MTP ACT

DEFINITION

 Deliberate termination of pregnancy either by the


medical & surgical method before the viability of
the fetus is called induction of abortion
MEDICAL TERMINATION O F PREGNANCY
ACT 1971

 The Indian abortion laws falls under the Medical


Termination of Pregnancy (MTP) Act, which was enacted
by the Indian Parliament in the year 1971 with the intention
of reducing the incidence of illegal abortion and
consequent maternal mortality and morbidity. The MTP
Act came into effect from 1 April 1972 and was amended
in the years 1975 and 2002.

 Recently, the Supreme Court permitted a rape survivor to


terminate her pregnancy at 24 weeks, which is beyond the
permissible 20 weeks limit prescribed under the Medical
Termination of Pregnancy Act, 1971
LEGAL ABORTION

 Termination is performed by the medical


practitioners(assisted in at least 25 MTP &degree in OBG)
by the act.

 Termination is done at the place approved under the act.

 Termination done for condition & within the gestation


week prescribed by the act.

 The abortion has to be reported to the director of health


service of the state.
INDICATION
 Women whose physical and/or mental health were
endangered by the pregnancy

 Women facing the birth of a potentially handicapped or


malformed child

 Rape

 Pregnancies in unmarried girls under the age of eighteen


with the consent of a guardian

 Pregnancies that are a result of failure in sterilization


Who can terminate the pregnancy

 Experience minimum 3yr who is registered in state


medical register

 6months of house surgeon-ship in gynaecology Or


experience of working in department of gynaecology –1yr

 A Practitioner who has assisted RMP in 25 cases of


Medical termination of pregnancies, at least 5 of which
have been performed independently in a hospital
established or maintained by government or a training
institute approved for this purpose by the Government.
Experience and Training Required by a
RMP

 Up to 20 wks PG Degree or Diploma in OBG

 Completed 6 months as House Surgeon in OBG

 At least one yr experience in dept of OBG at any hospital


that has all facilities.
Where pregnancy can be terminated - PLACE

 Hospitals established or maintained by the Government

 A Place approved by the Government or DLC constituted


by the Government.
Consent

 Only the consent of a women is required

 If Age <18 yrs or a mentally ill patient, consent of


guardian is required.
Violation of The ACT

 Any person doing MTP and not a RMP can be


punished with rigorous imprisonment for 2-7 yrs.

 If terminating at a place which is not approved can be


punished 2-7 yrs rigorous imprisonment.

 The owner of unapproved place , performing


termination can also be punished with rigorous
imprisonment 2-7 yrs
COMPLICATION O F MTP

IMMEDIATE:
 Injury to the cervix (cervical lacerations)

 Uterine perforation during D and C

 Hemorrhage and shock due to trauma, incomplete


abortion, atonic uterus or rarely coagulation failure

 Thrombosis or embolism
COMPLICATION O F MTP
REMOTE : The complications are grouped into:

Gynecological complications include


 Menstrual disturbances
 Chronic pelvic inflammation
 Scar endometriosis (1%)

Obstetrical complications include


 Ectopic pregnancy (three -fold increase )
 Preterm labour
 Dysmaturity
 Rupture uterus
