In Milton V Baby Nona the wife was deserted by her husband and she did not
know his whereabouts for many years. Thinking that her husband has died, the
wife contracted a 2nd marriage and later both husband and wife of the 2 nd
marriage adopted a 4 year old child after obtaining a court order for adoption. In
the adoption order it had been stated that both of them were spouses. When the
husband of the 2nd marriage died, the wife claimed intestate rights to his
property. The Supreme Court refused to accept her as an heir since she had not
obtained a divorce from her 1 st marriage, the husband of which was still living.
Then the adopted child claimed the right for the letters of administration on the
basis that he was an issue of a putative marriage and that the rights enjoyed by
children of such marriage should be extended to adopted children as well. The
Supreme Court did not make any reference to the putative marriage and held the
validity of and order given 24 years ago cannot be questioned in a testamental
proceedings and ordered that letters of administration be given to the adopted
child. This indicates that the concept of putative marriage has not been rejected
by our courts.
