EMBARKING ON FORENSIC EXPLORATION

The Team Il assignment of The Code of Criminal Procedure , which consists of eight students—
Sumith KR , Kartik Menon, Pallavi Choudhary, Shloka Bansal , Tanmay Choudhary ,Andri
Pandey, Vaishnavi H , Rishika Singh .—was given the aforementioned academic exercise, on
CRPC, on May 8, 2024. The visit took place between 10:00 am to 5:00 pm. We were assigned
the station at Vijaynagar, Bengaluru. The following was the suggested goal for the
aforementioned field tour and reporting:
The objective of the field tour was threefold:
● to gain an understanding of the workings and organization of a police station;
● to learn about the duties performed by police officers in that setting.
● to learn about the actual application of criminal laws, with a particular emphasis on their
interaction with the forensic procedure.

Observation: Taking note of the various departments (investigations, patrol, administration,


etc.) and their interactions, as well as the physical configuration and arrangement of the police
station.
Interviews: Getting to know police personnel and officers to learn about their daily
responsibilities, the procedures they follow with regard to forensic procedure , the difficulties
they encounter, and how they interpret and apply the rule regarding the same.
Research and Study: Examining the different criminal law provisions and then observing how
they are really implemented in a police station scenario.
Documentation: Making notes, keeping track of observations, and maybe compiling data into
reports or analysis.

Vijay Nagar Police Station.

Vijay Nagar is a residential neighborhood in west Bangalore, India. It derives its name from the
Vijayanagara empire that flourished in South India during the 15th and 16th centuries. It is
bound by Mysore Road and Magadi Road, with Chord Road cutting through. It is the
northernmost area in South Bangalore. Additionally, the sustained development and evolution of
Vijay nagar have played a pivotal role in shaping the cityscape of Bangalore, making it a focal
point for both historical significance and contemporary urban life.

The locality Vijaya Nagar falls in Bengaluru Urban district situated in Karnataka state, with a
population 198091. The male and female populations are 104540 and 93551 respectively. The
size of the area is about 7.03 square kilometer.

OBSERVATIONS

During our exploration of the forensic facilities at the Vijaynagar Police Station, we embarked
on a journey through the intricate landscape of forensic analysis, where every piece of equipment
holds the potential to uncover truth and justice. As we observed the evidence collection
procedure, we were struck by the meticulousness of the process overseen by appointed
individuals known as Mazar. Their role in video recording the crime scene ensures accurate
documentation of evidence, laying the foundation for a thorough forensic examination.
Additionally, witnesses, known as Panchnama, provided valuable insights into the crime scene,
corroborating the findings and adding credibility to the evidence collection process.

Furthermore, our discussions with the station's officers and experts shed light on the submission
process to the Forensic Science Laboratory (FSL) Headquarters in Bangalore. We learned that
once the First Information Report (FIR) is filed including Invest Panchnama and the collected
evidence is promptly sent to the FSL for further examination. However, we were surprised to
discover that this process can take a minimum of 3 months due to the meticulous nature of
forensic analysis.

Our journey through the forensic laboratory underscored the commitment of the Vijaynagar
Police Station to ensuring thorough and effective investigations. Each piece of equipment and
every procedure carried out within the laboratory represents a crucial step in the quest for justice.
As we reflect on our observations, we recognize the significance of forensic procedures in the
intricate web of criminal justice, where attention to detail and adherence to protocol are
paramount. This immersive experience has deepened our appreciation for the crucial role played
by forensic science in unraveling the mysteries of crime and upholding the principles of justice.

