Subject: Submission of Evidence and Request for Action

Dear Members SCSC,

We regret to inform you that we are unable to physically present all the evidence
before the Standing Scrutiny and Complaint Committee (SCSC) due to the
arbitrary withholding of our salaries by the institute for over 20 (twenty) months,
which has led to severe financial distress. Despite repeated instructions from the
AICTE to the Secretary and President to resolve service-related issues through
the Grievance Redressal Committee (GRC), the management has intentionally
neglected these directives.

Enclosed herewith do students, staff, upload photographs and other concerned


individuals, supporting our claim regarding the shared building and infrastructure
of the three institutes, as detailed in our previous communication dated 13th
August 2024. The trust has violated Register undertaking submitted on Non
Judicial stamp paper of Rs 100/- stating that exclusive built up area has been
created to conduct Diploma Engineering Programme and the facilities are not
shared with Degree Engineering College or any other programme. We believe
that a surprise visit by an Expert Committee would be the most appropriate
method to handle such complaints, and therefore, we refrain from delving into
the specifics of the shared infrastructure.
We would like to draw the Committee’s attention to the fact that both AICTE-
approved institutes (the Vikramshila Polytechnic Darapur and the
Takashsaheela Engineering College, Darapur formerly known as KGIET in short)
have failed to comply with the following mandatory requirements of the AICTE:
1. Department-wise availability of infrastructure along with approved
courses and intake as sanctioned by the Council.
2. Faculty details: Department-wise listing of faculty members/teaching staff,
including their names, designations, and qualifications, tenure of service,
total experience, student-faculty ratio, and cadre ratio.
3. Audited financial statements for the last three financial years.
The trust’s website (https://www.dgctamt.org/) has intentionally omitted the
above mandatory disclosures. Additionally, the websites for the engineering
college (www.kgiet.ac.in) and the polytechnic
(http://vikramshilapolytechnic.org/) are non-functional.
The management is fully aware of the shortage and shared infrastructure between
the Polytechnic and Engineering College operated by the trust on the same
campus. This issue has been highlighted in Civil Application [Caw] Nos. 1851 &
1524 of 2024 in Writ Petition No. 3541 of 2023 by the High Court of Judicature

at Bombay, Nagpur Bench, which pointed out the intentional delay in obtaining
the Extension of Approval for the Polytechnic.
Despite several RTI applications, both the Engineering and Polytechnic institutes
operated by Shri Dadasaheb Gawai Charitable Trust on the same campus have
repeatedly denied consent for the disclosure of information to WR (RB), AICTE
HQ-New Delhi, indicating an attempt to conceal information. We are submitting
one such email as proof of our claim.
We have already submitted documents related to the violation of EPF dues
payment by both institutes.
There is several concerns with building infrastructure as many buildings have
developed severe cracks and structural stability is at question. Non-availability of
sewage disposal system has created potential danger for the buildings. Some
cracks in the building have propagated throughout the entire building.
We do not find any point in submitting detail-building infrastructure of total built
up area of both AICTE approved institute as both institute for obtaining EOA on
AICTE portal has already submitted it.
We, therefore, request the Standing Scrutiny and Complaint Committee (SCSC)
to aggregate all complaints submitted through the Centralized Public Grievance
Redress and Monitoring System as well as the Central Vigilance Commission
portal and recommend a surprise visit to verify the facts against the allegations
and complaints filed by us.

Respected Sir,
Despite our numerous verbal and written requests, Prof. Manish Manohar Patil, the Incharge Principal
of Vikramshila Polytechnic, Darapur, has consistently failed to display and provide the following
mandatory information.
As per the mandatory disclosure requirements of the Approval Process Handbook (APH) 2024-27
(Annexure-18, page 180), institutions are required to prominently disclose the following information
on their website:
1. *Department-wise availability of infrastructure* along with approved courses and intake
as sanctioned by the Council.
2. *Faculty details*: Department-wise, including the name and designation of faculty
members/teaching staff, their qualifications, tenure of service in the organization, and total
experience. The institution must also disclose the Student-Faculty Ratio and Cadre Ratio.
3. *Audited Financial Statements* for the last three financial years.
Given the persistent non-compliance by the aforementioned institution, we are compelled to file this
formal complaint. The above information is urgently required for a legal matter concerning our union.
We request your immediate intervention to ensure compliance with the APH guidelines and to
facilitate the provision of the required information at the earliest.

