IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT


(RA) NO. 11052, ENTITLED “AN ACT REGULATING THE PRACTICE
OF FOOD TECHNOLOGY IN THE PHILIPPINES,
CREATING FOR THE PURPOSE THE BOARD OF FOOD TECHNOLOGY,
AND APPROPRIATING FUNDS THEREFOR”

RULE I
TITLE, STATEMENT OF POLICY, DEFINITION OF TERMS, AND
SCOPE OF PRACTICE

SECTION 1. Title. – This Resolution shall be known as the “IMPLEMENTING RULES


AND REGULATIONS OF THE PHILIPPINE FOOD TECHNOLOGY ACT”, hereinafter cited
as the “IRR of Republic Act (RA) No. 11052” or simply “IRR”.

SECTION 2. Statement of Policy. – The State recognizes the importance of


Professional Food Technologists in nation-building and development. Hence, it shall
develop and nurture competent, virtuous, productive, and well-rounded
Professional Food Technologists whose standards of practice and service shall be
excellent, world class, and globally competitive through honest, effective, relevant,
and credible licensure examinations and through regulatory programs, measures,
and activities that foster their professional growth, social responsibility, and
development.

This IRR of RA No. 11052 shall be interpreted, construed, and carried out in the
light of the Statement of Policy enshrined in Section 2, Article I of RA No. 11052
and Section 2, Rule I of this IRR.

SECTION 3. Definition of Terms. – For purposes of this IRR, the following terms
shall be understood to mean:

(a) Accredited Integrated Professional Organization (AIPO) refers to the one


and only national organization accredited by the Professional Regulatory
Board of Food Technologists (Board) and the Professional Regulation
Commission (Commission) to represent the Food Technology profession.
A Food Technologist duly registered with the Board and the Commission
shall automatically become a member of the AIPO of Food
Technologists;
(b) Board refers to the Professional Regulatory Board of Food Technology
created pursuant to RA No. 11052;
(c) Certificate of Registration (COR) refers to the document issued by the
Commission, through the Board, signifying that the person named
therein has complied with all the legal and procedural requirements for
such issuance, including in appropriate cases, passing the licensure
examination;
(d) Certificate of analysis refers to an official document that provides all the
required specification and results of scientific tests conducted to provide
information about the different characteristics of a particular material.
In food, the material may refer to samples of raw material, in-process
material, or finished product; and the scientific tests may include the
following: microbiological analysis, physico-chemical analysis, sensory
evaluation, evaluation of functional characteristics, shelf life tests, and
nutritional content;
(e) Code of Professional Conduct refers to the Code of Ethics and the Code
of Technical Standards for Food Technologists which should govern the
decisions and behavior of a Professional Food Technologist;

(f) Commission refers to the Professional Regulation Commission;


