Presidential form of Government

introduction :
A presidential system is a system of government
where a head of government is also head of states and
leads an executive branch that is separate from
legislative branch.
The majority party and the cabinet are a team in a
parliamentary system. But the president is directly
elected by the people.
Under a Presidential form, there is separation of
powers between both the branches of government.
A presidential system or a single executive system is a
form of government (president) leads an executive
branch that is separate from the legislative branch.
Organization of Presidential Form of Government:
• The President
• The ministers of President
• The congress
Definition:
According to Merriam Webster Dictionary:
“A System of government in which the
president is continuously independent of legislature.
• According to Gettell:
“presidential government is that form in
which the chief executive is independent of the
legislature as to his tenure and to a large extent, as to his
policies and acts. In this system, the head of the state is
real executive.”
Features
• Real head of the state:
In this system the head of the state is the real
executive head.
• Separation of powers:
The presidential form of government is based
on the principle of separation of power among the three
organs of the government.
The executive is not responsible to legislature.
The executive cannot dissolve the legislature. And the
judiciary is independent from executive and legislature.
• Principle of checks and balances:
All the three organs of the government are
separated from each other but all are checking each
other and warning each other from any type of
transgression (misbehavior) of their power and functions.
• Superior position of president:
The president occupies a superior position
because all the power of the government are
concentrated with him.
• Political homogeneity not necessary:
It is not necessary that all cabinet should belong
to same political party.
• Election of chief executive:
In president system people elect the chief
executive directly or indirectly e.g., in America the
president elected formed for this purpose while the
members of electoral collage are elected directly by the
voters in each state.
• Tenure:
Tenure of president is fixed and he cannot be removed
before his specific period. For Example, in America
tenure of president is fixed for four years. Legislature
can’t remove the president without vote of confidence.
MERITS OF PRESIDENTIAL FORM OF GOVERNMENT:
1. Stable government:
President is elected for fixed tenure of four years.
His fixed tenure brings stability and efficiency in the
administration.
2. Separation of power:
This checks the dictatorship of any branch of the
government and ensures citizens rights and liberties.
3. Suitable in emergency:
Since the president is head of the state and
government, he can take important decisions promptly and
effectively.
DEMERITS/CRITICISM OF PRESIDENTIAL FORM OF
GOVERNMENT:
1. Checks and Balance:
The checks and balance are antithetical to economic
planning.
2. Rigid Constitution:
Rigidity of constitution is also criticized because
flexibility is required to cope with the changing
circumstances.
3. Less possibility of good laws:
Less possibility of enactment of good laws as there is
less harmony between executive and legislature.