Petitioners are teaching and non-

teaching staff. They seek certain directions against

respondents, in particular for payment of salary and

to protect their services.

2. Petitioners are in the employment of

respondent nos. 7 and 8 Technical Institution

which is controlled by All India Council of

Technical Education (AICTE). As per the

prevailing norms, the Management has to annually

undertake to apply for grant of extension of

approval for the institution. The Management

annually needs to submit requisite information by

following on-line process within a stipulated period

and with requisite fees. The entire process is to be

followed in terms of the Approval Process

Handbook.

3. It reveals that the Management has not

paid the requisite fees which resulted into closure of


the proposal.

4. It is not in dispute that presently the

teaching and non-teaching staff is working with the

institution, as well as there are several students who

are taking education. It is submitted that if annual

approval is not granted, it would be against the

interest of teachers, as well as students.

5. The learned Counsel appearing for

AICTE would submit that if the fees are deposited,

then further steps would be taken.

6. The learned Counsel for the

Management would submit that interest of students

is not at all affected, but, according to us, if the

extension is not obtained, then stage wise classes in

the institution would become defunct. Particularly

we have taken note that the Management has

neither applied for closure, and thus, they have to

fulfill their obligations.

7. In view of above, by way of an interim

measure, we direct respondent nos. 7 and 8 to

deposit the requisite fees and complete the process


of extension within a period of two days from today.

If within two days, fees is deposited, the AICTE

shall accept the same and complete the remaining

formalities. However, if they are any deficiencies,

the same would be cured by the Management

immediately to proceed further.

7. Civil Application is accordingly disposed

of.

8. Copy of this order be furnished to

learned Counsel for the parties to act upon.

The All India Council for Technical Education (AICTE) permits the sharing of
infrastructure among several institutes operating on the same premises, subject to
specific guidelines and conditions. According to AICTE’s approval process,
institutions under the same trust, society, or company operating in the same
location or city can merge into a single institution, allowing them to share
facilities such as classrooms, laboratories, libraries, and other infrastructure.
We wish to bring to your attention that the aforementioned institutes are operating
as separate entities despite being under the same trust. They have not merged into
a single institution to date. Consequently, the combined shared infrastructure does
not meet the requirements for all the programs and levels offered.
The AICTE conducts surprise visits to ensure that institutions comply with its
standards and regulations. These visits are part of the Expert Visit Committee
(EVC) process, which verifies the availability of facilities, faculty, and other
resources at AICTE-approved institutions. We request AICTE to conduct
physical visits due to several complaints from the employees of both the
engineering and polytechnic colleges, recent directions from the Nagpur High
Court to Vikramshila Polytechnic, Darapur for affiliation, and other extraordinary
circumstances, including several cases filed by employees regarding salary
arrears/non-payment of salary as per AICTE norms. The surprise visit will
address all allegations and claims made by both parties.
We also wish to inform you that the management is aware of the available
infrastructure and the false claims made in the affidavit submitted to AICTE for
obtaining EOA. Consequently, they have not paid EOA charges for Vikramshila
Polytechnic, Darapur even after the deadline, intending to merge the polytechnic
infrastructure with the engineering college. However, the Bombay High Court,
Nagpur Bench, passed an order on 22nd July 2024 for mandatory EOA payment
as a special provision. The receipt of payment attached as proof of the above
claim along with the court order. Moreover, there is a violation of EPF dues
payment, and a public notice in a daily newspaper attached as proof to support
our complaint.
