Government of Maharashtra vide Government Resolution, dated 23.02.2023 referred


at Sr- No. 1 above, has directed the respective Planning / Competent Autho ty in the State of
Maharashtra to ensure that their websites are integrated with the website of MahaRERA in a
time bound manncr. Irending such integration, the above-referrcd Govemment Resolution,
further directs the respe.tive Planning / Competent Authority to attach and Iorward at the
division wise emails setapartby MahaRERA, the Commencement Certificates / Occupation
Certilicate issued in respect o{ real estate proiecls, immediately upon issuance of the same,
so as to enable MahaRERA to comparc and verily for the purpose of ascertaining the
autlenticity / genuineness of the Commcnccment Certificates / Occupation Certificate
submitted by promoters along with their application for registration oI their real estatc
projects / corection appreciation / form - 4 & other.
The above-referred Government Resolution was issued to avoid promoters obtaining
registration from MahaRERA of their rcal estate project on the basis of submission of fakc /
fraudulent Commencement Certificates as noticed in some cases pertaining to Kalyan
Dombivli Municipal Corporation.
Pursuant to the Government Resolution, MahaRERA has issued MahaRERA Order
referred at Sr. No. 2 above. By this Order, the cutoff date to commence verification of the
Commencement Certilicates / Occupation Certificate has been fixed $'ith effect Irom
19.06.2023. Though the above-.referred MahaRERA Oftter has been put up on the website on

15.05.2023, till date every Planning / Competent Authority are not complying with the
directions issued in the above-referred Govemment Resolution.
ln this regard it is rcquested that an intimation be sent to all concemed olficers of the
Planning / Comp€tent Authority dire.ting t]'em to comply with the directions issued in the
Govemmmt Resolutions as well as calling upon them to have a separate designated email id
for the purpose of atta(hing and forwarding the Commencement Certificate / occupation
Certificate under intimation to MahaRERA. Further follow up action with these officerc shall
be taken up by MahaRERA. lf a dedicated email is made and communicated to MahaRERA
than all other emails bein8 written to the email set apart by MahaRERA for the PurPose of
receiving the Commencement Cerhficates / Occupation Certificate coulcl be blocked. This
action will enable receipt by MahaRERA ofonly the emails and the attached Commencement
Certificates ftom the designated emails of the respective Planning / Comp€tent Authority,
thus avoiding non-reliable emails.

The copy of MahaRERA Order relerred at Sr. No. 2 above is enclosed herewith for
your teady reference. The Covernment Resolution referred above as well as th€ list of emails
set apart by MahaRERA for receipt of Commencement Certilicates / Occupation Certilicate
for verification are attached to the said Order as Annexure'A' and 'B' respectively.
It is to be further inlormed that the MahaRERA order 32/2022 as refened 3) above

shall be shictly implemented with elfect from ln August 20a3. Therefore, all members of the
resPective SROS shall be informed and aware about the penalty provisions specifically so as

to ensure diligentsubmission of the applications by the promoters with due care and complete
in all respect including uploading legible documents in the respective tabs only.
This may please be treated as MO6T URGENI as the applications submitted for
registration of real estate projects cannot be cleared unless the Commenrement Certificates /
Occupation Certificate are verified for its authenticity/genuineness as per the directiorx
issued under the Government Resolution {or registration of prciect with MahaRERA, other

PurPose.

Whereas, Govemment of lndia has enacted the Real Estate (ReEgulation and
Dovclopmcnt) Act 2016 (thc A.t) and all sedions of the Act ha!e come into force \4,ith
eficct from 01-05.2017.

And whereas, the Covcmmcnt of MalTarashka l,idc Notifi.ation No. 23 datcd


08.03-2017 has established the lvlaharashtra Real Estate Regulator)- Authoritv,
hereinafter re{erred to as "MahaRERA" or as "thc Authorit}"-

Antl whereas, the Government of Ma-tLlrashtra has notilied the Maharashtra


Real E:,tatc (ReBxlation and Dcvelopmcnt) (Registration of Rcal Ertate Proic.tlr,
Rcgistration of Real Estate Agents, Rates of Interesi and Disclosures on Website)
Ru1es,2017 (the Rul!,s) for canl ing out the provisions of the Act.

And u'hereas, the Authoritv has notjfied the Maharashtra Real Estate
Regulatory Authofity (General) Regulations,2017 (the Regulations) to.arr!' out the
PurPoses of the Act.
And .{uthority uncler Section 37 of the Act, and Regulatlon 38 of

Devclopment Department, Govemnent of Maharashta to put in place a svstem

And whereas, Secretarv, MaiaRER,A. vide letter dated 10.11.2022 in vielv of the
orders !')assed bv the Authori{ in the SuGMoto prcrccedings had requestcd Urban
De\.elopment Department, Govcmment of Maharashtra to ensurc that thc wcbsite oI
thc rcspc(tive Competent Althoritics in the State are integrated with the website of
MahaRERA in a time bound manner anci pending such integration neccrjsary
dlrectioru be issued that the respcctivc Competent Authoriry shall as and uhcn
commcncc'rncnt .ertificates and ffcupation certifi.ates are i$sucd, attach and forward
thc same to a designated email set apari in that regard bv MahaRERA.

And whcreas, the Covcrnment of Maharashtra by Governmcnt Rcsolution


dated 23.02.2023 refcrrcd above has issued necessary direations to the tespective
Competent AuthoritY in the state of Maharashtra, the cr)pv of the aboye-referred
Government Resolution is attacl'rcd llere&'ith as Annexure'A'.

In vicw,of the above-referred Covcmmcnt R.,solution dated 23.02.2023 thc


iollorving ftrriher dircctions are issued:

a) With cifert from 19,06.2023 the commencement ce*ificate submitted by


promoters alongrvith thcir application for regishation of real estate projects
shall bc compared and verified for its authenticit\,/ genuineness $,ith the
aommencement certilicate attached and forwarded to the dcsignated cmail
set apart bv MahaRERA- The designatcd emails sct apart by MahaRERA nr
that regard is anne\ed hetervith as Annexuie 'B'.
b) Only after the commencement certi{icate is conjirm€d as hav.ing been issued
by the respective Competent Authoritv, as the case maY be on compari5on
and vcrification \ .ith the commencement certificate submittLd bl, promotor

d) The timeline prescribed in Clausc 6 in MahaRERA Cturular No.6 of 2017
dated O,1.07.m17 bearing No. MahaRERA/ Strv/ File No.2Z113l2017 in thc
matte! of start of the period of 30 days mcntioncd in Scrtion 5 of the Act
shall also apply to the pr.rcdurc cnumcrated in clauses (a) and (b) above.
