RECOMMENDATION:
That the Council adopt Resolution No. 2024-48, Approving City Manager’s Determination of
Emergency at the Sanger Domestic Wastewater Treatment Facility and the Industrial Wastewater
Treatment Facility and Authorizing the City Manager to Make Required Emergency Repairs on Those
Facilities Without Competitive Bidding in accordance with Sanger Code Section 2-214(d) and the Public
Contract Code.
EXECUTIVE SUMMARY:
Based on reports from the Central Valley Waterboard regarding violations at the City’s Industrial
Wastewater Treatment Facility, action necessary by the City to address those violations, and as more
particularly set forth below, the City Manager has made a Determination of Emergency at the Wastewater
Facilities. The proposed resolution approves the Determination of Emergency and authorizes procurement
of equipment and services without competitive bidding. Reports on actions taken and status of the
emergency will be made at each regular meeting of the City Council.

BACKGROUND:
In accordance with Sanger City Code Section 2-214, this Staff Report serves as the City Manager’s
Determination of Emergency regarding the City of Sanger Wastewater Treatment Facility (WWTF) and the
Industrial Wastewater Treatment Facility (IWWTF). This detailed staff report sets forth the specific facts
establishing the emergency, why the emergency does not permit a delay resulting from a competitive
solicitation for bids, and why action is necessary to respond to the emergency.
As part of the compliance evaluation, Central Valley Water Board staff reviewed self-monitoring reports
for the period of October 2020 through December 2022 for the City of Sanger Wastewater Treatment
Facility (WWTF), and for the period of April 2020 through December 2022 for the Industrial Wastewater
Treatment Facility (IWWTF). A total of 65 violations were identified for the IWWTF, including
exceedances of effluent limits for BOD (Biochemical Oxygen Demand), TSS (Total Suspended Solids),
and total nitrogen. Additional violations were identified for late reports and deficient monitoring. A total of
51 violations were identified for the IWWTP for exceedances of EC, pH, and DO limits, and for late/missing
reports and deficient monitoring.
Since the state’s findings, the City has not kept up with scheduled maintenance which has rendered the
WWTP and IWTTP inefficient and out of compliance with the City’s Waste Discharge Requirements
(WDR’s):
• Waste Discharge Requirements (WDRs) Order R5-2014-0004 regulates the City's Domestic
Wastewater Treatment Facility.
• WDRs Order 98-131 regulates the City's lndustrial Wastewater Treatment Facility
The City Manager has made a Determination of Emergency at the Domestic and Industrial Wastewater
Facilities based on the foregoing and the following findings:
• The Domestic and Industrial Wastewater Treatment Plants are out of compliance with Waste
Discharge Requirements Orders R5-2014-0004 and Order 98-131.
• The digester cleaning was put out to bid but required maintenance on the digester will need to done
on Time and Material contracts.
• The Industrial Headworks is no longer separating material as designed and rebuild and epoxy
coating is needed.
• The domestic Headworks is no longer separating material as designed and rebuild and epoxy
coating is needed.
• Cross contamination issues are occurring after the thickening clarifier introducing industrial and
domestic discharge to be combined and going to domestic aeration ponds.
• The repairs necessary are described as follows: Digester repairs as needed after inspection and
boiler rehabilitation, repairs as needed to the industrial and domestic headworks including epoxy
coating to headworks, new line, concrete pit, valves and pump to correct cross contamination after
the thickening clarifier.

This Determination of Emergency and Council’s approval are necessary to allow the City Manager to
proceed with making certain immediate repairs without delay. This means that the formal competitive
requirements will not be followed.
Sanger City Code Section 2-214 provides for procurement without competitive bidding for emergency
purchases and contracts for supplies, materials, equipment, and services when the purchase is required for
health, safety, or welfare of the public, or for the protection of property if there is a present, immediate, and
existing emergency, and that such emergency procurements shall be made with such solicitation of
competitive pricing as practicable under the circumstances.
Sanger City Code Section 2-214 further provides: “The determination that an emergency exists shall be
made by the City Manager in writing, setting forth the specific facts establishing the emergency. This
delegated authority to the City Manager is in conformance with Public Contract Code Section 22050 (b);
These emergency repairs are critical to ensure the protection of health, safety, and welfare of City residents
and to protect the Wastewater Treatment Facilities.
FISCAL IMPACT:
The exact fiscal impact is not fully known at this time as the work is being performed on a Time and
Material basis due to the time sensitivity, but Staff will provide an updated budget for the project at an
upcoming Council meeting. We estimate $750,000 for the repairs noted above. The costs will be funded
from the Wastewater Enterprise funds.
ALTERNATIVES:
No recommended alternatives.
Per the Resolution, Staff will provide Council updates at each regular meeting and seek ratification of any
contracts at those.

