APPEALS FOR HEARING


All Appeals are heard by way of a physical hearing unless otherwise directed by the Court.

A revised version of Practice Direction CA06 came into effect on June 1st 2022 a copy of which is available on
the Courts website www.courts.ie.

LODGING OF BOOKS OF APPEAL


Parties are required to lodge complete books of appeal (in hard and soft copy) not later than 4 weeks prior to
the date of the appeal in accordance with Practice Direction CA06 or such other date as shall be fixed by the
Court. This must include the transcript of the DAR or approved note of the judgment of the High Court
where appropriate and a joint book of authorities. A party who has been authorised to file the books of
appeal may file the books in accordance with this direction notwithstanding the failure of another party to the
appeal to furnish its written submissions to such party for inclusion in the books of appeal.

In the event that the books are not lodged within the time fixed, the appeal shall be relisted in the next
directions list in the Court of Appeal for mention. If the books are not lodged by the latter date, the Court may
make an order extending the time for the late filing of the books of appeal for such short period as it deems
appropriate subject to an order that the appeal shall stand struck out for failure to comply with the directions of
the court. In the event of a failure to comply with such order the appeal shall be struck out. Where an appeal is
listed in the directions list by reason of the foregoing, the party in default may be liable for the costs arising
from attendance at the directions list.

Parties should lodge the books of appeal (including the books of authorities) in hardcopy (x 4) and also in soft
copy via the ShareFile platform.

DIRECTIONS LIST AND MOTION LISTS


From 12 January, 2024 the weekly directions and motions lists before Ms. Justice Costello will no longer be
conducted routinely by way of hybrid hearing in Court of Appeal Court 1, Old Public Records Building, The
Four Courts. This means that all parties must attend in person, save where the court directs otherwise.

In accordance with provisions of Order 86A Rule 16(1) the directions book is to be lodged in the office by close
of business on the preceding Friday. In accordance with the provisions of Order 86 Rule 12(5) (dealing with
interlocutory applications) the motion book is to be lodged in the office by close of business on the preceding
Tuesday.

FRIDAY CALLOVER OF APPEALS LISTED FOR HEARING

From 12 January, 2024 the weekly advance Callover of appeals listed for hearing are conducted in person
before Ms. Justice Costello unless otherwise directed by the court. The Callover lists for each respective Friday
list are published in advance in the Legal Diary. The Legal Diary list is updated on a daily basis. It is the
responsibility of the parties in listed appeals to check the Legal Diary for the date of the relevant Callover
(usually scheduled for six weeks in advance of the appeal hearing date).

Parties will be aware that the purpose of the Callover is to confirm that the submissions and books of appeals
(including books of authorities) have been lodged, and that there has been compliance with any other directions
previously given by the Court. It is vital therefore that there be an attendance at the Callover by all parties to an
appeal.

VIRTUAL MEETING ROOM (VMR) DETAILS FOR FRIDAY LISTS - IMPORTANT


Parties are asked to note that the Virtual Meeting Room (VMR) details for the Callover / Directions / Motion
list on each Friday will no longer be furnished unless directed by the court. If any party is unable to attend in
person, they may apply to the Office of the Court of Appeal for leave to appear remotely for a decision by the
judge in charge of the list, which application should be supported by a medical report which details the medical
reasons why the party concerned is unable to attend in person. Without prejudice to the foregoing, the court
may in any case for good and sufficient reason permit a party to appear remotely.

COURT OF APPEAL ORDERS


Due to the recent upgrade to the High Court case management system, it is not currently possible to view when
Court of Appeal Orders are perfected on High Court Search.

DELIVERY OF ELECTRONIC JUDGMENTS


Written judgments of courts may be delivered by means of a copy of the judgment being sent electronically to
the parties and a copy, subject to such redactions as would ordinarily apply, being posted as soon as possible on
the Courts Service website. The date and time of delivery to the parties will be notified in the Legal Diary.

The parties may be invited to communicate electronically with the Court on issues arising (if any) out of the
judgment such as the precise form of order which requires to be made or questions concerning costs or they
may be requested to attend physically to address the Court on these issues. If there are such issues and the
parties do not agree in this regard concise written submissions should be filed electronically with the Office of
the Court, [email protected], within 14 days of delivery subject to any other direction
given in the judgment.

