discussion portion of the event, Greene asked the panelists about Pruneyard Shopping Center v.
Robins, in which the U.S. Supreme Court ruled that when California gave a group of high school
students a state law right to protest at a mall, the federal First Amendment did not give the mall
owner a right to exclude the speech. “I’ve often wondered whether people think that Pruneyard
could serve as a model for congressional action, to insist that large social media platforms act as
public forums,” said Greene. Today, data driven decision-making is at the center of educational
policy debates in the United States. School districts are increasingly turning to rapidly evolving
technologies and cloud computing to satisfy their educational objectives and take advantage of new
opportunities for cost savings, flexibility, and always-available service among others. As public
schools in the United States rapidly adopt cloud-computing services, and consequently transfer
increasing quantities of student information to third-party providers, privacy issues become more
salient and contentious. The protection of student privacy in the context of cloud computing is
generally unknown both to the public and to policy-makers. This study thus focuses on K-12 public
education and examines how school districts address privacy when they transfer student information
to cloud computing service providers. The goals of the study are threefold: first, to provide a
national picture of cloud computing in public schools; second, to assess how public schools address
their statutory obligations as well as generally accepted privacy principles in their cloud service
agreements; and, third, to make recommendations based on the findings to improve the protection of
student privacy in the context of cloud computing. Fordham CLIP selected a national sample of
school districts including large, medium and small school systems from every geographic region of
the country. Using state open public record laws, Fordham CLIP requested from each selected
district all of the district’s cloud service agreements, notices to parents, and computer use policies for
teachers. All of the materials were then coded against a checklist of legal obligations and privacy
norms. The purpose for this coding was to enable a general assessment and was not designed to
provide a compliance audit of any school district nor of any particular vendor. Social Science

REAL is designed to orient participants to the study of law, and to help new first-year law students
feel prepared, confident, and welcome in the Fordham Law community. Program participants
participate in a pre-orientation program, which consists of classes that will introduce students to the
foundation of law and as well as focus on the basics of legal reasoning and analysis and fundamental
legal concepts. There is a wellness component to the program, which includes Peak Performance
sessions to manage the personal aspects of navigating law school. Participants will also learn useful
information from peer mentors during the program. The Fordham Law curriculum offers a perfect
mix of courses devoted to theoretical inquiry as well as practical experience. LL.M. students have
the opportunity to enroll in drafting courses, clinics, and externships that offer them hands-on legal
experience. LL.M. students may also apply for special staff positions on student-run journals.
Student lists are commercially available for purchase on the basis of ethnicity, affluence, religion,
lifestyle, awkwardness, and even a perceived or predicted need for family planning services. This
study seeks to provide an understanding of the commercial marketplace for student data and the
interaction with privacy law. Over several years, Fordham CLIP reviewed publicly-available sources,
made public records requests to educational institutions, and collected marketing materials received
by high school students. The study uncovered and documents an overall lack of transparency in the
student information commercial marketplace and an absence of law to protect student information.
LAW SCHOOL NEWS LAW Another draw, Parikh explains, was the support that Fordham Law
offers to those with an interest in public interest law. As a Stein Scholar, Parikh will benefit from the
guidance and support of past graduates working in pro-bono, non-profit, and government law

Fordham University School of Law at Lincoln Center serves as the centerpiece for the first phase of
Fordham University’s 15-year Upper West Side campus master plan. Designed by Pei Cobb Freed &
Partners Architects, the 22-story, 468,000-square-foot, LEED Silver-certified building features a 2-
story atrium, moot and trial courtrooms, a 562,000-volume law library, and a residence hall
containing student housing and apartments for faculty. The lower 9 floors of the tower, comprising
the law school, feature a precast checkerboard façade, while the upper stories, containing housing for
over 400 undergraduate students, are clad in an aluminum and glass curtain wall. The building forms
a series of undulating arcs that gesture toward the School’s neighbor, Lincoln Center for the
Performing Arts.
