This manual has been prepared by the. Conditions of Service Division o f the Personnel
Department with the objective o f assisting personnel officers in the Civil Service and in Statutory
Authorities subject to the Statutory Authorities Act, Chapter 24:01, in the administration and
application of rules, regulations and circular instructions relating to the terms and conditions of
employment o f monthly-paid officers.
The manual embodies those rulings, guidelines, interpretations and clarifications most
frequently sought o f the Conditions o f Service Division in respect of the subject areas listed in
the Contents and includes references to relevant authorities. The opportunity has also been taken
to summarize the conditions under which the principal allowances/benefits/facilities are applicable.
Circulars/Circular Memoranda mentioned in the manual are reproduced for ease o f reference
at Sections II and III herein. It is, o f course, essential that this manual be read in conjunction with
the relevant provisions o f the Civil Service Regulations, Chapter 23:01, the Public Service
Commission Regulations, Chapter 1:01 or the Travelling Allowances Regulations, Chapter
23:50, as may be appropriate.

is necessary should be referred to the Chief Personnel Officer for attention.

time off of half an hour during which time he/she
may leave the premises immediately after the end of
the normal work day which period shall be counted
as actual overtime hours worked. :
E. Payment of overtime when called out to work
With effect from January 1, 1977, where an officer is PD Circular No. 4 dated
not on duty and he is called out to work (whether or June 2,1978
not on call) he shall be guaranteed a minimum of two
(2) hours pay at overtime rates including “ travelling
time” and the cost of travelling to and from work.
F. Payment of overtime to Messengers
'Messengers qualify for payment of overtime in PD Circular No. 3 dated
respect of all work performed after the expiration of June 20,1975
their normal work day i.e., after eight (8) hours
per day.
G. Compensation to officers who are required to work through
their lunch hour
With effect from January 1, 1980, officers who are PD Circular No. 4 dated
required and authorised to work through • their June 5,1984

(iiJ be granted a twenty (20) minutes break for the
purpose of having a meal which period shall be
counted in the total number of hours per day which

the usual form of compensation applicable to the
particular category of officer — in respect of any
hours worked in excess of the normal hours fixed for
that day; , .

An officer becomes eligible for annual (vacation) leave
only after completing twelve ( 12) months continuous
service. The quantum of annual (vacation) leave is based
on his salary and length of service as follows: —

B. Training
T h e D e p a r t m e n t reflects the provisions in the Acts a b o v e m e n t i o n e d u n d e r whi ch
r egulations may be made by the Go ve rnor-Gener al for certain m at t e r s af fec ti ng t he Public
Service and include “ prescribing ar ra ng e me n ts and proc edu re s for providing, assisting in
or co- ordi nat ing s taff d e v e l o p m e n t p r o g r a m m e s ” . This will be involved in: —
(a) the overall training in the Public Service whi ch is an integral p ar t o f the p e r s on ne l
m a n a g e m e n t functi on;
(b) c o n s t a n t liaison a nd discussions with the Service C om mi s si ons D e p a r t m e n t in
c o n n e c t i o n with overall training in the Public Service with special r eference to the
placing o f r e t ur n in g scholars. ■

1 wish to inform you that it has been decided/that the following- terms arid cohditions o f
em ployment shall apply to full time monthly paid officers in the Civil Service and to full time
monthly paid officers in the service o f Statutory Authorities. Subject to the Statutory Authorities
Act, Chapter 24:01, with effect from the respective dates specified hereunder.
(b) With e f f e c t f r o m January 1, 1981, the rate o f Shift Bonus payable in accordance
with (a) above shall be increased from $4.86 to S6;00 per shift or part'thereof,
- : ' where a part of the shift falls within the hours prescribed at (a) (ii), above.
(c) With e f f e c t f r o m July, 1 9 8 3 , a Shift Bonus o f $6.00 per shift shall be paid to an
officer who is required to work a “ Split Shift” . For the purpose o f implementation
..... o f this provision, the term “ Split Shift!’ shall be defined to m ean “ an arrangement
in which the working day is not continuous, but.,is,split, in.. two or more-working:
periods with a time interval of not less than two (2) hours in betw een” .
Accordingly, such working periods in one working day shall be treated as a single
shift.
V. Subsistence Allowance
........... With ef f e c t f r o m O c t o b e r 1, 1 9 8 2 , a single rate o f Subsistence Allowance o f 339.00-per
day shall be payable to all eligible officers; subject to the existmg:x:onditi6nsrgoyerning
the payment of a subsistence allowance as provided in the Travelling Allowances
Regulations, Chapter 23:50.
VI. Meal Allowance to Officers Who, While Qff:Duty, are Called Out to W o r k ..... ....
With e f f e c t f r o m Ju l y 1, 1 9 8 3 , an officer* while;: off-duty, is called out to work,;:shall
qualify for a Meal Allowance, should the officer be required to w ork through any of
. the following meal period:
(a) 6.00 a.m. to 8.00 a.m.
(b) 11.00 a.m. to 1.00 p.m. - i
: (c) 6.00 p.m. to 8.00 p.m. .