CIVIL APPEALS FOR HEARING IN THE CRIMINAL COURTS OF JUSTICE


Civil appeals with a custody element i.e. Article 40 habeas corpus, extradition, bail and judicial review arising
out of criminal proceedings are now dealt with by the criminal office which is situated on the 4th Floor of the
Criminal Courts of Justice Building, Parkgate Street, Dublin 8. The civil office will continue to issue the Notice
of Appeal and identify whether the appeal comes within the category of appeal to be heard in the Criminal
Courts of Justice and allocate the next available case-management list in the Criminal Courts of Justice for a
directions hearing. The file will then be transferred to the criminal office and all subsequent documents in the
appeal process are to be lodged in the criminal office which will have responsibility for the management and
listing of the appeal. Any enquiries in relation to such appeals should be made to the criminal office by email
to [email protected] or by telephone on (01) 7988004.

All Appeals are being conducted by way of a physical hearing unless otherwise directed by the Court.

LODGING OF DOCUMENTS FOR CRIMINAL APPEAL HEARINGS


Parties are required to lodge all document pertaining to criminal appeal hearing not later than 2 weeks prior to
the hearing date.

Parties are required to lodge complete books of appeal (in hard and soft copy) not later than 4 weeks prior to

CASE MANANGEMENT LIST


The weekly Case Management List before The President will be conducted by way of hybrid hearing in Court
of Appeal Criminal (CCJ-Court 16).
This means that The President/Judge and the Registrar will be sitting in the Courtroom physically and that
Parties can either attend physically or attend remotely by means of the VMR platform.

While it is intended to have a list every Friday in term practitioners are advised to check the Legal Diary on an
ongoing basis to confirm that there is a list scheduled on a Friday where a matter is required to be listed for
case-management. The court office will also be able to confirm the dates of such lists.

In relation to civil appeals listed in case management and accordance with provisions of Order 86A Rule 16(1)
the directions book is to be lodged in the office by close of business on the preceding Friday.

Sentence appeals and undue leniency applications


See Practice Direction (CA02) for requirements as to materials (reports, testimonials etc) for the use of the
court in sentence appeals and undue leniency applications. Practitioners are urged to ensure that any such
materials are furnished to the court office at least two weeks in advance of the remote hearing date to facilitate
the transmission of the materials to the Court. Practitioners are also reminded that there is no necessity to apply
to Court for the preparation of a Governor’s Report or an Educational Report so that such Reports are available
in the event of the Court finding an error in principle in the sentence imposed by the court of trial. On receipt of
an email to the court office (in good time in advance of the hearing date) specifying the nature of the Report
required, the date of the appeal hearing and the prison where the appellant or respondent (as the case may be) is
incarcerated the office will request the required Report from the relevant prison.

Chief Prosecution Solicitor – service of documents and notification of any intended application
Practitioners are reminded of the requirement to serve on the Chief Prosecution Solicitor for the Director of
Public Prosecutions written submissions lodged in or transmitted via email to the court office. Except for the
documents referred to in Order 86C Rule 7 (1) (a notice of appeal or a notice of application pursuant to section
2 of the Criminal Procedure Act 1993) and in Order 86C Rule 15(1) (a notice of abandonment) notice of which
the Registrar is required to give to various parties including the Chief Prosecution Solicitor all other documents
lodged in or transmitted via email to the court office must be served on the Chief Prosecution Solicitor. Notice
of any intended application to the Court must be given to the Chief Prosecution Solicitor as well as to the court
office.

The following arrangements will apply to all cases listed in the Dublin Personal Injures List until further

The default position will be that, save where otherwise ordered, all cases will be afforded a physical hearing

Twenty cases will be listed each day -Tuesday to Friday (to include 2 Specially Fixed cases)
Cases not assigned to a Judge for hearing on the day on which they are listed will roll over from day to day
Any cases not reached or commenced at the end of a week will be removed from the list and will require, in
due course, an application to be made for a new hearing date in the usual manner.
All Specially Fixed cases and cases afforded priority will retain priority over other cases

