Non Governmental Organizations (Renewal and Incentives) GOVERNMENT NOTICE NO. 686 published on 20/9/2019 THE NON GOVERNMENTAL ORGANIZATIONS ACT (Cap. 56) REGULATIONS (Made under section 17(7) and 38) ‘THE NON GOVERNMENTAL ORGANIZATIONS (RENEWAL AND INCENTIVES) REGULATIONS, 2019 Gitaion 1. These Regulations may be cited as the Non- Governmental Organizations (Renewal and Incentives) Regulations, 2019. Interpretation 2. In these Regulations, unless the context require otherwise- “Act” means the Non- Governmental Organizations Act; “incentive” means, any privilege recognized by the Minister from time to time after an organization has delivered its objectives to the intended community and complied Applicaton for 2.-(1) An application for renewal of certificate of renewal of registration under section 17(4) of the Act shall be made to registration, ‘ Roe the Registrar in the manner prescribed in NGOB — Form No. | as set out in the schedule to these Regulations. (2) The Registrar shall, upon satisfaction by the Board, and upon payment of necessary costs to be determined by the Board, issue certificate of registration prescribed in NGOA - Form No. 3B as set out in the Schedule to these Regulations, (3) Notification for refusal to renew registration certificate shall be in NGOB — Form No. 2 as set out in the Schedule to these Regulations. (4) Upon refusal, the Registrar shall notify the Non Governmental Organizations (Renewal and Incentives) GN. No. 686 (Contd.) Incentives for ‘good performance to respective Non Governmental Organization, within 14 days from the date of receipt of the application for renewal, stating the reasons for such refusal. (5) Any Non-Governmental —_ Organization aggrieved by a decision of the Registrar under this regulation may appeal to the Minister within thirty days from the date of decision (6) An Organization aggrieved by the decision of the Minister may appeal to the High Court whose decision shall be final. 3.-(1) The Minister, may award incentives to any NGO which has shown better performance in discharging its duties for the purpose of- (a) motivating Non-Governmental Organization in performing its duties diligently; and (b) promoting performance and productivity by the Non-Governmental Organization to the Government plans. (2) The Minister shall, when considering to award any incentive to a Non Governmental Organization, take into account the following criteria- (a) the Non-Governmental Organization has implemented its objectives and plans in line with Government plans; (b) has fully complied with Non-Governmental Organizations Act and its Regulations; and (c) any other criteria as may be deemed fit by the Minister. (3) The Minister may, upon satisfaction of the performance criteria under sub regulation (2) of any Non- Governmental Organization, award such Non- Governmental Organization with a certificate of recognition to appreciate its contribution to the Government developmental plans as prescribed in NGOB — Form No.3 set out in the Schedule.
