AGREEMENT OF GIFT DEED

THIS Agreement of Gift Deed is duly made and executed on this


day Twenty Eight of August Two Thousand and Twenty-Four (28/08/2024)

Hereinafter referred to as the ‘DONOR’ which term shall include his Heirs,

Mrs. Sahana S Shettar is anxious to make a gift to her minor Children and
acting as their natural guardian.

Hereinafter referred to as the ‘DONEE’ on behalf of minor which term


shall include her Heirs, Legal Representatives, Executors, Administrators,
Successors, assigns, etc., of the OTHER PART;

WHEREAS the Donor is the absolute owner in possession and enjoyment


of the Residential Property situated at Sri M Vishweshwaraya Layout, 7th
Block, No. 922, East to West :: 9.00 meter, North to South ::12.00
Bengaluru meter morefully described in the Schedule hereunder and
hereinafter referred to as the ‘Schedule Property’ having got the said
property through a Gift deed dated 28-03-2016 from Sri. S P Shettar, Gift
deed Document duly registered as bearing No. PNY-1-09154-2015-16 in
CD No. PNYD637 of Book I pages No. 1 to 8 at the Office of the Sub-
Registrar, Peenya, Bengaluru in favour of Mrs. Sahana S Shettar, the
Donor was put in possession and enjoyment of the property, the said
property is morefully described in the 'Schedule' hereunder and
hereinafter referred to as the 'SCHEDULE PROPERTY'.

WHEREAS the Donor has been exercising all rights of ownership therein,
without any let or hindrance whatsoever from any corner as absolute
owner thereof. The schedule property is the gifted property of the DONOR
herein and the said property is free from all kinds of encumbrances. The
DONOR has got absolute, good and marketable title over the schedule
property and the Donor is married to Mr. Niranjana Shravanabelagola
Jinachandra and the couples are having 2 children, Rishith N Jain and
Kushi N Jain;

WHEREAS Rishith N Jain and Kushi N Jain, the Donee herein are the
children of the Donor and residing with the Donor.

WHEREAS the Donor has acquired the Schedule Property from her father
and later with the support of her husband has build a house in the said
property out of own earnings and as the Donee are the children of Donor,
the Donor deems it fit and proper to gift the Schedule Property in favour
of the Donee i.e., both the Children Rishith N Jain and Kushi N Jain, out of
love and affection and

WHEREAS the Donee by the natural guardian has agreed to accept the
gift of the Schedule Property from the Donor,

NOW THIS INDENTURE OF GIFT WITNESSETH AS FOLLOWS:-

That in pursuance of the aforesaid desire and in consideration of


gratitude, natural love and affection towards his daughter the DONEE
herein. The DONOR does hereby transfer, assign and set over possession
of the SCHEDULE PROPERTY, mentioned hereunder UNTO AND TO THE
USE OF THE DONEE AUTHORIZED BY THE NATURAL GUARDIAN TO HAVE,
TO HOLD AND TO ENJOY the same peacefully forever as her own and
absolute property together with all appurtenances, liberties, privileges,
easement rights, free from all encumbrances, lawful evictions, litigations,
liens, lispendences, claims, clogs, arrears of taxes made either by the
DONOR or anybody claiming through or in trust of him.

AND WHEREAS, the DONOR further undertakes to do or cause to be done


all such acts, deeds, and things whenever occasion demands as to more
perfectly assure the DONEE and to indemnify the DONEE against all
claims, demands, losses incurred and damages sustained for and on
account of any breach of the said covenants, and the DONEE have no
right to alienate the said SCHEDULE PROPERTY at her own discretion once
the children attain majority they would get all the right to alienate the
said SCHEDULE PROPERTY.

The DONOR further declares that the DONEE shall be at full liberty to get
the khatha of the schedule property transferred in her name and enjoy
the same as her own and absolute property without any let, hindrance,
interruption or disturbances either from the DONOR or anybody claiming
through her.

The DONEE in token of her graceful acceptance of this Gift on behalf of


both the children has affixed her signature below and the DONEE shall
have no right and liberty to alienate, sell, mortgage, gift, bequeath,
transfer, convey the schedule property in whatever manner as she deems
fit and proper and declares that she is in possession of the schedule
property. The DONEE can let the property for rent, lease and maintain the
residential property only after children attaining majority, the children can
alienate the property.

The DONOR has set his hand to this GIFT DEED out of his own free will
and volition, without any force or pressures from any person or persons
whomsoever. This Gift in respect of the Schedule property is absolute, full
and final in favour of the DONEE on behalf of minor.

In consideration of love and affection the Donor has in respect of the


Donee on behalf of minor, who are children of Donor, the Donor has, out
of his own free will, volition and pleasure without any undue influence,
fraud, force or coercion and in full possession of his senses, this day
gifted the entire Schedule Property to the Donee on behalf of minor
together with all privileges, advantages and all other easements
whatsoever enjoyed by the Donor till this day and which are reputed to be
so, absolutely and forever and free from all encumbrances and liabilities
whatsoever.

The Donor having the absolute right and none else have any right, title or
interest in respect of the same has put the Donee on behalf of minor in
exclusive possession of the Schedule Property.

The Donee by the natural guardian has accepted the Gift made by the
Donor in respect of the Schedule Property and also the Documents in
respect of the same as well as the physical possession of the Schedule
Property.

The Donee on behalf of minor shall hereafter at all times peacefully and
quietly enjoy the Schedule Property hereby gifted without any let or
hindrance whatsoever from the Donor or by any person claiming under
the Donor.

The Donor is mentally fit and sound to execute this Gift Deed.

North to South ::12.00 Bengaluru with all the structures, fixtures, fittings,
moveable and building etc., found in the property and bounded on the

West by: House No.923

North by: House No.912

South by: Road

IN WITNESSES WHEREOF the DONOR and DONEE on behalf of


minor have affixed their respective signatures to this Deed of Gift on the
day, month and year first above written.