(g) Continuing Professional Development refers to the inculcation of
advanced knowledge, skills, and ethical values in a post-licensure
specialization or in an inter- or multi-disciplinary field of study, for
assimilation into professional practice, self-directed research, and/or
lifelong learning;
(h) Food refers to any substance or product whether processed, partially
processed, or unprocessed that is intended for human consumption. It
includes drinks, chewing gum, water, and other substances or products
which are intentionally incorporated into such substances or products
during the process of manufacturing, preparation, and treatment;
(i) Food law refers to the laws and administrative rules and regulations
governing food in general, donated food, and food safety at any stage of
production, processing, distribution, and preparation for human
consumption;
(j) Food processing refers to any action that substantially alters the initial
raw materials or product or ingredients, including but not limited to
heating, smoking, curing, maturing, drying, marinating, extraction,
extrusion, and/or a combination of those processes intended to produce
food;
(k) Food product development refers to the work directed towards the
ideation, innovation, improvement, and prototyping of food products
and processes;
(l) Food quality systems refer to the processes, procedures, and policies
established in the manufacture of food products to help ensure that food
products consistently meet applicable requirements and specifications;
(m) Food safety refers to the assurance that food will not cause harm to the
consumer when it is prepared or eaten according to its intended use;
(n) Food supply chain refers to all stages in the production of food from
primary production, post-harvest handling, distribution, processing, and
preparation for human consumption. Preparation includes cooking and
the application of other treatments to food prior to its consumption;
(o) Food technology refers to the application of the physical, chemical,
biological, and behavioral sciences to the conversion of raw materials
into safe, stable, palatable, and nutritious foods. It includes the
processes of handling, storage, processing, packaging, distribution, and
utilization of food;
(p) Food traceability refers to the ability to follow the movement of a food
through specified stages of production, processing, and distribution;
(q) Foreign reciprocity refers to Section 7 (j) of RA No. 8981 or the “PRC
Modernization Act of 2000” and Section 28 of RA No. 11052 which
provide that only foreign Food Scientists/Technologists whose country or
State allows Filipino Food Technologists to practice within its territorial
limits under the same conditions and on equal basis as its own citizens
or subjects shall be allowed to take the Food Technologists Licensure
Examination and be given a COR and Professional Identification Card
(PIC) or be entitled to any of the privileges under RA No. 11052;
(r) Microbiological certification refers to an official document that provides
all the required specification and results of analysis involving the use of
biological, biochemical, molecular or chemical methods for the
detection, identification or enumeration of microorganisms in a material;
(s) Professional Food Technologist (also refers to a Professional Food
Scientist) refers to a person qualified to practice Food Technology as
provided in RA No. 11052 and who is a holder of a valid COR and a valid
PIC issued by the Board and the Commission;
(t) Professional Identification Card (PIC) refers to the document bearing the
name, signature, birth date, and photograph of the professional,
registration number, dates of issuance and expiry, duly signed by the
Commission Chairperson which is issued to a Professional Food
Technologist, upon compliance with the requirements for registration or

renewal, as the case may be, including the payment of the prescribed
fee;
(u) Professional subjects refer to the subjects which are part of the Food
Technologists Licensure Examination (i.e. physical, chemical, biological,
and microbiological principles; food processing, preservation, and food
engineering; quality systems and sensory evaluation of foods; and food
laws and regulations);
(v) Risk assessment refers to the scientific evaluation of known potential
adverse health effects resulting from human exposure to biological,
chemical, and physical hazards;
(w) Risk communication refers to the interactive exchange of information
and opinion during the course of risk analysis on the hazards and risks
among risk assessors, risk managers, consumers, food and feed
business operators, academia, and other stakeholders;
(x) Risk management refers to the process of weighing policy alternatives
to accept, minimize, or reduce assessed risks; and if necessary, to
select and implement appropriate prevention and control measures;
(y) Sensory evaluation refers to the scientific discipline used to evoke,
measure, analyze, and interpret those responses to food products that
are perceived by the senses of sight, smell, taste, touch, and hearing;
and
(z) Temporary or Special Permit refers to the privilege granted to a foreign
Professional Food Technologist to practice in the Philippines for a limited
period of time, subject to the limitations and conditions provided for by
law.

SECTION 4. The Scope of the Practice of Food Technology. – The professional


practice of Food Technology shall cover the performance of the following services
related to public interest, public safety, legal, or regulatory matters:

(a) Food Supply Chain – the work of the Professional Food Technologists
shall involve the application of scientific methods to the chain of
processes that describes how food from the farm or source ends up on
tables for human consumption, in short: from farm to fork. Specifically,
food traceability or the ability to follow the movement of a food through
specified stages of production, processing, and distribution shall apply
for a systematic and orderly tracking of food materials across the food
chain;
(b) Food Safety – the work of the Professional Food Technologists shall
cover the following areas:

i. Identification of microbiological, chemical, and physical


procedures and processes to identify and certify the hazards in
the food supply chain; and
ii. The use of preventive controls in food by way of risk assessment,
risk management, and risk communication to develop a food
safety plan that would ensure the safety and suitability of food at
all stages of the supply chain;

(c) Sensory Evaluation – scientific work used to evoke, measure, analyze,


and interpret human responses to food products as perceived through
the five (5) senses: sight, smell, taste, touch, and hearing;
(d) Technical transaction or sale – technical support to the trade of food,
food ingredients, and equipment or implements used in food processing,
manufacture, packaging, and distribution;
(e) Food Product Development – the work directed towards ideation,
innovation, introduction, and improvement of products and processes;
(f) Research – basic and applied research work as well as technological
advances in processing, manufacture, packaging, and distribution for
the innovation, introduction, and improvement of safe, nutritious, and
delectable food;

