MARKETING AND SALE AGREEMENT FOR LAND OPEN PLOTS

This Marking and Sale Agreement for Land Plots (“Agreement”) is made on August 9, 2023 at Attapur,
Rajendra Nagar, Rangareddy District between Stm. G. Venkata Lakshmi, D/o K. Venkatewsara Rao,
Aged 27 years, having Aadhar No. ______________________ Resident of Flat No. 403, Brundavanam
Residency, Near Bhavani Bar and Restaurant, Attapur, Rajendra Nagar, Rangareddy District, Telangana
– 500048 and Stm. K.Lakshmi Devi W/o K.Baludu, Aged 55 years, Aadhar No.
________________________ resident of H/No. 1-101, Mallela Village, Thondur Mandal, YSR District,
Andhra Pradesh-516401 (Hereinafter called the “Land Owner or Land Owners” of the One Part:) and
Mr.Nerugattu Rajanikanth S/o N.Chengaiah, Aged; 39 years; Aadhar No. 799636636715, Occ: Business
and Private Employee R/o 1-1-10, Upper Palli, Near Session Court, Hyderguda, rajendra Nagar, K.V.
Ranga Reddy district, Telangana-500048 (Hereinafter called the “Agent” of the Other part).
WHEREAS the Land Owner is in the business of “Real Estate” and is interested in appointing a
commission agent at Hyderabad, for sale of Open Plots being developed by Land Owners. AND
WHEREAS the Agent has approached LAND OWNERS with Land and its sellers details and Agent has
proposed to Land Owners to invest on the same Land. AND
WHEREAS the Agent has approached the LAND OWNER to appoint him as his Commission Agent for
the Proposed Land, LAND OWNERS are interested to appoint Agent for sale of the open plots.
NOW THIS AGREEMENT WITNESSES AS UNDER;
1. That the LAND OWNER appoints the agent as its Commission Agent for sale of Open Plots in
India and other parts of the Globe.
2. That the agent shall get a commission of _____________% on the total sale consideration of the
each Plot, for which he has procured the Order/Booking and the same shall be paid to him as under
i). On receiving the booking amount/ allotment price ______________ % by the Land
Owner
ii) On receiving the Total Sale Consideration ________________%
iii) On conclusion of sale, by Registering the Document __________________% in
favour of the purchaser 3. His commission shall be payable, with deduction of the amount,
which he is liable to pay under the Income-Tax Laws for the time being in force.
4. The said Mr. N. Rajanikanth here by undertakes and guarantees, to the Land Owner to keep the
Land Owner harmless and indemnified for all losses, damages, costs and charges, that it might incur due
to any wrongful acts, malaise acts, negligent acts or gross dereliction of duties on his part.
5. This Agreement is valid for five (5) Years and renewable on mutual terms and conditions for
successive periods as agreed from time to time.
6. The Land Owner shall have the right to terminate this agreement without any prejudice to any
other remedy, for any breach or non-performance of any part of this Agreement namely:
(a). If the agent is found guilty of breach of any provision of this Agreement or is found guilty of
misconduct or negligence of his duties.
(b) If the Agent commits any act of insolvency.
7. The said ____ shall not engage himself in any business which of competition to the business of Land
Owner during his tenure with the Land Owner.
8. He shall perform his duties and functions under the direction, supervision and control of the Land
Owner.
9. He shall duly account for all moneys of the Land Owners, if any, coming into his hands, and the
accounts shall be shown and paid to the Land Owner on demand.
10. That during the currency of this agreement the agent shall work honestly and diligently in
increasing the sales of the Land Owner.
11. That if any dispute arises between the parties herein regarding this Agreement, the same shall be
settled by the sole arbitrator duly appointed by the Land Owner.
12. Agent should not collect any amount by way of cash or any other way from the Customer. All
payments shall be directed to the Land owners and their bank accounts details provided. That on
termination of this agreement, the Agent shall handover the Land Owner’s all the cash held with him if
any, and other documents and papers etc, within seven days from the date of termination.
We the above mentioned parties have signed this agreement in the presence of following witnesses.
