Before the Hon’ble Judicial Magistrate II, Bareilly

Application U/s 91 of CrPc/Section 94 Of BNSS to summon the


report regarding above-mentioned case

It is respectfully showeth:-

1. That the applicant is a resident of 13, Paalpur , Kamaalpur, Cantt


which falls within the jurisdiction of this hon’ble court.
2. That the applicant is an accused in the above case and granted bail
by the hon’ble court in 2010 before filing chargesheet by the
respective investigating officer, whereas copy of bail documents
was destroyed in a fire accident.
3. That the applicant is an illiterate poor person and to earn
livelihood went out of state to earn his livelihood thereupon no
summons was served upon the applicant regarding the
proceedings of above case.
4. That to fulfil his sacrament wish to do Hajj which is an
annual Islamic pilgrimage to Mecca, Saudi Arabia, the holiest
city for Muslims also an mandatory religious duty for Muslims
that must be carried out at least once in their lifetime by all adult
Muslims, applicant applied for his passport before regional
passport office Bareilly, bearing application no. ARN: 23-
0011659528 dated 27/07/2023.
5. That upon issuing verification process by respective office the
local intelligence unit reported this case and respective passport
office decline the application due to same reason.
6. That upon discovering such fact the applicant filed an RTI dated
13/10/2023 before the SSP whereas respective department of
police disposed the same application by stating that respective
police station is not capable to provide the information regarding
the case.
7. That due to such aggrieved act by the respective police
department the applicant is prejudiced and left no other option to
knock the door of this hon’ble court to summon the report/ other
necessary documents regarding this case from respective police
station for further process.
8. That for the kind perusal of this hon’ble court the copy of
passport application is annexed as Ex- 1, Copy of above RTI is
annexed as Ex-2 and copy of Adhar of applicant is annexed as Ex-
3.

PRAYER

Hence, it is humbly prayed before this hon’ble court in


the view of above-mentioned facts to kindly issue process U/s 91
of CrPc/Section 94 Of BNSS or pass any suitable order in the
favour of applicant in the interest of justice and equity.

I, Ishak Ahmad S/o Late Gulam Rasool R/o 13, Paalpur,
Kamaalpur, P.s Cantt, Bareilly do hereby solemnly affirm make
oath as under: -

1. That the deponent is applicant/accused in the above


application and well acquainted with the facts and
circumstance of the application.
2. That the accompanying exhibits are copy of documents
obtained through original documents.
3. That the deponent states that, contents of the accompanying
application from paragraph no.1 to 8 along with prayer, are
true to my personal knowledge and information receive
through my counsel which receive to be true.
4. That deponent states contents of this affidavit are true to
my personal knowledge.
