OBLIGATIONS AND CONTRACTS

School Year: 2021-2022

Schedule: MONDAYS – 5:30 p.m. – 8:30 p.m.

COURSE DESCRIPTION:

This course involves the study of the Philippine law on obligations and contracts. The
first part of the course will deal with prescription on Title V, its definition, concept, kinds, and
its effects of rights of the people. Subsequently, the concept of obligations will be discussed,
specifically its nature and effect, the various kinds of obligations and its mode of
extinguishment in the second part. The third part is the study of contracts, its essential
requisites, the forms of contract, the rules of interpretation of contract and the various kinds
of defective contracts under Philippine Law.

The provisions on obligations and contracts are found on Book IV of the Civil Code of
the Philippines.

The course also includes a study of Natural Obligations under Title III, Book IV and
Estoppel under Title IV, Book IV, also of the Civil Code of the Philippines.

ROOM POLICY:

1. GRADING SYSTEM: 80% Exams (4 exams – 20% each); and 20% Recitations (includes
quizzes or digests)
2. RECITATIONS: Usually, case recitations. It will be in random through shuffling of
index cards. If called for recitation and the student is absent, he/she will get zero (0).
For students who decides to pass after being called, he/she will be scored 50%. A
student will be scored on his/her recitations according to the mastery of the
topic/case and his/her ability to answer questions RESPONSIVELY without merely
reading his/her material.
3. EXAM: Exams will be scheduled after finishing the coverage for that particular exam.
The schedule will be made according to the availability of the professor. Exams are
purely essay (problem-solving, enumeration, definition, and objective questions) and
will measure the ability of the student to apply the law with their logic and language.
Online exams are conducted through Examplify or other viable online platforms.
Cheating during exams will not be taken lightly. Any student caught cheating will
automatically be disqualified for that exam and will merit a score of zero (0). No
special exams will be given for those who failed to take their exams on the given
schedule.

4. MAKE-UP CLASSES: Should the time be insufficient to finish the course, the professor
reserves his right to conduct make-up classes on the schedule that is convenient to
the professor and the students.
