A RESOLUTION ESTABLISHING THE BIDS AND AWARDS COMMITTEE (BAC)


AND BAC SECRETARIAT OF SANGUNIANG KABATAAN OF BARANGAY IBERICA
LABO, CAMARINES NORTE

WHEREAS, Republic Act No. 9184, otherwise known as Government Procurement Reform Act,
provides for the modernization, standardization and regulation of the procurement activities of the
government.

WHEREAS, all the procurement of the National Government, its department, bureaus, offices
and agencies, including states universities and colleges, government owned and/ or controlled
corporations, government financial institution and LOCAL GOVERNMENT UNIT, shall in all
cases be governed by this act;

WHEREAS, Section 209(b) of RA No. 10742 states that the SK shall have financial
independence in its operation, disbursement, and encashment of their fund, income and
expenditures;

WHEREAS, Section 5 of JMC No. 1, s. 2019 states that the SK funds should be utilized strictly
in accordance with applicable budgeting, accounting, and auditing rules and regulations and the
provision of RA No. 9184 and other pertinent laws.

WHEREAS, this is in line with the government’s commitment to good performance and its effect
to adhere to the principle of transparency, accountability, equity, efficiency and economy in its
procurement process.

WHEREAS, procurement under RA No. 9184 shall apply to procurement of infrastructure


projects, goods and consulting services;
WHEREAS, Government Procurement Policy Board issued a Resolution No. 15 2019, titled
“APPROVAL OF THE ISSUANCE OF A CIRCULAR ON SANGUANIANG KABATAAN
(SK) PROCUREMENT” GOVERNMENT PROCUREMENT POLICY BOARD, by virtue of
the powers vested on US, by the law and other executive issuances, hereby RESOLVE, to confirm
adopt, and approved, as WE hereby confirm, adopt and approved the issuance of a Circular
providing that the SK, as a procuring entity, should create a BAC in accordance with the
composition and qualification under RA No. 9184 and its IRR.

WHEREAS, the Bids and Awards Committee (BAC) shall established in accordance with Article
V of Republic Act No. 9184 with the following functions.

1. The BAC shall responsible for ensuring that the Sanguniang Kabataan of Barangay Iberica
Labo, Camarines Norte abides the standard set forth by the Act, and its implementing rules
and regulations –A9(IRR-A);
2. Advertisements and/or posts the invitation to bid;
3. Conducts Pre-procure and Pre-bid Conference;
4. Determine the eligibility of prospective bidders;
5. Receives bids;
6. Conducts evaluation of bids;
7. Undertake post-qualification proceeding;
8. Resolved motions for reconsiderations;
9. Recommends awards of contracts to the SK Chairperson shall be the head of the Procuring
Entity (HOPE) or his/her duly authorized representatives.
10. Recommend the imposition of sanctions in accordance with Article XXIII of the Act;
11. Create a Technical Working Groups from the pool of technical, financial and legal experts
to assist in the procurement;
12. Performs such other function and duties authorized under this Act and its IRR-A and
subsequent enactment/guidelines.

WHEREAS, the BIDS and AWARDS COMMITTEE is hereby and composed by the following:

NOW THEREFORE, upon the motion of SK Kgd Joselito Gache and duly seconded by SK Kgd
Jericho M. Sayno so be it.

RESOLVED AS IT, is hereby resolved to ORGANIZE THE BIDS AND AWARDS


COMMITTEE (BAC) AND BAC SECRETARIAT OF SANGUNIANG KABATAAN OF
BARANGAY IBERICA LABO, CAMARINES NORTE.

RESOLVED FURTHER, to furnish copies of this resolution to concerned offices for their
information.