(g) Teaching, lecturing, and reviewing of a professional subject in the


curriculum of the Bachelor of Science in Food Technology degree or
subject in the Food Technologists Licensure Examination given in any
college, university, or training, or review center, or any other
educational institution or certification body;
(h) Food Law – scientific work to support and assist legislation which
regulates the production, trade, and handling of food and covers the
regulation of food control, food safety, food labelling, and other relevant
aspects of the food trade;
(i) Food Quality Systems – the use of physical, chemical, and
microbiological methods and certify the results of analysis using these
methods to establish procedures, processes, and policies to help ensure
that food products consistently meet applicable requirements and
specifications;
(j) Sustainability of Resources – scientific work directed towards the
utilization of food waste for human consumption, the reliable access of
sufficient quantity of affordable and nutritious food, and the protection
of the environment;
(k) Consultation work related to any or all of the above functions; and
(l) Procurement of chemicals, reagents, equipment, apparatus, and other
materials for the conduct of food analysis and research and
development.

The Board, subject to the approval of the Commission, may revise, exclude from, or
add to the above-enumerated acts or activities, as the need arises, to conform to
the latest trend in the practice of the profession.

Further, the Board may, after consultation with the concerned Boards and subject
to the approval of the Commission, enter into appropriate Joint Resolutions and/or
Memoranda of Agreement for the purpose of clarifying, delineating, and/or defining
the interface of activities constituting their respective scopes of professional
practice.

RULE II
THE PROFESSIONAL REGULATORY BOARD OF FOOD TECHNOLOGY

SECTION 5. Creation of the Professional Regulatory Board of Food


Technology. – There is hereby created a Professional Regulatory Board of Food
Technology, hereinafter called the Board, under the administrative supervision of
the Commission, to supervise and regulate the professional practice of Food
Technology in the Philippines.

The Board shall be composed of a Chairperson and two (2) members who shall be
appointed by the President of the Republic of the Philippines from a list of three (3)
nominees for each position submitted by the Commission from a list of five (5)
nominees for each position, chosen, and ranked by the AIPO of Food Technologists.
The Board shall be organized not later than six (6) months after the effectivity of
RA No. 11052.

SECTION 6. Powers and Functions of the Board. – The Board shall exercise the
following powers and functions:

(a) Promulgate, administer, and enforce rules and regulations necessary


for carrying out the provisions of RA No. 11052;
(b) Supervise and regulate the registration, licensure, and practice of Food
Technology in the Philippines;
(c) Issue Temporary or Special Permits to persons admitted to the practice
of Food Technology for a specific duration of time, and Certificates of
Recognition for advanced studies, researches, and accomplishments
that contribute to the enrichment of the profession;

(d) Issue, reinstate, suspend, or revoke the COR, and/or professional


license, or cancel Temporary or Special Permits for the practice of Food
Technology;
(e) Ensure, in coordination with the Commission on Higher Education
(CHED), that all educational institutions offering Food Technology
education comply with the policies, standards, and requirements of the
course prescribed by the CHED in the areas of curriculum, faculty,
library, and facilities;
(f) Prepare, adopt, and issue the Table of Specifications (TOS) of the
subjects for examination by determining and preparing the questions
which shall strictly be within the scope of the TOS of the subjects for
examination;
(g) Adopt a program for the full computerization of the licensure
examination;
(h) Prescribe guidelines and criteria on the Continuing Professional
Development (CPD) program for Food Technologists;
(i) Monitor the conditions affecting the practice of Food Technology and
adopt such measures as may be deemed proper for the enhancement
of the profession and the maintenance of high professional, ethical,
and technical standards;
(j) Prescribe and adopt a Code of Professional Conduct for the practice of
Food Technology;
(k) Hear and investigate cases on violations of RA No. 11052, its IRR, the
Code of Professional Conduct, and other pertinent issuances for the
practice of Food Technology, and for this purpose, to issue summons,
subpoena ad testificandum and/or subpoena duces tecum to alleged
violators and witnesses to compel their attendance in hearings or
investigations and/or production of documents in connection
therewith: Provided, that the decision of the Board shall, unless
appealed to the Commission, become final and executory after fifteen
(15) days from receipt thereof;
(l) Grant registration without examination, subject to approval by the
Commission;
(m) Administer oaths in connection with the administration of RA No. 11052;
(n) Maintain a roster of Food Technologists indicating therein the basic
information about the registered professionals;
(o) Adopt an official seal of the Board; and
(p) Discharge such other powers and functions as the Board may deem
necessary for the practice of the profession and the upgrading,
enhancement, development, and growth of the Food Technology
profession in the Philippines.