The process outlined reflects a systematic approach to evidence collection and legal procedures
in forensic investigations:
UNRAVELING FORENSIC MYSTERIES

● FSL Headquarters Jurisdiction: Understanding that FSL Headquarters in Bangalore caters


to cases from both Bangalore and Tumkur districts, especially for serious crimes like rape
and murder, indicates a centralized processing system for such cases.
● Evidence Collection Procedure:At Vijaynagar police station there are no specific forensic
experts who accompany them for the purpose of collecting evidence. The team of four
police officers including a police inspector proceeds towards the crime scene, they
protect it by securing the premises with yellow tape and barricades. They investigate as
they are in search for evidences, whenever they find any evidence they themselves collect
it, they make sure they are complying with every procedures in order to prevent
evidences from getting manipulated, likely, they wore gloves so that fingerprints are not
tempered, evidences are kept in plastic bags covered it with white cloth and imprint their
thumb impression and then send it to FSL. The pointers stated below expand the process
mentioned above :
❖ Mazar: The above procedure is recorded by the Individuals appointed by the
police team for the purpose of video recording evidence, ensuring a documented
visual record of the crime scene.
❖ Panchnama: Two Witnesses present during the crime scene investigation,
providing legal validation and documentation of the scene.
❖ Invest Panchnama: Further the witnesses are required to give a thumb impression
and signature in the documentation and investigation procedures carried out at
the crime scene .
❖ Submission to FSL: All collected evidence and documentation are sent to the FSL
for thorough examination, a process that typically takes a minimum of three
months but in rape cases the Hon’ble Supreme Court in one of the landmark
judgement stated that the investigation should be completed within three months
when this information provided to the police inspector, he mentioned that in these
circumstances they submit first chargesheet within 90 days and request FSL to
give results as soon as possible and then they file second chargesheet along with
FSL report. There is no limitation period for the second charge sheet.
● Legal Procedures:

❖ Chargesheet Filing: If the FSL reports are not submitted at the time of filing the
first chargesheet, a second charge sheet may be filed. Unlike the first chargesheet,
there's no limitation on how long the accused can be kept in custody if a second
chargesheet is filed. However, failure to submit the second chargesheet to the
court may lead to the accused being released on bail under Section 173(8). The
FSL report is not only the sole criteria for conviction but merely a supporting
document that favours the conviction.
● Hierarchy of Police Department:

❖ Director General (State): Top-level authority overseeing the entire state police
force.
❖ District Heads: Supervising police operations within their respective districts.
❖ Superintendent of Police: In charge of law enforcement at the district level.
❖ Inspector: Responsible for leading investigations and supervising subordinates.
❖ Sub Inspector: Involved in the day-to-day tasks of law enforcement, with a range
of personnel reporting to them.

● Arrest Procedure:
Following the 11 Points of DK Badu ensures a comprehensive and lawful approach to making
arrests, which likely includes steps such as informing the accused of their rights, ensuring the
presence of witnesses, and adhering to proper documentation procedures.
This detailed explanation outlines the various steps involved in evidence collection, legal
procedures, and the hierarchical structure within the police department, ensuring a systematic
approach to forensic investigations and law enforcement.
CONCLUSION

Our visit to the Vijaynagar Police Station has provided valuable insights into the forensic
procedures employed within its jurisdiction. Located strategically within the bustling Vijaynagar
area, the station serves as a vital hub in the fight against crime.

Through our exploration of the station's jurisdictional landscape, we gained a deeper


understanding of the diverse demographics and criminal challenges faced by law enforcement
officers. This knowledge underscores the importance of tailored forensic strategies to address
specific community needs effectively.

Our interactions with the station's personnel, coupled with observations within the forensic
laboratory, highlighted the dedication and professionalism of those involved in the investigative
process. From evidence collection to analysis, each step is conducted with precision and
attention to detail.

As we depart the Vijaynagar Police Station, we carry with us not only a wealth of knowledge but
also a renewed sense of purpose. Our experience underscores the critical role of forensic
procedures in the pursuit of justice and underscores the need for ongoing collaboration between
law enforcement and forensic experts.

Looking ahead, we remain committed to applying the lessons learned from our visit to contribute
positively to the field of forensic science and support the efforts of law enforcement agencies in
ensuring public safety and upholding the rule of law.