are required to work through their lunch hour shall be compensated as follows: —
(i) Payment o f an overtime allowance at premium rates (i.e. time and one half the officer’s

(ii) the officer shall be granted a twenty minute break for the purpose o f haying..a meal,

2. It is to be pointed out that before compensation in the terms set out at pargaraph 1 (i) — (iii)

to work on a Public Holiday, they shall be granted an additional day-off in lieu o f the Public

3. The compensatory leave referred to in paragraph 2 above should normally be granted at the

the officer concerned, say, within five (5) weeks after the end o f the m onth iivwhich the Public
Holiday fell or, with the concurrence o f the officer concerned, may be added to his annual vaca
tion leave eligibility and taken when next he proceeds on such leave.
4. It is to be; pointed out that the aforementioned provisions are n ot applicable to those Estate

It has been drawn to my attention that certain Ministries, Departments and Statutory
Authorities Subject to the Statutory Authorities Act, Chapter 24:01, are unclear as to the proper
application o f the provisions o f Personnel Department Circular No. 4 o f 1984 dated J une 5, 1984
on the subject mentioned above. .
(a) the provisons of Personnel Department Circular No. 4 o f 1984 apply only to officers
whose daily hours o f duty permit o f a lunch hour. In that regard, it:is-to be emphasized::
that the number of hours which an officer is required to work daily does n o t include
the lunch hour. Thus, in determining the number o f hours worked daily by an officer,
there should be deducted therefrom the lunch hour of such officer. Accordingly, the
hours o f work o f officers (such as those o f the Technical and Manipulative Classes),
who are conditioned to a 40 hour work week, that is, 8 hours per day over 5 days,
should extend from say, 7.00 a.m. to 4.00 p.m. or 8.00 a.m. to 5.00 p.m. with one
hour being allowed for lunch between the hours o f 11.00 a.m. and 1.00 p.m. , -
(b) the daily hours o f duty o f officers who work on a shift basis (e.g. Air Traffic Controllers,
Estate Policemen, Health Institution Personnel) do not include a lunch/meal hour.
However, such officers are allowed a twenty (20) minute break for the purpose o f
having a meal. Accordingly, sUch officers are not covered by the terms o f Personnel
Department Circular No. 4 o f 1984; and
(c) notwithstanding that an officer has worked through his/her lunch hour, such officer
is yet required to continue working to the end o f his/her normal daily w ork day. Thus,
an officer whose daily hours o f duty are from 7.00 a.m. — 4.00 p.m. b u t has been
required and authorised to work through his/her lunch hour, is required to work, in the
normal manner, up to 4.00 p.m. that day. Should the officer be required and authorised
to work b e y o n d his/her normal work day (i.e. after 4.00 p.m. in the instant case) he/she
then falls to be compensated in accordance with the provisions o f paragraph 1 (iii) o f
Personnel Department Circular No. 4 of 1984.

From time to time, it has been represented to che Personnel Department that situations have
occurred where, on applying for annual leave, officers have been advised verbally that they cannot
be granted such leave owing Co che exigencies of che Service and chat, as a result, the leave will be
deferred. In other cases, the officer might postpone submitcing an applicacion for annual leave on
the presumption that the leave will not be granted owing to ciie exigencies of the Service. -
2. I wish to invite your attention to regulations 75, 77, 78 and 82 o f the Civil Service Regulations,
Chapter 23:01, o f the Laws o f the Republic of Trinidad and Tobago, as follows:-
' “ 75. An officer who owing to the exigencies of the service is required to defer
his annual leave, shall, in the year following, that in respect o f which his
annual leave was deferred, be granted such deferred leave together with
the annual leave for that year. .... '■
71. Subject to regulation 78, annual leave, once-earned, shall not be forfeited..