Except those requiring ministerial actions on the part of the Board, all policies,
resolutions, rules and regulations, orders, or decisions issued or promulgated by
the Board shall be subject to the review and approval of the Commission.

SECTION 7. Qualifications of the Members of the Board. – At the time of their


respective appointments, the members of the Board, including the Chairperson,
must possess the following qualifications:

(a) a citizen and resident of the Philippines for the last five (5) years;
(b) a holder of Bachelor of Science in Food Technology or its equivalent as
conferred by a school, college, or university in the Philippines or abroad
where its Food Technology program is recognized by CHED;
(c) a Professional Food Technologist under RA No. 11052, with valid COR
and PIC, and has been in the active practice of the profession in the
Philippines for at least five (5) years prior to their appointment as
members;
(d) a member in good standing of the AIPO of Food Technologists;
(e) a person who does not have any pecuniary interest, directly or
indirectly, in any school, academy, college, university, or institution
conferring an academic degree necessary for admission to the practice

of Food Technology or where review classes in preparation for the


licensure examination are being offered or conducted, nor a member of
the faculty, or of the administration thereof at the time of the
appointment of the member to the Board; and
(f) has not been convicted by any competent court of an offense involving
moral turpitude.

SECTION 8. Term of Office of the Members of the Board. – The Chairperson


and members of the Board shall hold office for a term of three (3) years from the
date of appointment or until their successors shall have been qualified and
appointed. They may be reappointed in the same office for another term of three
(3) years immediately after the expiry of their term: Provided, That no member of
the Board shall hold office for more than two (2) terms or more than six (6) years;
Provided, further, That the first Board appointed under RA No. 11052 shall hold
these terms of office: the Chairperson for three (3) years, the first member for two
(2) years, and the second member for one (1) year: Provided, finally, That an
appointee to a vacancy shall serve only the unexpired portion of the term of office.
The Chairperson and members shall take their oaths of office before a duly
authorized officer.

SECTION 9. Compensation and Allowance of the Board. – The Chairperson


and members of the Board shall receive compensation and allowances comparable
to those being received by the chairpersons and members of existing regulatory
boards under the Commission as provided for in the General Appropriations Act.

SECTION 10. Grounds for Removal or Suspension of Members of the Board.


– The Chairperson or any member of the Board may, upon the recommendation of
the Commission, be suspended or removed from office by the President of the
Philippines, upon due notice and hearing, for cause such as neglect of duty,
incompetence, malpractice, commission or tolerance of irregularities in any
examination given by the Board, manipulation or rigging of the examination,
tampering of questions prior to the conduct of the examination, tampering of
grades, and/or unprofessional or unethical conduct. The rights of the accused or
respondent to be heard, to defend oneself, and to be assisted by a counsel shall be
respected in the proper administrative investigation to be conducted for the
purpose.

The Commission shall, in the conduct of the investigation, be guided by Section


7(s) of RA No. 8981, the rules on administrative investigation of the Commission,
and other applicable rules of procedure.

SECTION 11. Supervision of the Board, Custodian of its Records,


Secretariat, and Support Services. – The Board shall be under the
administrative supervision of the Commission. All records of the Board, including
applications for examination papers and results, minutes of deliberation,
administrative cases, and other investigations involving Food Technologists shall be
kept by the Commission.

The Commission shall designate the Secretary of the Board and shall provide the
secretariat and other support services to implement the provisions of RA No.
11052.