Papers and Correspondence with Registrars

Please take notice of the following directions regarding the lodgement of papers and correspondence with
registrars:
1. Non-Jury, Judicial Review and Asylum Hearings and Callover of Hearings
Papers for hearings in Non-Jury, Judicial Review and Asylum Lists must be lodged in the List Room no later
than the Tuesday of the week prior to the Hearing date. (Please note, this deadline does not apply to the
Monday Judicial Review ex parte list and the Monday Asylum and Immigration ex parte list- for information
on lodgement for that list, see item 3 below).
Parties in Asylum, Immigration and Citizenship List hearings should note that the Tuesday deadline
supersedes the deadline for lodgement of papers for hearings included in in Asylum Practice direction HC81.
Any application for late lodgement of papers must be made to the List Judge at the callover on the Thursday
of the week prior to the Hearing date.
The callover takes placed on a hybrid basis and begins at 10 a.m. Parties must also indicate at the callover
whether the hearing will be physical, hybrid or remote. If no preference is given, the hearing will be physical.
If there is no attendance at the callover, the hearing will be struck out.

Correspondence to the registrars/mailbox/Judicial Assistant seeking permission for the late lodgement of
papers, requests to change the mode of hearing or applications to re-instate hearings that have been struck out
will not be acknowledged. No additional/missing documents will be accepted by email. Any further
applications must be made to the Court at the end of the list any day.
Papers for hearings will not be returned and will be shredded. They must be re-lodged prior to any new
hearing date.

2. Case Management Hearings

which the parties wish to bring to the attention of the Court, these may be handed in by the solicitor when the
matter is called.

3. Judicial Review Ex Parte and Asylum Ex Parte Lists


Papers for Judicial Review ex parte applications listed in the Monday Judicial Review Ex parte list and the
Monday Asylum Ex parte list must be lodged in the List Room no later than the Monday of the week prior to
the list (i.e.no later than 7 days before the Listing). Due to capacity issues in the List Room, papers can only
be accepted from a fortnight before the listing date up until the Monday of the week prior to the Listing.
Papers for leave applications will not be returned and will be shredded They must be re-lodged prior to any
adjourned date.
4. Judicial Review and Asylum- “Leave on Notice” Applications
If the Court directs that an application for leave to seek Judicial Review is to be made on notice, the
applicant/applicant’s solicitor must liaise with the solicitor for the respondent prior to the return date to
ascertain if the leave application will be contested.
If the leave application will not be contested, the applicant/applicant’s solicitor must hand in a copy of the
Statement of Grounds to the Judge in court.
If the leave application is contested by the respondent(s), a hearing date will be given and papers must be
lodged in the List Room prior to the hearing in accordance with Item 1 above.

5. Judicial Review and Asylum- Applications to Open and Adjourn (to stop time)
Applications to open a Judicial Review for the purposes of stopping time only can be made at the end of the
list any day, provided the case has been issued by the Central Office and a record number has been obtained.
Practitioners do not have to email the registrar to ask for permission to mention the proceedings in advance.
Booklets of papers are not required in Court for the application to open the Judicial Review for the purposes
of stopping time.

6. Matters Listed for Mention


Papers are not to be lodged in the List Room for matters listed for mention. If there are papers which the
parties wish to bring to the attention of the Court, these are to be handed in when the matter is called.
Emails to registrars/Judicial Assistants regarding papers/correspondence for the Judge will not be
acknowledged.

7. Queries to the Non-Jury/Judicial Review List mailbox


Parties should be mindful of the volume of correspondence that registrars are receiving and must consult
High Court Search, the list diaries and Today’s cases on the Legal Diary and this notice before contacting the
registrar/mailbox.
The Non Jury and Judicial Review mailbox ([email protected]) should primarily be used to
send in terms of orders or to request that certified actions are listed for mention to get a hearing date.

8. Consent Applications
Consent applications in the Non-Jury and Judicial Review Lists will be taken by the registrar on Tuesday,
Wednesday and Friday from 10:15. On Thursday, consent applications will be taken at the end of the
Callover of hearings.

9. Obtaining a hearing date for Non-Jury Actions


Once the Certificate of Readiness has been filed in the Central Office, please email
[email protected] along with a soft copy of the Certificate. The action will be listed for
mention on the next available Wednesday.
Once the registrar provides the date, the requesting party must then inform the other party/parties of the date.

