Good Morning everyone,


Myself Kiran Choonawala. I am the Head of the Talent Team at Black
Spot Studios. You may refer to me as Kiran.
At the outset, I would like to thank both the Mediators for agreeing to
oversee today’s session and thoroughly explaining the mediation
process. I believe that mediation provides us with a platform to
communicate with ease and bring an end to the issues at hand.
I am also grateful to Mr. Charlie Pressly for responding positively to
our request for this mediation session, this signifies the willingness of
both the parties to reach an amicable solution to resolve the present
issues.
I believe that this session will guide us in the correct direction in order
to set aside our differences and continue our venture together with the
same synergy as before. As explained by the mediators, we need to be
as transparent and open with each other as possible.
I would like to begin by explaining the situation as it stands from my
company’s perspective, Mr. Pressly is a widely popular singer, who
was recently accused and found guilty under the Domestic Violence
Act by the competent courts in the country. Due to such conviction he
drew a lot of criticism and scrutiny. Therefore the studio also drew
some criticism, due to which we had to postpone the release of Mr.
Pressly’s albums and suspend the promotion of any of his albums, and
cancel all of his live shows, in order to ensure that due to the fact that
he has been convicted and being the public lime light his artistic
works doesn’t draw the same criticism. This was a strategic decision
taken by my company in order to protect our investment, and not that
we didn’t have faith in him, which is evident from the very fact that
instead of parting ways we opted for merely postponing the release.
As per our analysts we planned to release the upcoming album and
resume the live shows and promotions as soon as the news of Mr.
Pressly’s conviction was out of public light.
We understand that our decision to halt the promotion and postpone
the release came out as lack of trust for Mr. Pressly, but it was a
strategic decision taking into consideration commercial viability. I
apologise that we could’ve expressly communicated the same with
Mr. Pressly in order to ensure clarity. We decided to release the
albums and resume promotions of his albums after Mr. Presly was
adjudged innocent by the Court of Appeals, but his termination letter
came as a shocker for us, considering the synergy we shared.
Nevertheless, I have come to this session with an open mind, and
would welcome a solution that allows both of us to feel that we are
fairly treated. I look forward to a fruitful and productive mediation
session, and leave the floor for my counsel, Mr. Rachit.

Offers-

2. We are willing to offer reduced prices for our services for a
period of 3 months so that FlyEZ can recover from its current
financial crisis.
3. We are willing to extend our offer in allowing FlyEz to delay
their future payments for a period of 2 months, they will be
exempted from the payment for this period owing to their
current inability to muster funds. After this period they can pay
the prices regularly along with the accrued amount.
4. Since we are unable ton reach any consensus on any offer
extended by us, I m willing to go out of my way and sign a
sperate contract under which the IP would lie with us and we
would provide the services to you under a new contract.
