working period.

7. TERMINATION:
7.1 Termination by the Employer: Employer reserves the right to terminate Employee’s services for just and
authorized causes provided under the Company’s Handbook and Code of Conduct and/or the Philippine laws
including, but not limited to, the following:
- Serious misconduct
- Insubordination or willful disobedience by the employee of the lawful orders of the Employer or the
latter’s representative in connection with his work
- Gross and habitual neglect of duties
- Fraud or willful breach by the employee of the trust reposed in him by the Employer or duly
authorized representative
- Commission of a crime or offense by the employee against the person of the Employer or any
immediate member of the latter’s family or duly authorized representative
- Abandonment of work
- Closure or cessation of the operations of the business of the Employer
- Retrenchment
- Redundancy
- Disease, where the continued employment is prohibited by law or is prejudicial to employee’s
health or to the health of his co-employees
- Other cases analogous to the foregoing
7.2 Termination by the Employee: In the event Employee wishes to terminate his employment, he shall serve a
written notice thereof to the Employer at least one (1) month prior to the effectivity thereof.
- In the event of dismissal/termination of employment for any cause or in case of resignation of the
Employee, Employee shall be required to undergo exit clearance procedure no later than thirty (30) days
prior to the effective date of dismissal/termination or resignation, or such shorter period as Employer
may determine, and to comply with transitional instructions to ensure the continuity of the operations of
the Employer. Employer reserves the right to deliver the last pay of the Employee, if any, or issue any
certificate only upon faithful compliance of his obligations, as provided herein.

8 MISCELLANEOUS: Other aspects of employment shall be covered and governed by the Company’s Handbook
and Code of Conduct and such other rules and regulations as may, from time to time, be issued, determined or
provided by the Employer.

9 DECLARATION OF COMPREHENSION / CONFORMITY: Employee hereby declares that he has read the
Contract and has fully understood every provision thereof, and hereby expresses his acceptance of and conformity
to the terms and conditions of his employment, as provided herein.

place first above written.
