1.1 Introduction

This Minimum Equipment List (MEL) is based on the F.A.A. Master Minimum Equipment List (MMEL) 02/02/98 revision 4a. This MEL takes into consideration XXXX XXXX (XXXX) particular aircraft equipment, configuration and operational conditions, routes flown and requirements eventually set by the Airworthiness Authority either Portuguese or by the FAA. This MEL does not deviate from any applicable Airworthiness Directive or any other Mandatory Requirement and is no less restrictive than the MMEL. The present MEL is intended to permit operations with inoperative items of equipment for a period of time until the applicable rectifications are accomplished. Rectifications are to be accomplished at the earliest opportunity. The present MEL Conditions and Limitations do not exempt the Pilot in Command from determining that the aircraft is in condition for safe operation with specified unserviceabilities allowed by the MEL. The provisions of the present MEL are applicable until the aircraft commences the applicable flight. Any decision to continue a flight following a failure or unserviceability which becomes apparent after the commencement of a flight must be the subject of Pilot in Command judgement. The Pilot in Command may continue to make reference to and use of the MEL as appropriate. By approval of the present MEL, the Airworthiness Autority permit dispatch of the BE 76 Aircraft to perform the XXXX activities flights with certain items or components inoperative, provided an acceptable level of safety is maintained by the use of appropriate operational or maintenance procedures; or by transfering the function to another operating component; or by referencing to other instruments or components which provide the required information. This MEL is mandatory at XXXX for Instructors Pilots as well as for Students namely undergoing solo flights. The MEL is part of each BE 76 aircraft documentation and is provided individually to each Pilot and is available permanently in XXXX intranet. including to the Maintenance Organisation responsible for the aircraft.

Note:For dispatch with airframe or engine parts missing, refer to the CONFIGURATION
DEVIATION LIST (CDL).

1.2 Contents of MEL

This MEL contains only those items required by Operating Regulations and those items of airworthiness significance which may be inoperative prior to dispatch, provided that appropriate limitations procedures are observed. Aircraft equipment essential to aircraft airworthiness such as wings, rudders, flaps, emgines, landing gear, etc. are not listed and must be operative for all flights at all stages and time. As such, ALL ITEMS RELATED TO THE AIRWORTHINESS OF THE AIRCRAFT ARE NOT INCLUDED ON THE MEL LIST BEING AUTOMATICALLY REQUIRED TO BE OPERATIVE.

1.3 Criteria for Dispatch

The decision of the Pilot in Command to have allowable inoperative items corrected prior to flight prevails over the provisions contained in the MEL. In this respect, notwithstanding the content of this MEL, the PIC may request on his own discretion to have duly functional certain MEL items, which at the time of fligh preparation need to operative, thus ensuring flight safety and/or enable certaing flight training activities. The MEL does take into account multiple equipemnts unserviceable. Therefore, any decision to dispatch BE 76 aircraft with multiple MEL inoperative items, must be thoroughly assessed to verify that any interrelationship between inoperative items will not result in a degradation of the flight safety and/or unnecessary increase in crew workload. It is respect, a good judgment is essential, with good assessment of the relevant circumstances, including climatic and en-route conditions associated with the flight training.

1.4 Maintenance Actions

The Maintenance Department shall make all efforts to correct the technical defects as early as practicable being each aircraft released from maintenance in fully operational condition. Notwithsantding the RTB content in wthat concerns recording of unserviceable items, that were not possible to rectify prior to aircraft departure, at the time of aircraft dispatch, the Pilot in Command must be informed by XXXX Maintenance of those MEL situations. Whenever an aircraft is released by Maintenance for dispatch with MEL inoperatives items, the following is required: a) The onboard technical log book (RTB) must contain identification of each MEL inoperative item, with special advice to the flight crew, if necessary, and information about corrective action taken. b) If accessible to flight crew, the MEL inoperative equipment must be cleary identified. c) To properly secure any MEL inoperative equipment to avoid any hazard or endanger people or the operation. d) The relevant Maintenance Procedures related with the corrective actions needed to repair the inoperative MEL equipment are available at XXXX Maintenance Organisation, duly updated.

1.5 Rectification Intervals

Inoperative items or components, deferred in accordance with the MEL, must be rectified at or prior to the rectification intervals established by the following letter designators given in the Cat columm of the MEL. 17 Original FEB2010

Category A
No standard interval is specified, however, items in this category must be rectified in accordance with the conditions stated in the Remarks column (5) of the MEL.

Category B
Items in this category must be rectified within three (3) consecutive calendar days, excluding the day of finding.

Category C
Items in this category shall be rectified within ten (10) consecutive calendar days, excluding the day of finding.

Category D
Items in this category shall be rectified within one hundred and twenty (120) consecutive calendar days, excluding the day of finding.

1.6 Ferry Flights

Ferry flights may be take place with less than the equipment specified in this MEL provided all the equipment expected to be utilized in flight is operable and flight can take place in safe conditions. Permission for such a flight, however, must be requested from the appropriate Authority or be granted to XXXX in accordance to XXXX specific regulation. 18 Original FEB2010

1.7 Definitions and General MEL Instructions

For the purpose of this MEL the following definitions and instruction apply:

1.7.1 System Definitions

System numbering is based on the Air Transport Association (ATA) Specification Number ispec 2200 (following former ATA 100) being items numbered sequentially. a. (Column 1) Item means the Equipment, System Component, or Function listed in the Item column. (Column 2) Cat means Inoperative items or components, deferred in accordance with the MEL, that must be rectified at or prior to the rectification intervals established by the letter designators given in the Cat column of the MEL. (Column 3) Quantity Installed menas the quantity of items installed in the aircraft. This number represents the aircraft configuration considered in development process of this MEL. Should the quantity be variable (e.g., passenger cabin items) a number is not required. (Column 4) Quantity Required for Dispatch means the minimum quantity of items required for the operation provided the conditions specified in Column 5 are met.

