OBJECTIVE

EMPLOYEES’ COMPENSATION
COMMISSION (ECC)

• The ECC is a government corporation. It is attached


to the Department of Labor and Employment for
policy coordination and guidance.

• The ECC was created on November


1, 1974 by the virtue of PD 442 or
the Labor Code of the Philippines. It,
however, become fully operational
with the issuance of PD 626 which
took effect January 1, 1975.
ECC MAIN FUNCTION

• To formulate policies and guidelines for the improvement of


the employees’ compensation program;

• To review and decide on all EC appealed claims


disapproved by the Systems; and

• To initiate policies and programs


toward adequate occupational
health and safety and accident
prevention in the working
environment.

EMPLOYEES’ COMPENSATION
PROGRAM (ECP)

• The Employees’ Compensation Program (ECP) is a government


program (P.D. 626) designed to provide compensation package to public
and private employees and/or their dependents in the event of a work-
connected injury, sickness, disability or death.
EMPLOYEES’ COMPENSATION
COVERAGE

• Employees are covered under the Employees’


Compensation Program starting from the first day of
their employment.
PREMIUM CONTRIBUTION
COMPENSABLE CONTINGENCIES

Any work-connected INJURY


or SICKNESS, resulting to
DISABILITY or DEATH of a
covered employee is compensable
under the ECP.

1. Cancer of the epithelial lining of the bladder


2. Cancer, epithellomatous or ulceration of the skin or of the
corneal surface of the eye due to tar, pitch, bitumen, mineral
oil or paraffin, or any compound product or residue of any
these substances.
3. Cataract produced by exposure to the glare of, or rays from
molten glass or molten or red hot metal.
4. Occupational Hearing Loss
5. Decompression sickness
6. Dermatitis due to irritants and sensitizers
7. Infections
8. Ionizing radiation disease, inflammation, ulceration or
malignant disease of skin or subcutaneous tissues of the
bones or leukemia, or anemia of the aplastic type due to x-
rays, ionizing particle, radium or other radioactive substances.

• Guaranteed for life if disability remains until


death of the worker, but may be suspended
due to the following:

• Failure to present for examination


• Failure to submit quarterly medical report
• Complete or full recovery
• Upon being gainfully employed

CASH ASSISTANCE
CARER’S ALLOWANCE

• Granted to employee who got permanently


and totally disabled and has difficulty taking
care of basic personal needs.

• Php 575/month allowance for both private


and public sector employees.
REHABILITATION SERVICES
ECC QUICK RESPONSE PROGRAM

• Provides immediate assistance to workers


who suffer from work-connected
contingencies, or to their families who have
to deal with work accidents or sudden onset
of occupational disease or death.

• This is in the form of psychosocial


counselling and assistance in the filing of
EC claim with the GSIS or the SSS.
BENEFICIARIES

• The beneficiaries of the covered


member.

• The beneficiaries shall be either


primary or secondary, and determined
at the time of employee’s death.

PRESCRIPTIVE PERIOD
AVAILING OF ECP BENEFITS

EC claims must be filed within a period of three


years.

• In case of sickness - from the last confinement, in


case of multiple confinements due to the same
illness, or from the last time the employee was
unable to report for work due to illness, whichever
is applicable;
• In case of injury, from the time of the incident;
• In case of death, from the date of death.
WHO MAY FILE THE CLAIM?

• The employee or any member of


his/her family can file for the EC
benefits claim with the GSIS/SSS.

• The employer may assist the employee


or his/her family in filing the claim.
EC LOGBOOK

• Entries in the logbook shall be made within 5 days from notice or


knowledge of the contingency.
• Within 5 days after entry in the logbook, the employer shall report to the
System only those contingencies he deems to be work-connected.

• The ECP is enjoyed only by those with Employee-


Employer relationship.

• ECP coverage/entitlement to benefits begin on the first day


of employment.

• ECP benefits are in addition to SSS and PhilHealth


benefits.

• The ECP benefits are welcome but it is better to be safe


than injured or ill because of work.