RESOLUTION NO. 2024-48
WHEREAS, the City of Sanger operates the Sanger Domestic Wastewater Treatment
Facility and the Industrial Wastewater Treatment Facility (hereafter “Domestic and Industrial
Wastewater Facilities”; and
WHEREAS, the City Council has pursuant to Sanger City Code Section 2-214 delegated
its authority to the City Manager to order emergency work and proceed without plans,
specifications or notice for bids to award contracts governing the purchase of supplies, equipment,
and contractual services; and
WHEREAS, Sanger City Code Section 2-214 provides for procurement without
competitive bidding for emergency purchases and contracts for supplies, materials, equipment, and
services when the purchase is required for health, safety, or welfare of the public, or for the
protection of property if there is a present, immediate, and existing emergency, and that such

WHEREAS, in accordance with Sanger City Code Section 2-214, the City Manager has
provided a detailed staff report setting forth the specific facts establishing the emergency, why the
emergency does not permit a delay resulting from a competitive solicitation for bids, and why his
actions are necessary to respond to the emergency associated with the aforementioned repairs as
well as on the costs associated with the repairs to support his Determination of Emergency; and
WHEREAS, failure to immediately make the required repairs may result in danger to the
health, safety, and welfare of the City’s residents and/or public facilities; and
WHEREAS, at this time the cost of repairs and necessary equipment is estimated at
$750,000; and
WHEREAS, the foregoing recitals set forth the specific facts establishing an emergency at
the Sanger Domestic Wastewater Treatment Facility and the Industrial Wastewater Treatment
Facility; and
WHEREAS, the City Council has considered the written report and verbal report of the
City Manager at a regular meeting and determined that the facts and circumstances are such that
emergency repairs were and are needed.
Section 3. The City Council further finds based on the City Manager’s Determination
of Emergency as follows:
• The City’s Sanger Domestic Wastewater Treatment Facility and the Industrial
Wastewater Treatment Facility are critical to the health and safety of the residents
of the City of Sanger.

• Immediate repairs are needed for the protection of health, safety, and welfare of
City residents and for the protection of the Wastewater Facilities.
Section 4. The City Manager is authorized to proceed without competitive bidding for
the emergency repairs.
Section 5. Upon completion of the aforementioned repair work, any other work shall be
made through a competitive bid process as required by the Sanger City Code and Public Contract
Code.
Section 6. The City Council hereby directs the City Manager to make status reports at
each regularly scheduled Council meeting, pursuant to Section 22050 of the Public Contract Code
until the repairs have been completed.
Section 7. The City Council hereby authorizes the City Manager to execute contracts
for emergency repair work under the Determination of Emergency up to $200,000 without City
Council action. The City Manager will present such contracts to Council at such time as it makes
status reports under Section 5.
The foregoing Resolution was considered by the City Council for the City of Sanger at a
regular meeting of said Council held on the 18th day of July 2024 and approved by the following
vote:

Waste Discharge Requirements (WDRs) Order R5-2014-0004 for the City of Sanger
(City or Discharger) regulates the City's Domestic Wastewater Treatment Facility
(\A Ml-F). WDRs Order 98-131 regulates the City's lndustrialWastewater Treatment
Facility (l\ A//TF). WDRs Order R5-2014-0004 authorizes a monthly average daily
discharge of 3.0 million gallons per day (mgd), and WDRs Order 98-131 authorizes a
monthly average daily discharge of 1.3 mgd. The \MffTF and IWWTF are also regulated
by Standard Provisions and Reporting Requirements for Waste Discharge
Requirements dated 1 March 1991 (Standard Provisions).
At the time of the inspections, staff observed that the bar screen was missing from the
\ A/VTF. This is a violation of Provision F.5 of WDRs Order R5-2014-0004 and of
Standard Provision A.7. No inspection violations were identified at the I\AA/VTF. Staff
did not detect objectionable odors outside of the \ ANTF or I\AMTF property limits
during the inspections, and the odor complaint was not confirmed. However, staff
detected strong objectionable odors onsite in the vicinity of the headworks of the
\ AIVTF. Should objectionable odors be perceivable beyond the limits of the \AAffTF or
l\ AIVTF properties, the City would be in violation of the odor provisions in its WDRs
Orders.

As part of the compliance evaluation, Central Valley Water Board staff reviewed self-

for BOD, TSS, and total nitrogen. Additionalviolations were identified for late reports
and deficient monitoring. A total of 51 violations were identified for the I\AANTF for
exceedances of EC, pH, and DO limits, and for late/missing reports and deficient
monitoring. ln addition, the 2021 and 2022|\M//TF reports are missing the annual
groundwater analyticaldata and water flow net diagrams required by the WDRs Order.
The enclosed Facilities lnspection Report documents staffs inspection findings and the
above violations.
FILE REVIEW
ln a letter dated 17 September 2019, CentralValley Water Board staff requested that
the City of Sanger provide the dates the documents were submitted and the dates the
required actions were implemented. The letter stated that if the documents and actions
had not yet been submitted and/or implemented, then the City should provide updates.
A response to the 17 September 2019 was not submitted by the City. The required
reports and actions are overdue and need to be submitted/implemented. The Gity is in
violation of Provisions F.16.a, F.16.b, F.19.a, and F.19.b of WDRs Order R5-2014-
0004 and will continue to be in violation until the required reports are submitted
and the required actions are implemented. A copy of the 17 September 2019 letter is
enclosed.