(Column 5) Remarks or Exceptions in this column includes a statement either prohibiting or permitting operation with a specific number of items inoperative, provisions (conditions and limitations) for such operation, and appropriate notes. A vertical bar (change bar) in the margin indicates a change, addition or deletion in the adjacent text for the current revision of that page only. The change bar is dropped at the next revision of that page. When MEL shows a variable quantity required for dispatch, the MEL must reflect the actual Quantity Required for dispatch or an alternate means of configuration control approved by XXXX. 19 Original FEB2010

1.7.2 Airplane Flight Manual (AFM)

It is the document required for Type Certification and approved by XXXX . The XXXX approved AFM for the specific aircraft is listed on the applicable Type Certificate Data Sheet.

1.7.3 Other instructions

a) Each inoperative MEL item must be duly identified to inform the crew members and maintenance personnel about the condition of the equipment. b) To the extent practical, identification should be located on or adjacent to the MEL item affected. Otherwise, the relevant identification may be placed in a different location provided that option can ensure for the Pilot will be determined by XXXX. c) - symbol in column 3 and/or column 4 indicates a variable quantity of the item installed. d) Deleted in the remarks column after a sequence item indicates that the item was previously listed but is now required to be operative if installed in the aircraft. e) Flight Day means a 24 hour period (from midnight to midnight) either Universal Time Coordinated (UTC) or local time, as established by XXXX, during which at least one flight is initiated for the affected aircraft. f) Icing Conditions means an atmospheric environment that may cause ice to form on the aircraft or in the engine(s).

g) Alphabetical symbol in Column 4 indicates a provision (condition or limitation) that must be complied with for operation with the listed item inoperative. h) Inoperative means a system and/or component malfunction to the extent that it does not accomplish its intended purpose and/or is not consistently functioning normally within its approved operating limit(s) or tolerance(s). i) Notes in Column 5 provides additional information for crew member or for maintenance staff. Notes are used to identify applicable material which is intended to assist with compliance, but do not exempt XXXX of the responsibility for compliance with all applicable requirements. (1) Inoperative items which are components of a system which is inoperative are usually considered components directly associated with and having no other function than to support that system. (Warning/caution systems associated with the inoperative system must be operative unless exemption is specifically authorized per the aircraft MMEL.. k) (M) symbol indicates a requirement for a specific maintenance procedure which must be accomplished prior to operation with the listed item inoperative. Normally these procedures are accomplished by maintenance personnel; however, other personnel may be qualified and authorized to perform certain functions. Procedures requiring specialized knowledge or skill, or requiring the use of tools or test equipment should be accomplished by maintenance personnel. The sactisfactory accomplishment of all maintenance procedures, regardless of who performs them, is the required to be published as part of XXXX BE 76 MEL.. 20 Original FEB2010 (O) symbol indicates a requirement for a specific operations procedure which must be accomplished in planning for and/or operating with the listed item inoperative. Normally these procedures are accomplished by the flight crew; however, other personnel may be qualified and authorized to perform certain functions. The sactisfactory accomplishment of all procedures, regardless of who performs them, is the responsibility of the operator. Appropriate procedures are required to be published as a part of the XXXX BE 76 MEL.

l)

m) The (M) and (O) symbols are required in the operators MEL unless otherwise authorized by XXXX Director of Exploitation. n) Deactived and Secure means that the specified component must be put into an acceptable condition for safe flight. An acceptable method of securing or deactivating will be established by XXXX. o) Visual Flight Rules (VFR) is as defined in Operations Manual of XXXX, Part C (Page C-41 in Weather Minima for Flight Instructors and Page C-5-1 in Weather Minima for Students) and EASA 1899 OPS 1.465. p) Visual Meteorological Conditions (VMC) means that the atmospheric environment is such that would allow a flight to proceed under the visual flight rules applicable to the flight. This does not preclude operating under Instrument Flight Rules. q) Visible Moisture means an atmospheric environment containing water in any form that can be seen in natural or artifical light; for example, clouds, for, rain, sleet, hail or snow. r) Repair Intervals: Inoperative items or components, deferred in accordance with the MEL, must be rectified at or prior to the rectification intervals established by the following letter designators given in the Column 2 Cat of the MEL: s) Administrative Control Item means an item listed by XXXX in the MEL for tracking and informational purposes; t) *** symbol in Column 1 indicates an item which is not required by regulation but which may have been installed on some Cessna aircraft covered by this MEL, operated by XXXX.

u) This document nor the use of the symbol defined in 7.22 provide authority to XXXX remove a MEL item from an aircraft.

v) Day of Finding is the calendar day an equipment/instrument malfunction was recorded in the aircraft maintenance log and or record, known at XXXX as RTB. This day is excluded from the calendar days or flight days specified in the MEL for the repair of an inoperative item of equipment.
