TRAINING AGREEMENT

This Training Agreement made and executed by and between:

LKY FOOD GROUP INC ., a corporation duly organized and existing under and by virtue of
the laws of the Republic of the Philippines, with principal office ___________________,
represented in this act by its ____________________, MR. ________________________,
hereinafter referred to as the COMPANY;

-and-
LEONEIL M. CARAYAG, Filipino of legal age, a resident of Sta. Maria Macabebe,
Pampanga and hereinafter referred to as the TRAINEE.

WITNESSETH:

WHEREAS, the Trainee, a graduating student from STA.MARIA NATIONAL HIGH SCHOOL (“DepEd) applied
for an on-the-job training with the Company as part of his final requirements with the Institution;

WHEREAS, the COMPANY, in its commitment to train and develop more professionals, has agreed to support
the Trainee in the form of training on the operations in the field of GRADE 12 TVL -HOME ECONOMICS to enhance his
competence, skills and professional discipline subject to the terms and conditions of this Agreement;

NOW THEREFORE, for and in consideration of the foregoing, the PARTIES have come to an agreement under
the following terms and conditions:

1. NATURE & PURPOSE - The purpose of the Agreement is to train the Trainee through on-the-job training
and theoretical instructions from the Managers/Supervisors of the department or unit the Trainee may be
assigned.

The Trainee shall be evaluated based on the performance evaluation criteria herein attached as Annex A.
The COMPANY has the option to hire the Trainee after the program if the Trainee meets the skills
requirement required by the COMPANY.

It is understood that the Trainee is not an employee of the COMPANY.

2. POSITION- The Trainee shall be given the training for the position of ON THE JOB TRAINING, reporting
directly to the STORE HEAD, LARA MAY MORALES.

3. COMPLIANCE WITH THE INSTITUTION’S REQUIREMENTS. The Trainee shall ensure that the training
to be given by the Company qualifies with the requirement of the Institution. For this purpose, the Trainee
shall have the responsibility to have this Agreement approved by the Institution. Moreover, the Trainee
shall ensure that it has provided the Company all documents necessary to evaluate his performance such
as the grading metrics or performance evaluation criteria upon signing of this Agreement.

4. TERM - The effectivity of this Training Agreement shall commence on _______________ until
________________ or for a period not exceeding ____ months with a daily hours of __________from ___
to ______.

5. RESPONSIBILITIES –The trainee is expected to… (enumerate Job Description for the Position)

(i) The Trainee is expected to observe all administrative policies and procedures, safety and security
measures and work guidelines as well as lawful orders given by persons in authority;

(ii) Shall conduct in a manner befitting of a professional by maintaining entirely professional during the
course of my training towards my co-intern and all employees of LKY Group of Companies;

(iii) The Company has the right to impose sanctions and even terminate the training immediately, if the
Trainee violates any of the Company policies which the Trainee is expected to know.

(iv) The Trainee shall be held responsible for any damages to property or injury, which may arise, due to
his negligence or intentional acts during the course of his training.

(v) The Trainee must complete the agreed number of training hours with the Company. Otherwise, only the
actual working hours as well as the services that he has rendered shall be certified by the company. For
this purpose, the Trainee shall have a daily time record with corresponding output to be signed on a daily
basis by the Manager/Supervisor.

6. COMPENSATION – The Trainee shall not be entitled to any compensation for the duration of this
Agreement.

7. The COMPANY shall not be held responsible in the event of any misfortune or loss of property
such as personal belongings or accident resulting to permanent or temporary disability or major
or minor injuries during the course of the training.

8. TERMINATION OF THE CONTRACT-

The following shall be the grounds for the termination of the Agreement:

By the COMPANY:

a) Habitual absenteeism in on-the-job training and related theoretical instructions without due notice;
b) Willful disobedience of company rules, insubordination to lawful order of a superior or disrespect to
superior;
c) Poor physical condition, permanent disability or prolonged illness which incapacitates the Trainee from
working;
d) Theft or malicious destruction of company property or equipment;
e) Poor efficiency or performance on the job for a prolonged period despite warnings duly given which
affects the COMPANY’s operations;
f) Engaging in violence or other forms of gross misconduct inside the COMPANY’s premises;
g) Spreading of confidential or false information or rumors about the COMPANY and its employees.

By the TRAINEE:

a) Substandard or deleterious working conditions within the COMPANY’s premises;


b) Repeated violations by the COMPANY of the terms of the Training agreement;
c) Cruel or inhuman treatment by the COMPANY or its employees;
d) Personal problems which in the opinion of the Trainee shall prevent him from a satisfactory
performance of his job; and
e) Bad health or continuing illness.

In the unfortunate event that one of the Parties opt to terminate this Agreement, he/she is required to serve
a notice in writing at least 3 days prior to the actual date of disengagement, unless cleared by the
COMPANY for an earlier release. The TRAINEE shall immediately turn-over the assigned tasks to him.

9. PROPRIETARY/CONFIDENTIAL INFORMATION – Unless otherwise authorized in writing by the


President of the COMPANY, the TRAINEE will maintain all information in confidence, EVEN AFTER THE
TERMINATION OF THIS AGREEMENT, will not copy nor make notes of, divulge to anyone outside the
COMPANY, nor use or allow the use by others, of any of these information for his own or another’s benefit,
either during or after his employment with the company, the following information:

 Trade secrets – valuable information that helps sell the COMPANY’s services or increase revenues or
profits, such as patents, blue prints, costing and price lists, customer and supplier listings,
marketing/sales strategies, sales forecasts and analyses.

 Other confidential information – all kinds of contracts and written agreements, personnel files, payroll
records, information technology, records and files, software systems, financial analyses, budget and
other data and/or procedures for internal use.

 All documents, materials and other tangible property relating in any way to the COMPANY’s business
shall be and remain the exclusive property of the COMPANY. The TRAINEE is prohibited from making
a copy of any of these documents.
 All information that may come to his possession r have knowledge due to this Agreement.

By affixing his/her signature in this document, the TRAINEE HEREBY ACCEPTS the fact that he/she
understood the entire contents of this Training Agreement and affirms his/her voluntary submission to the foregoing.