BACKGROUND
Waste Discharge Requirements (WDRs) Order No. R5-2014-0004 for the City of Sanger (City or Discharger) regulates
the City's domestic Wastewater Treatment Facility (V1 /WF) WDRs Order No. 98-131 for the City regulates the City's
lndustrialWastewater Treatment Facility (l\ A/VTF). The \M/VTF is in the City's corporation yard adjacent to the lWUflF.
The \AAfiTF is separate from the IWVTF except that both share sludge processing operations. The \MNTF features a
bar screen, primary clarification, aeration basin, activated sludge treatment and disposal to percolation/evaporation
ponds. About 90 percent of the sludge is derived from the \A /VTF. The \AA&TF's sludge drying beds are paved with
asphalt that is underlain with a plastic liner. There are underdrains for the drying beds that divert leachate back to the
WVTF headworks. The I\M/VTF consists of headworks, clarification, two aerated treatment ponds, three storage ponds,
and effluent is discharged to a 116-acre Land Application Area (LM) for disposal. \ A/VTF effluent is conveyed in a
three-mile-long pipeline to six percolation/evaporation ponds near Lincoln Avenue known collectively as the "Domestic
Lincoln Ponds." Currentiy, VIA//TF effluent is discharged primarily to only three ponds (Ponds 1 - 3) and the other three
ponds are for emergency use. Order No. R5-2014-0004 authorizes a monthly average daily discharge of 3.0 million
gallons per day (mgd). Order 98-131 authorizes a monthly average daily discharge of 1.3 mgd.

I arrived onsite about 0945 and met with Jose Padilla, Operator lll. We then walked to the headworks. The domestic and
industrial influent enter the facilities in two separate channels. The bar screen for the domestic flow was missing (photo
1) and had been removed in December 2022 due to it malfunctioning. Objectionable odors were strong in the vicinity of
the headworks. Mr. Padilla stated that debris is removed from the domestic influent manually. The bar screen was
present for the industrial \ A/VTF. The industrial flume is shown in Photo 2. I then observed the domestic clarifier (photo
3) which had some debris likely due to the lack of a bar screen. The industrial clarifier appeared to be functioning
correctly (Photo 4) We then visited Domestic Clarifier #3, where rags were present within the clarifier likely due to the
lack of a bar screen (Photo 5). The sludge from the two \AMTFs is combined and first goes to the thickener (Photo 6),
then the DAF (Photo 7), and the Digester (Photo 8). The domestic wastewater flows to an aeration basin (Photo 9) prior
to discharge to the Lincoln Avenue Ponds. We then drove by the industrial aerated ponds (Photo 10), the industrial LAA
which had just been harvested (Photo 11), and MW-3 on the south end of the industrial ponds (Photo 12). We then
drove south to the Lincoln Avenue Ponds. Adequate signage was present (photo 13). We drove around the ponds,
which were weed free. A photo of Lincoln Avenue Pond 1 is included as Photo 14.
I identified violations of Order Provision F.5 and Standard Provision A.7 for failure to maintain the Domestic \M/VTF in
good working order (the bar screen was missing). In addition, the strong objectionable odors at the headworks threaten
to cause a nuisance condition by being perceivable beyond the \AA/VTF property during warmer times of the year which
would be a violation of Discharge Specification C.7.
Daily maximum limit for BOD of 80 mg/L was exceeded 13 times and was as high as270 mglL.
Monthly average limit for BOD of 40 mg/L was exceeded 1 3 times and was as high as 185 mg/L.
Daily maximum limit for TSS of 80 mg/L was exceeded 11 times and was as high as 640 mg/L.
Monthly average limit for TSS of 40 mg/L was exceeded 12 times and was as high as 218 mg/1.
Monthly average limit for total nitrogen of 10 mg/L was exceeded 6 times and was as high as 39 mg/L.
Nine late reports and deficient monitoring on one occasion.
The industrial \AMTF SMRs were reviewed for the period April 2020 through December 2022 and 51 violations were
found which included:
The EC limit of source plus 500 pmhos/cm was exceeded 29 times and was as high as 613 pmhos/cm over the limit.
The pH was less than the minimum limit of 6.0 pH units on one occasion.
Dissolved oxygen in the ponds was less than 1 mg/L on 7 occasions.
There were 11 late reports, one missing report, and deficient monitoring on two occasions.
ln addition, the 2021 and 20221\ AIVTF reports are missing the annual groundwater analytical data and water flow net
diagrams required by the Order.