4. Also, the provisions o f the regulations referred to at paragraph 2 above hinge on the application
tor the leave and the reply thereto being made in writing. It would be invidious, therefore, for
management or employee to consider that conduct in the m anner referred to at paragraph 1 above
is acceptable to satisfy the provisions relating..to the deferm ent: o f annual leave or to the
accum ulation o f annual leave beyond the normal maximum. It is in tu in b e n t on the'-officer?>'i6 ’;

request. In the event that annual leave is being deferred in accordance with regulation 75 owing to

extension o f sick leave, the officer may be given the option of having the period provisionally offset
against his earned annual (vacation) leave while his application is being determined by the Personnel
Department.
2.. It has been brought to my attention that in many instances, such officers who are absent from
duty are paid salary b e y o n d the period of annual (vacation) leave which they have to their credit.
Overpayments therefore arise when the absences are subsequently classified as being periods with
out pay or with partial pay. ■ .....
4. Thus, where the amount o f earned annual (vacation);leave mortgaged has-beenexhausted; ors
where the officer chooses not to have his earned annual (vacation) leave provisionally credited
against his absence from duty on account of illness, the absence falls to be treated as being a period
without pay pending the determination o f the application by the Personnel Department.
5. I take the opportunity to emphasize that the prompt submission of applications for extensions
of sick leave, with the information necessary for their processing, would reduce to the barest
minimum the necessity for the provisional offsetting of. periods o f absence due to illness against an
officer’s earned annual (vacation) leave.
6. Kindly ensure that this Circular Memorandum is widely circulated and that appropriate
administrative arrangements are instituted to eliminate overpayments o f the kind referred to at

ance to all categories o f Government Pensioners, with effect from 1st January, 1974.
2. The allowance payable from time to time will be determ ined in accordance with the procedure
set out in Minister o f Finance Circular No. 10 o f 1975 dated 14th November, 1975, (see excerpts

3. Your attention is drawn to paragraph 1 o f the above-m entioned circular wherein provision is-
made for the paym ent o f a Cost o f Living Allowance to re-employed pensioners. As eacli person
is entitled to the receipt o f only one allowance m onthly, you are advised th at as from 1st July,
1976, the Cost o f Living Allowance will be paid...on.:.the-^monthly,. pension .:of- a re-em ployed
pensioner instead o f on his m onthly salary. Consequently, Accounting Officers should take' the
necessary steps to ensure that the Cost o f Living Allowance is not paid by them to re-em ployed

from the 1st January, 1974. The list should show name, position, date o f re-em ploym ent, date o f
term ination, and other relevant particulars.

School for Girls, etc.
(i) all officers who, on or after 1st January, 1977, held perm anent appointm ents and who
continue to hold such appointm ents in fu ll-tim e m onthly—paid posts in the Service,.-.
Boards and Bodies, m entioned in paragraph.4 above;
; ' (ii) persons who, on or after 1st January, 1977 were holding appointm ents (w hether

or posts covered by the Agreem ent” but have since resigned or have retired with or
w ithout pensions or other superannuation benefits;

7. New Salary Scales have been drawn up reflecting the increases m entioned in paragraph 3 above
for the years 1977, 1978, 1979 and 1980. The attached Schedule shows the salary scales for 1976
in the 1974 to 1976 Compensation Plans (hereinafter called the “old salary scales” ) and the salary
scales being introduced from 1st January, 1977 (hereinafter called the “new salary scales”).
8.— The salary o f an officer-shall generally be assimilated to the new salary scales on a
point—to —point basis. That is to say, an officer whose basic, salary is at any point in the old salary
scales shall convert to the corresponding point in the new salary scales. To find the corresponding
point the old and new salary scales should be set out in horizontal columns with the minimurn o f
the old salary scales above the minimum o f the same vertical lines.

10. An officer who has been acting in a post which is higher, than his substantive post shall be
treated as though he was tem porarily prom oted to that post.
11. Paysheets for arrears o f salary should be prepared immediately for the period 1 st January,
1977 to 3.1st August, 1977. In order to- determine the gross am ount o f arrears of- salary payable.to
an officer his basic salary should be assimilated to the new salary scales in the m anner described in
paragraph 8 above and the total salary and Cost o f Living Allowance already drawn by the officer
must be deducted from the gross am ount payable to him for the period, on the basis o f his new
salary. All .officers should be.paid a. new. Cost o f Living Allowance: of' S6.00-per m onth w ith effect
from the m onth o f May, 1977 (that is from May to August, 1977) on the basis;d f the rise iifi the
rebased Index o f Retail Prices since 31st December, 1976. Further changes in the Cost o f Living
Allowance will be notified by publication in the Trinidad and Tobago G azette over the hand o f the
Chief Personnel Officer.