SECTION 12. Monthly and Annual Reports. – The Board shall, at the close of
each month and calendar year, submit a monthly and annual report to the
Commission, giving a detailed account of its proceedings, accomplishments during
the month or year, and recommending measures to be adopted, with the end in
view of upgrading and improving the conditions affecting the practice of Food
Technology in the Philippines.

LICENSURE EXAMINATION FOR FOOD TECHNOLOGISTS

AND APPROPRIATING FUNDS THEREFOR”

SECTION 13. Licensure Examination Requirement. – Except as otherwise


specifically allowed under RA 11052 and this IRR, applicants for registration for the
practice of Food Technology shall be required to pass a licensure examination as
provided for in RA No. 11052. The Food Technologists Licensure Examination shall
be given at least once a year according to the Master Schedule or Calendar of the
Annual Professional Licensure Examinations issued by the Commission. The dates
and venues shall, as far as practicable, be announced by the Commission in a
newspaper of general circulation, broadcast media, or its official website.

SECTION 14. Qualifications of an Applicant for the Licensure Examinations.


– An applicant for the Food Technologists Licensure Examination shall meet the
following qualifications:

(a) a citizen of the Philippines or of a foreign country or State that has


reciprocity with the Philippines for the practice of Food Technology;
(b) of good moral character;
(c) if educated in the Philippines, a graduate of any higher education
institution and a holder of a degree of Bachelor of Science in Food
Technology or its equivalent, conferred by a school, college, or
university recognized and duly accredited by the CHED. If with foreign
education, a graduate of reputable foreign universities who has been
conferred the degree of BS Food Technology or its equivalent as
certified by CHED, and whose curriculum includes all the professional
subjects in Food Technology; and
(d) has not been convicted of an offense involving moral turpitude by a
court of competent jurisdiction.

Applicants for the Food Technologists Licensure Examination must submit the
following documents and pay the appropriate fees:

(a) Notarized Application Form;


(b) Birth Certificate;
(c) Marriage Certificate/Contract (for female married applicants);
(d) College Diploma and Transcript of Record (TOR) with scanned picture
and Remarks “For Board Examination Purposes”;
(e) National Bureau of Investigation (NBI) Clearance; and
(f) Other documents that may be required by the Board.

For foreign nationals applying for the Food Technologists Licensure Examination,
he/she must submit the following documents and pay the appropriate fees:

(a) Notarized Application Form;


(b) Copy of the national law or international treaty, agreement or
covenant to prove reciprocity for the practice of Food Technology
between the Philippines and his/her country as provided under
Section 26 hereof;
(c) Birth Certificate;
(d) Marriage Certificate/Contract (for married female applicants);
(e) Copy of passport data page or any equivalent document to establish
citizenship;
(f) College Diploma and Transcript of Records with scanned picture;
(g) Certificate of Good Moral Character to be issued by any of the
following: employer, school/college/university or any competent
authority acceptable to the Board; and
(h) Other documents that may be required by the Board.

For degrees taken abroad, the applicant has to submit also a Certificate of
Equivalency from the CHED.

All official documents that are issued or executed abroad must be authenticated by
the Philippine Embassy/Consulate/Legation in the State or country where they are

issued or executed. An Apostille Certification issued by the foreign competent


authority responsible for the implementation of the Apostille Convention is
sufficient. The document must also be accompanied by an official English
translation, if applicable.

The Board may modify or revise herein list of documentary requirements as


needed.

SECTION 15. Scope of the Examination – The licensure examination shall cover
the following subjects:

(a) Physical, Chemical, Biological, and Microbiological Principles;


(b) Food Processing, Preservation, and Food Engineering;
(c) Quality Systems and Sensory Evaluation of Food; and
(d) Food Laws and Regulations

The Board may, after thorough evaluation and consultation with the stakeholders,
revise, add, or exclude any of the above subjects from the scope of the
examination as may be warranted by the needs/demands of the industry and the
profession. These changes, if any, shall be communicated to schools, colleges, and
universities at least one (1) year prior to their inclusion in the licensure
examination.