Monday Judicial Review ex parte list and the Monday Asylum and Immigration ex parte list- for information on
lodgement for that list, see item 3 below).
Parties in Asylum, Immigration and Citizenship List hearings should note that the Tuesday deadline supersedes
the deadline for lodgement of papers for hearings included in in Asylum Practice direction HC81.
Any application for late lodgement of papers must be made to the List Judge at the callover on the Thursday of
the week prior to the Hearing date.
The callover takes placed on a hybrid basis and begins at 10 a.m. Parties must also indicate at the callover
whether the hearing will be physical, hybrid or remote. If no preference is given, the hearing will be physical. If
there is no attendance at the callover, the hearing will be struck out.
Correspondence to the registrars/mailbox/Judicial Assistant seeking permission for the late lodgement of
papers, requests to change the mode of hearing or applications to re-instate hearings that have been struck out
will not be acknowledged. No additional/missing documents will be accepted by email. Any further
applications must be made to the Court at the end of the list any day.
Papers for hearings will not be returned and will be shredded. They must be re-lodged prior to any new hearing
date.

11. Case Management Hearings


Lodgement of papers in advance is no longer required for Case Management hearings. If there are papers
which the parties wish to bring to the attention of the Court, these may be handed in by the solicitor when the
matter is called.

12. Judicial Review Ex Parte and Asylum Ex Parte Lists


Papers for Judicial Review ex parte applications listed in the Monday Judicial Review Ex parte list and the
Monday Asylum Ex parte list must be lodged in the List Room no later than the Monday of the week prior to
the list (i.e.no later than 7 days before the Listing). Due to capacity issues in the List Room, papers can only be
accepted from a fortnight before the listing date up until the Monday of the week prior to the Listing.
Papers for leave applications will not be returned and will be shredded They must be re-lodged prior to any
adjourned date.
13. Judicial Review and Asylum- “Leave on Notice” Applications

If the Court directs that an application for leave to seek Judicial Review is to be made on notice, the
applicant/applicant’s solicitor must liaise with the solicitor for the respondent prior to the return date to
ascertain if the leave application will be contested.
If the leave application will not be contested, the applicant/applicant’s solicitor must hand in a copy of the
Statement of Grounds to the Judge in court.
If the leave application is contested by the respondent(s), a hearing date will be given and papers must be
lodged in the List Room prior to the hearing in accordance with Item 1 above.

14. Judicial Review and Asylum- Applications to Open and Adjourn (to stop time)
Applications to open a Judicial Review for the purposes of stopping time only can be made at the end of the
list any day, provided the case has been issued by the Central Office and a record number has been obtained.
Practitioners do not have to email the registrar to ask for permission to mention the proceedings in advance.
Booklets of papers are not required in Court for the application to open the Judicial Review for the purposes of
stopping time.

15. Matters Listed for Mention


Papers are not to be lodged in the List Room for matters listed for mention. If there are papers which the parties
wish to bring to the attention of the Court, these are to be handed in when the matter is called.
Emails to registrars/Judicial Assistants regarding papers/correspondence for the Judge will not be
acknowledged.

16. Queries to the Non-Jury/Judicial Review List mailbox


Parties should be mindful of the volume of correspondence that registrars are receiving and must consult High
Court Search, the list diaries and Today’s cases on the Legal Diary and this notice before contacting the
registrar/mailbox.
The Non Jury and Judicial Review mailbox ([email protected]) should primarily be used to send
in terms of orders or to request that certified actions are listed for mention to get a hearing date.
The most efficient way of raising queries is to mention your query to the Non-Jury and Judicial Review
registrar before the List or at the end of the list on Tuesday-Friday inclusive.
Most other requests to list matters for mention can mentioned to the Judge at the end of the List on Tuesday (in
respect of Judicial Review proceedings), Wednesday (in respect of non-Jury proceedings) or Fridays (in respect
of Asylum applications).
If sending a query to the mailbox, please ensure the record number is quoted in the subject line of the
correspondence.

17. Consent Applications


Consent applications in the Non-Jury and Judicial Review Lists will be taken by the registrar on Tuesday,
Wednesday and Friday from 10:15. On Thursday, consent applications will be taken at the end of the Callover
of hearings.
