FREQUENTLY ASK QUESTIONS ON ECC/CNC

1. How long is the processing of ECC/CNC?

ECC= 20 working days, CNC= 7 working days.


2. How much is the processing fees for ECC and CNC?

ECC= Php 5,070.00, CNC= Php 1,040.00.


3. Is there any way not to be penalized with the amount of 50,000 for
existing projects operating without ECC?

However, the P50, 000.00 is set as reduced at the discretion of the


Secretary, the EMB Director, or the RD, considering the circumstances of
each case, i.e. impact of the violation on the environment.
4. Whose name should be inputted under project proponent?

ECC= Php 5,070.00, CNC= Php 1,040.00.


5. How long is the processing of ECC/CNC?

Proponent Name should be of the project owner proprietor or company.


6. Does the EMB conduct on-site inspection during the application of the
proposed project?

Yes, whenever inspection on-site is needed.


7. What is the difference between ECC and CNC?

ECC is the certificate issued to projects covered under the PEISS based
on the EMB MC 2014-005, while CNC is a certificate that the proponent
may secure for project not covered under the PEISS or not required to
secure ECC.

8. When was the implementation of ecc since on the past years thelgu
didn’t require them to secure ECC/CNC?
The Presidential Decree No. 1586 was approved on June 11, 1978.

9. What are the requirements for ECC and CNC applications?

CNC Requirements:

Recent photos of the project area

10. Is the approved CNC/ECC generated by the online system the true
copy of CNC/ECC?

Yes

11. What will happen to the CNC application received prior to the updated
CNC online system in the case that the proponent had already paid the
processing fee but can’t upload the bank receipt copy because the new
system won’t accept it?

The proponent may apply again for a CNC using the same bank receipt.

12. Is there an amendment for projects with CNC?

No. The proponent shall have to secure another CNC or advice to secure
ECC depending on the proposed amendment

13. What is the difference between zoning certificate and certification from
LGU on the compatibility of the proposed project with the existing land use
plan?

Zoning Certificate certifies the land use classification of a specific lot area.
However, the requirement for ECC is a certification or maybe a Zoning
certificate from the concerned LGU specifying in the certificate that the
proposed project is compatible with the existing land use plan.

14. Which is most required, Barangay resolution interposing no objection or


affidavit on no complaint? will the affidavit of no complaint be enough?

Affidavit of No Complaint is required which should be executed by the


project owner or the authorized representative of the company.

15. Is ECC a permit?


ECC is a set of conditionalities that the proponent will have to comply after
its issuance.

16. Does ECC/CNC has an expiry/validity? if yes, is it renewable?

No. However, for project issued with ECC not operated after five years
from the issuance without submission of Compliance Monitoring Report
(CMR) is considered null and void.

17. Is there a need to conduct a public scoping activity for eis-based


projects during this emergency health crisis?

Yes, consistent with DAO 2017-15, but the proponent may conduct the
scoping through virtual meeting or onsite strictly observing social
distancing. New guidelines will be released soon.

18. Project threshold/coverage for specific projects (e.g. poultry, building,


processing, etc.)

Project coverage is based on EMB MC 2014-005 “Revised Guidelines for


Coverage Screening and Standardized Requirements under Philippine
Environmental Impact Statement System (PEISS)”.

19. How many days will be added to the 20-day processing timeframe for
projects with on-going case/violation?

Depending on the frequency of the proponent in completion of its


commitment.

20. Questions related to ECC additional requirements

The following must be secured as additional requirement for specific


projects:
PAMB Clearance – for projects located within protected areas
RSGA- for quarry projects
GSSR/EGGAR- for subdivision/condominium projects
FLA/Provisional Permit- for projects using foreshore
Ore Supply Contract- for mineral processing projects
Valid Wood Supply Contract- for wood processing projects

Depending on the frequency of the proponent in completion of its


commitment.

22. What will be the next step after receiving the approved ECC?

The downloaded ECC must be printed and notarized. The ECC notarized
copy must be uploaded again in the ECC online system.

23. How to input geographical coordinates in the ECC online system?

There should be at least three coordinates inputted in the ECC online


using degree-minutes-seconds or decimal degrees coordinates.

Tax Declaration must be supported with other legal documents showing


the authority of the proponent over the project area such as land title, Deed
of Absolute Sale, Memorandum of Agreement, etc.
26. My project falls under category d based on mc 2014-005, but I am
located in a protected area. what should i secure?

MC 2020-26 provides that CNC could be issued to project within


Protected Area with PAMB Clearance as one of the requirements in line
with Rule 12.2of DAO 2019-05

27. A My project is located in an ancestral domain, what should i secure?

Projects listed in Table 1 of EMB MC 2014-005 within ancestral domains


are considered in an Environmentally Critical Area (ECA) where an ECC is
required.

28. Will my documents in CNC be validated after uploading?

And any misrepresentation shall be construed as a violation as provided


in EMB MC 2020-24.

29. I want to increase my project production capacity, what should i secure


and how will i secure it?

If the proposed increase exceeds the coverage thresholds, an EPRMP


must be submitted to EMB Regional Office. If the total production rate is
still within the threshold, a major amendment must be applied through the
ECC online system.

30. I just bought a warehouse/manufacturing plant/gasoline station with an


issued ECC, what should i do next?

Apply for ECC Transfer of Ownership at EMB Regional Office