SECTION 16. Ratings in the Examination. – To pass the licensure examination,


a candidate for Food Technologist must obtain a passing rating of seventy-five
percent (75%) in each subject given during the examination: Provided, however,
That an examinee who obtains a passing rating in the majority of the subjects but
obtains a rating in the other subjects below seventy-five percent (75%) but not
lower than sixty percent (60%) shall be allowed to take one removal examination
on the subjects where the passing rating was not obtained: Provided, finally, That
should the examinee fail to obtain a passing rating in the removal examination, the
examinee shall be considered as having failed the entire licensure examination.

The removal examination shall be taken in the immediately scheduled licensure


examination. Otherwise, he/she shall be considered to have failed the entire
examination.

SECTION 17. Report of Rating - The Board and the Commission shall release the
results of the licensure examination within ten (10) calendar days from the last
date of examination, unless extended for just cause.

RULE IV
REGISTRATION AND ISSUANCE OF CERTIFICATE OF REGISTRATION AND
PROFESSIONAL IDENTIFICATION CARD

SECTION 18. Issuance of the Certificate of Registration (COR)


and Professional Identification Card (PIC). – The COR and PIC shall be issued to
successful registrants, with or without examination, upon application and submission
of requirements and payment of corresponding fees. The COR shall bear the name of
the Professional Food Technologist, the registration number, the registration date,
the signatures and the official seals of the Commission and the Board, and shall
indicate that the person named therein is entitled to practice the profession, with all
the privileges appurtenant thereto. This certificate shall remain in full force and
effect until revoked or suspended by the Board and Commission in accordance with
RA No. 11052.

The PIC shall bear the registration number and dates of issuance and expiry, duly
signed by the Commission Chairperson, after payment of the required registration or
renewal fees. The validity, expiration, and renewal of the PIC are subject to current

Commission policy; Provided, that the COR has not been suspended or revoked
under RA No. 11052. The PIC shall serve as evidence that the licensee can lawfully
practice the profession until the expiration of its validity.

SECTION 19. Refusal to Register. - The Board shall not register any successful
examinee who has been convicted by a court of competent jurisdiction of any
criminal offense involving moral turpitude or has been found guilty of immoral or
dishonorable conduct after investigation by the Board or has been declared to be of
unsound mind. The reason for the refusal shall be set forth in writing.

SECTION 20. Registration without Examination. – The Commission shall


automatically issue a COR and PIC as Professional Food Technologists to the
Chairperson and members of the first Board without requirement of examination.

Registration and licensing without examination shall apply to graduates of Bachelor


of Science in Food Technology or its equivalent, or of the following allied fields:
Nutrition, Agriculture, Biochemistry or Molecular Biology, Chemistry, Fishery, and
Chemical Engineering, who have been actively practicing the profession of Food
Technology for a period of at least five (5) years immediately preceding the
effectivity of RA No. 11052. This provision is open to qualified applicants based in
the Philippines or overseas who have complied with the requirements.

The Board shall issue the pertinent guidelines to implement this section.

SECTION 21. Oath. - Successful examinees and those who are allowed to register
without licensure examination shall be required to take the Oath of Professional
before the Board or any member thereof, or any official of the Commission or any
person authorized by law prior to the practice of Food Technology.

SECTION 22. Roster of Food Technologists. - The Commission shall keep a


roster of all duly licensed and registered Food Technologists which shall contain
their names, residence and office addresses, the numbers
and dates of their registration and issuance of certificates, and other relevant data.
The Commission shall regularly update such roster and make it available to
requesting parties, subject to the provisions of the Data Privacy Act.

RULE V
PRACTICE OF THE FOOD TECHNOLOGY PROFESSION AND MEMBERSHIP TO
THE ACCREDITED INTEGRATED PROFESSIONAL ORGANIZATION

SECTION 23. Issuance of Temporary or Special Permits. - Without prejudice


to the requirements of existing law on the practice by
foreigners in the Philippines, foreigners who are commissioned by any party to
practice Food Technology in the Philippines shall secure a Temporary or Special
Permit from the Board and the Commission before the commencement of work for
the duration of his/her engagement but in no case exceeding one (1) year, subject
to renewal at the discretion of the Board; Provided, that such practice whether for
educational, research and development, commercial and other purposes is
compliant with the provisions of existing laws and regulations.

