AFFIDAVIT

I, Sri Ashwin Rathod, aged about 53 years, s/o Sri Chaganlal Rathod,
residing at No.58,1st Main Road, Sheshadripuram, Bengaluru-560020, do
hereby solemnly affirm and state on oath as follows:
1. I submit that I am the Petitioner herein and that I am fully aware of the
facts of the case herein.

2. I submit that I had filed the above case for setting aside the order dated
08-12-2022 passed by the Assistant Commisioner, Bengaluru North Sub-
Division, Bengaluru in RA(BE) 66/2021.

3. I submit that on the previous date of hearing on 02-02-2024 this Hon’ble


Court has not extended the interim order. I submit that I am the
absolute owner of the suit schedule properties vide registered Sale
Deeds. I submit that the said lands are Residentially converted lands
and I also have BBMP “A” Katha for the said lands.
4. I submit that I have already filed an advance application on 5-2-2024
which was allowed and the case was advanced to 6-2-2024. I submit
that on 6-2-2024 as there was no sitting, I am filing this advance
application.
3. I submit that I want to file the application to advance the above case
from 17-02-2024 to -02-2024. Hence I am filing this advance
application in order to file an application to continue the interim order
in the interest of justice and equity.

4. I submit that, No-Prejudice or hardship will be caused to the


respondents if the accompanying application is allowed. On the
contrary irreparable loss and injury will be caused to me if the said
application were to be rejected.

WHEREFORE, it is prayed that, this Hon’ble court may be pleased to


allow the accompanying application as prayed for, in the ends of Justice
and equity and in the interest of both the parties herein.
