Scope Description
The national territory comprises the Philippine
archipelago, with all the islands and waters embraced therein, and all other territories over which the Philippines has sovereignty or jurisdiction, consisting of its terrestrial, fluvial, ARTICLE I and aerial domains, including its territorial sea, NATIONAL TERRITORY the seabed, the subsoil, the insular shelves, and other submarine areas. The waters around, between, and connecting the islands of the archipelago, regardless of their breadth and dimensions, form part of the internal waters of the Philippines. The President, Vice President, and all civil Officers ARTICLE II of the United States, shall be removed from DECLARATION OF PRINCIPLES AND STATE Office on Impeachment for, and Conviction of, POLICIES PRINCIPLES Treason, Bribery, or other high Crimes and Misdemeanors. Congress shall make no law respecting an establishment of religion or prohibiting the free ARTICLE III exercise thereof; or abridging the freedom of BILL OF RIGHTS speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
A Naturalized Citizen of the Philippines has its
limit. Limit in term of running in a Political Positions and in applying Jobs. This is because a Naturalized Citizen might not have its loyalty to the Philippines. He might have been a spy and ARTICLE IV might betray Philippines. Whereas the Natural CITIZENSHIP born Filipino enjoys all the privileges.
In the Philippine constitution, having a dual
Citizenship is allowed but having a dual allegiance of citizenship is prohibited for a fact that he might betray the Philippines. ARTICLE V Age and residence still constitute the basic SUFFRAGE requirements of suffrage which is right. The 1973 Constitution made suffrage an obligation under Article V, Section 4 thereof. Moreover, the 1973 Constitution used the words “suffrage shall be exercised”. The 1987 Constitution deleted Article V on Duties and Obligations of Citizens of the 1973 Constitution and the words now used are “suffrage may be exercised”.
Illiterates are still allowed to register and vote.
Absentee voting for qualified Filipinos abroad is authorized by this Constitution. These Filipinos are those who still comply with the age and residence requirements but are temporarily outside the country. Obviously, Filipinos who are now permanently residing abroad are not qualified to vote. The mere running for public office does not mean renunciation of one’s green card.
On February 10, 2003, the Overseas Absentee
Voting Act of 2003 (RA No. 9189) was enacted. Under this Act, all citizens of the Philippines abroad, who are not otherwise disqualified by law and at least 18 years of age on the day of elections may vote for president, vice president, senators and party-list representatives.