Temporary or Special Permits may be issued to:

(a) Foreign Food Scientists or Technologists hired to provide consultancy


services in the Philippines;
(b) Foreign Food Scientists or Technologists employed as exchange
professors or instructors in recognized local schools, universities,
colleges, or instructors to teach Food Science and Technology subjects;
(c) Foreign Food Scientists or Technologists attached to international
agencies or organizations assigned to perform certain work in the
Philippines relative to the practice of Food Technology; and

(d) Foreign Food Scientists or Technologists who are engaged to provide


essential services requiring the application of knowledge, skills and
expertise in Food Technology.

SECTION 24. Continuing Professional Development (CPD) Program. – The


CPD guidelines shall be prescribed and promulgated by the Board and the
Commission, upon consultation with the AIPO of Food Technologists, affiliated
association of Food Technologists, and other concerned sectors. The Board shall
create a CPD Council that shall be composed of a Chairperson coming from the
Board, a member of the AIPO of Food Technologists, and a member from the
academe.

SECTION 25. Integration of Food Technologists. – All Professional Food


Technologists shall be integrated into one (1) national organization, which shall be
recognized by the Board and the Commission as the one and only AIPO of Food
Technologists. A Food Technologist duly registered with the Board shall
automatically become a member of the AIPO of Food Technologists, and shall
receive the benefits and privileges thereto, upon payment of the required fees and
dues. Membership in the AIPO shall not bar membership in other associations of
Food Technologists.

As part of its functions, duties, and responsibilities, the AIPO shall be required to:

(a) Submit nominations to vacant positions in the Board;


(b) Engage in consultations with the Board on matters affecting the
professional practice of Food Technology;
(c) Keep an updated registry of all its members;
(d) Pursue a program for CPD;
(e) Encourage and motivate its members to pursue CPD and other activities
aimed to uplift and advance the standards of the profession;
(f) Assist the Board, as needed; and
(g) Perform other duties and functions pursuant to the existing policy of the
Commission.

SECTION 26. Foreign Reciprocity. – No foreign Food Technologist shall be issued


a COR and PIC or be entitled to any of the privileges under RA No. 11052, unless
the country of which he/she is a subject or citizen of grants the same or similar
rights or privileges to a Filipino citizen to practice Food Technology within its
territory.

A foreign citizen, whether or not he/she studied in the Philippines who desires to
take the Food Technologists Licensure Examination, through reciprocity, shall
initiate the establishment of reciprocity between his/her country or State and the
Philippines by submitting an authenticated copy of the national law or international
treaty, agreement, or covenant to which his/her country or State and the
Philippines are signatories whereby other citizens, including Filipinos, are expressly
allowed to take the Food Technologists Licensure Examination and to register as
such in said foreign country or State on terms of strict and absolute equality with
its own citizens or subjects, including the unconditional recognition of prerequisite
degrees issued by institutions of higher learning duly recognized or established by
the Government of the Republic of the Philippines, and officially translated in the
English language, if applicable.

SECTION 27. Indication of COR, PIC, and Professional Tax Receipt. – The
dates of issuance of the COR and PIC, date of expiry of the PIC, Professional Tax
Receipt (PTR) number, and COR/PIC number shall be indicated by the Food
Technologist in any document that he/she signs or issues in connection with the
practice of the profession.

As a requirement of the Local Government Code of the Philippines, an annual


professional tax shall be paid by a person engaged in the exercise or practice of
his/her profession requiring government examination. Payment of the

professional tax shall be made to the province or locality where the Professional
Food Technologist practices his/her profession or where he/she maintains his/her
principal office in case the practice of the professional is in several places.

