UNITED STATES – TARIFF MEASURES ON CERTAIN GOODS FROM CHINA III

COMMUNICATION FROM THE UNITED STATES

The following communication, dated 12 September 2019, was received from the delegation of the
United States with the request that it be circulated to the Dispute Settlement Body (DSB).

On September 2, 2019, the United States received China's letter of the same date requesting
consultations pursuant to Article 4 of the Understanding on Rules and Procedures Governing the
Settlement of Disputes ("DSU") and Article XXIII of the General Agreement on Tariffs and
Trade 1994. The letter has been circulated as WT/DS587/1.

The United States takes note of State Council Tariff Commission Public Notice No. 4 (2019), entitled
Additionally Imposing Tariffs on Certain Products Originating from the United States. The State
Council issued this public notice on August 23, 2019. Pursuant to this notice, China is imposing
additional tariffs of 5 to 10 percent on over 5,000 different U.S. products with a trade value
of $75 billion. The notice indicates that China is implementing these additional tariffs in two batches,
effective September 1, 2019, and December 15, 2019, respectively.

At the consultations, the United States looks forward to hearing China's basis for imposing these
additional tariffs. The United States also looks forward to hearing how China intends to address the
trade-distorting policies addressed in the U.S. investigation mentioned in China's request for
consultations.

The United States accepts the request of China to enter into consultations. We stand ready to confer
with officials from your mission on a mutually convenient date for these consultations.