steps to-have their Personal Em olum ents Votes supplem ented as soon as their deficits are known.
13. Perm anent Secretaries and Heads o f Departm ents should also ensure th at the prescribed
procedures for obtaining grants o f credit on the Exchequer are followed.
14. C ontributions to the Widows’ and O rphans’ Pension Fund shall be payable in accordance with
the new rates o f pay with effect from 1st January, 1977. 7
Income Tax
15. Income Tax should be deducted from the arrears o f salary on the basis o f the new rates o f pay
with effect from 1st January, 1977.
16. Such am ounts as have already been deducted through P.A.Y.E. on the basis o f the old salary
scales should be subtracted from the P.A.Y.E. calculations that m ust be made o n the'basis o f the
new salary scales for the period 1st January, 1977 to 31st August, 1977 and the differences
deducted from the arrears o f salary o f each officer. In following this procedure, the incom e tax
tables should be consulted.

I wish to inform you that following upon negotiations with the appropriate recognised
associations representative o f employees in the Public Service, Governm ent has agreed to general
increases in pay, in respect o f the period January 1, 1981 to Decem ber 31, 1983, to. all full-time
m onthly-paid officers represented by these Associations. G overnm ent has also agreed th at the
Cost-of-Living Allowance o f $114.00 per rriohtli paid to the said full-time m onthly-paid officers
as at December 31, 1980 should be consolidated with basic salary as at December 31, 1980 before
the application o f the general increases from January 1, 1981. . ,
2. Governm ent has agreed, further, to the paym ent, with effect from January 1, 1981, o f a
new Cost-of-Living Allowance based on a revised formula o f $5.20 per m onth for each two (2)

4. For the purpose o f determ ining the Cost o f Living Allowance-payable, Accounting Officers
are requested to note that the term “ basic pay” rneans: —
(a) in respect o f Hourly, Daily and Weekly rated employees, “ Full p ay ” , which is defined
in the M emorandum o f Agreement as follows; —

5. Table A relates to m onthly paid employees and shows the adjusted m onthly Cost o f Living
Allowance payable to eligible employees at each point in the relevant salary scale. For example, an !
employee who is at the point o f $1,440 per m onth in Salary Range 7, is eligible for an adjusted
monthly Cost o f Living Allowance of $107.49.

1. The Governm ent shall employ the person engaged and the person engaged shall
act in all respects according to the instructions or directions given by the Governm ent
through the Head o f M inistry/D epartm ent or other duly authorised officers. In this Agreem ent

rent plus a further charge for any furniture, electrical appliances and
equipm ent supplied in accordance w ith the rates specified in the

Ill-health 4. (a) I f the person engaged shall be com pelled b y reaso n o f ill-health (n o t

is incapable by reason o f bodily or m en tal in firm ity o f re n d erin g fu rth e r efficien t
service in the C o u n try , the G overnm ent shall pay him his salary up to th e d ate o f
such resignation or c e rtificatio n . .
Wrongful 7. In event o f the determ ination ot the engagement by the person engaged at any
Termination time prior to the expiration of three months from the com m encem ent o f the term
of Concract of the engagement for any reason other than ill-health o f the person engaged or o f
its determ ination by the person engaged after the said period o f three months

as liquidated damages.
Liability to 8. In the event o f any pecuniary damage arising from the person engaged

damage from any neglect of duty whatsoever on his part he may be liable to a deduction
in his salary to make good the damage or any part thereof the am ount o f which
damage shall be fixed by the Government.
Leave of 9. The person engaged shall be eligible for casual absences from duty, sick and
Absence vacation leave at the rates for the time being in force.
Standing 10. The person engaged shall be'subject, co che General or Standing .O rders.of the

Gratuity 11. On the satisfactory com pletion of the term o f em ploym ent, or if the employ-
,f. ment is, term inated by the State other than for cause o f unsatisfactory performance
by the person engaged, or if the person engaged dies during the period o f employ^
m ent but his work and conduct had been satisfactory, the person engaged (or his
. lega.1 personal representative) shall be paid a gratuity'equivalent -to: twenty,.percent.
(20%) o f gross salary earned over the period of em ploym ent. Such gratuity shall be
liable to deductions for tax purposes.