RULE VI
ADMINISTRATIVE PROCEEDINGS: PROHIBITED ACTS, REVOCATION
OR SUSPENSION OF CERTIFICATES OF REGISTRATION, CANCELLATION
OF TEMPORARY OR SPECIAL PERMIT, AND REINSTATEMENT, REISSUANCE,
OR REPLACEMENT OF CERTIFICATE OF REGISTRATION
AND PROFESSIONAL IDENTIFICATION CARD

SECTION 28. Prohibited Acts. - It shall be unlawful for any person to


practice or offer to practice Food Technology in the Philippines, or offer oneself as a
Food Technologist, or use the title, word, letter, figure, or any sign tending to
convey the impression that one is a Food Technologist, or advertise or indicate in
any manner whatsoever as qualified to perform the work of Food Technologist,
unless the person has satisfactorily passed the licensure examination given by the
Board, except as otherwise provided in RA No. 11052, and is a holder of a valid
COR and a valid PIC or a valid Temporary or Special Permit duly issued by the
Board and the Commission.
Likewise, the following acts shall be prohibited:

(a) Representing oneself as a Food Technologist during the time that the
COR or PIC is not valid, or that the COR has been suspended or
revoked, or that the Temporary or Special Permit is cancelled;
(b) Allowing another person to use one’s COR and/or PIC or Temporary or
Special Permit as a Food Technologist to enable the other person to
engage in the practice of Food Technology; and
(c) Using the COR and/or PIC or Temporary or Special Permit of another
Food Technologist.

The Board shall investigate, in accordance with the rules on administrative


investigation promulgated by the Commission, violations of RA No. 11052, this IRR,
the Code of Professional Conduct, and other administrative policies, orders, and
issuances promulgated by the Board, the Commission, and/or other regulatory
agencies.

SECTION 29. Revocation or Suspension of the Certificate of Registration


and Cancellation of Special Permit. – The Board may, after due notice and
hearing, revoke the COR, cancel the Temporary or Special Permit, or suspend the
practice of a Food Technologist for any unprofessional or unethical conduct,
malpractice, or violation of any of the provisions of RA No. 11052, this IRR, and the
Code of Professional Conduct and other administrative policies, orders, and
issuances promulgated by the Board, the Commission, and/or other regulatory
agencies.

The Rules on Administrative Investigations issued by the Commission shall govern


the hearing or investigation of the case, subject to applicable provisions of RA No.
8981, RA No. 11052, and suppletory application of the Rules of Court.

SECTION 30. Reinstatement, Reissuance, or Replacement of Certificate of


Registration and Professional Identification Card. – Two (2) years from the
date of revocation, which shall be reckoned from the date of surrender of the COR
and PIC, the Board may, upon application and for reasons deemed proper and
sufficient, reinstate any revoked COR and reissue a PIC, and in so doing, may, in its
discretion, exempt the applicant from taking another examination.

A new COR, PIC or Temporary or Special Permit to replace lost, destroyed or


mutilated ones may be issued subject to the rules as implemented by the Board.

RULE VII
FINAL PROVISIONS

SECTION 31. Penal Provisions. – Any person who shall violate any of the
provisions of RA No. 11052 or any of its IRR as promulgated by the Board shall,
upon conviction, be punished by a fine of not less than Forty Thousand Pesos
(40,000.00) but not more than One Hundred Fifty Thousand Pesos (150,000.00) or
by imprisonment of not less than six (6) months but not more than four (4) years,
or both, at the discretion of the court.

SECTION 32. Funding Provision. – The Chairperson of the Commission shall


include in the Commission’s program the implementation of RA No. 11052, the
funding of which shall be included in the annual General Appropriations Act.

SECTION 33. Separability Clause. – If any provision, section, or part of this IRR
shall be declared unconstitutional or invalid, such judgment shall not affect,
invalidate, or impair any other provisions, sections, or parts hereof, but shall be
merely confined to the provision, section, or part thereof that is directly involved in
the issue upon which such judgment has been rendered.

SECTION 34. Repealing Clause. – All laws, decrees, orders, issuances, or parts
thereof which are inconsistent with the provisions of RA No. 11052 and this IRR are
hereby repealed or modified accordingly.

Nothing in RA No. 11052 shall be construed as to affect or prevent the practice of


other lawfully recognized allied profession.

SECTION 35. Effectivity. – This IRR shall take effect after fifteen (15) days
following the completion of its publication in the Official Gazette or in any
newspaper of general circulation in the Philippines.
