THE STUDY OF THE IMPLEMENTATION OF RA 11058 IN SELECTED MAJOR
FAST-FOOD CHAINS AND CASUAL DINING RESTAURANTS IN QUEZON CITY
Ocampo, M. M., 2019
The study mainly focused on the implementation of RA 11058 (an act strengthening compliance
with occupational safety and health standards and providing penalties for violations thereof) in the
selected fast food chains and casual dining restaurants located in Quezon City. The author briefly
discussed the importance of knowing OHS law and standards. As what is stated in the study, its purpose
is to assess the perception, knowledge, and practices on occupational safety and health of food
industries, particularly fast food industries, in a democratic and developing nation, particularly the
Philippines and assess the employee’s satisfaction regarding the company's compliance in OHS law and
standards. It also aims to promote awareness The study was conducted due to the researcher’s or the
author's observation that OHS law and the standard were not being applied to some industries like the
food industry, specifically fast food chains rather it is being implemented mostly in the construction and
production industry.
The questions given in the research problem are; (1) What is the essence of occupational safety
and health in general?, (2) What is its essence in the case of food industries, and to what extent?, (3)
How knowledgeable and compliant are the employees and managers of these selected foodservice
companies and establishments, particularly fast-food chains, to the OSH Standards?. The author used
questions that the study aims to answer and is related to the topic. The study was done by interviewing
and analyzing the employees and employers in selected fast-food chains and casual-style dining located
in Quezon City. Thus, its findings were based on the information gathered and analyzed for clearer
interpretation and understanding of the result.
The author used a qualitative method in collecting data which is appropriate for the study as it
needs to know the perceptions and knowledge of the employees and employers about the application
of OHS Law and standards to the company they work for and do a thorough interview with their
respondents. The author/s chose a specific location where they could easily gather the information they
need in the study. Thus, the gathering of the data was done accordingly.
Based on the data gathered by the author, (though it was done a bit hard for the researcher to
collect the answers from the respondents due to lack of cooperation) it was found that employees or
crews from the fast-food chains were not knowledgeable in terms of the implementation of the RA
11058 within the said workplace because according to them or from the researchers’ observation, the
said nature of work is nonhazardous. On the other hand, casual dining restaurants follow OHS laws and
standards that keep the employees and management safe from any hazardous events that could happen
if the employees were not working safely or accidents occurred unexpectedly. The findings answered
what the author concluded in the first place that crews from the fast-food chains don’t have enough
knowledge about health and safety practices in the workplace. Also, it was found that injuries occurred
in some workplaces, based on the findings of the researcher.
The researcher learned that most of the companies that usually apply or implement health and
safety practices and related laws were the constructions and productions industry. Hence, fast-food
chains have lack health and safety measures within the workplace. OHS law and standard is very helpful
to be implemented in all companies because it doesn’t only lessen the occurrence of accidents it can
also save someone’s life from danger. It can also save money and can avoid damage to equipment and
tools in the working area. Thus, it is likely to be implemented in all types of industries and workplaces.
