IN THE HONOURABLE COURT OF JUDICIAL MAGISTRATE OF FIRST CLASS AT UTNOORHonoured Sir,
This is a case of cheating taking an amount of Rs 2,31,500/- by the accused Budde Madhukar s/o Budde
Narayana, age:40yrs, caste: Perika, occ: Contractor (civil), r/o Perkapally village of Thiryani mandal Dist
Kuram Bheem Asifabad, which occurred on 27.04.2019 at KGVB School Pochamloddi village of Jainoor
mandal and reported on 21.06.2019 at 1630 hours by the complainant Bhatane Vijay s/o Bhatane Keshav,
age:40yrs, caste: BC Vanjari, occ: Business/ Agril, r/o Polasa village of Jainoor Mandal the accused have
cheated the complainant by and the accused not having sufficient fund over the contract work of school
compound wall and accused was given to the LW-1 to complete the said compound wall work on LW-1 own
expenses an amount of Rs.2,31,500/-. The place of offence comes under the limits of P.S Jainoor within
the jurisdiction Hon’ble court. This is a Court referred case, the complainant on 21.06.2019 at
1630 hrs I received a court referred petition vide O.D.MS No.635/2019 dt: 19.06.2019 from Hon’ble JFCM
Utnoor in which complainant Bathane Vijay s/o Bhatane Kashar, age:40yrs, caste: Vanjari, occ: Contractor
(Civil), r/o Jainoor village & Mandal stated that the accused Budde Madhukar s/o Budde Narayana, age:
40yrs, caste: Perika, occ: Contractor (civil), r/o Perkapally village of Thiryani mandal Dist Kuram Bheem
Asifabad complainant and accused were working as a civil contractor as profession that the K.G.V.B
Pochamloddi school compound wall tender the complainant given to the accused he not having sufficient
fund over the contract work of school compound wall and his given to the said work to the complainant to
complete the said compound wall work on complainant own expenses and the complainant completed the
compound wall work after that the tender final bill of Rs 2,31,500/- (Rupees two lakhs thirty one thousand
five hundred only) was sanctioned in favour of accused Budde Mahukar when the complainant asked for the
amount of compound wall work about two months back of Rs.2,31,500/- the accused intentionally avoided
to pay and dragging the matter lastly the complainant demanded the accused amount and he threatened
the complainant and told that what you can do you but I will not pay the amount before the 1) Dasu Soukari
@ Devidas and 2) Chand s/o Sikingar were intentionally the accused cheated the complainant taking the
advantage of the tender on his name and amount also credited in this account. As such the complainant
approached to JFCM Court Utnoor and field a petition against the Budde Madhukar for taking necessary
action. On the strength of above petition the LW-09 has registered a case in Cr. No.63/2019
U/Sec: 420 IPC, Sec. 156(3)Cr.PC and issued FIR and took up investigation, informed the same to the
superior officers and dispatched the FIR to the Hon’ble JFCM court Utnoor and copies to all concerned
superior officer for information. Further during the course of investigation the LW-09
visited the Jainoor and the Lws-1 examined and recorded his statements u/s 161 Cr.P.C detail in part-II
CDs and collected the Documents, and Photos of the scene of offence from the Lw-01, which was issued
by the accused to Lw-01, later the LW-09 visited the scene of offence situated at Pochamloddi village,
secured the presence of witnesses LWs 2 to 3 examined and recorded their statements u/s 161 Cr.P.C,
detail in part-II CDs, secured the presence of two mediators LWs 7& 8 observed the scene minutely and
incorporated the same into CDF and drawn rough sketch of scene of offence in the presence of same
mediators Lws 7 & 8. Subsequently on 28.06.2019 the Lw-10 took up the investigation in to this
case and verified the investigation done by the Lw-09 (WASI-2302) and found on proper lines, and did not
record their statements as they stated the same case facts before the LW-09. Subsequently on
4.11.2019 the Lw-11 took up the investigation in to this case and verified the investigation done by the
Lw-09 (WASI-2302) and found on proper lines, and did not record their statements as they stated the same
case facts before the LW-09, Subsequently the LW-11 visited the Jainoor local secured the presence of
 witnesses LWs 4 to 6 examined and recorded their statements u/s 161 Cr.P.C, detail in part-II CDs,
While the investigation was in progress, on 24.02.2020 the Lw-11 served notice u/s 41(A) CrPC to the
accused Budde Madhukar s/o Budde Narayana, age:40yrs, caste: Perika, occ: Contractor (civil), r/o
Perkapally village of Thiryani mandal Dist Kuram Bheem Asifabad by duly obtaining his signature and
informed him appear to whenever he was required to appear before Police officer or the Hon’ble JFCM court
on receipt of information. From the evidence collected during the course of investigation it is
established that the complainant/Lw-01 belongs Polasa village of Jainoor Mandal and the accused belongs
to Thiryani village. The accused was working as Civil contractors by profession, that the KGBV Pochamloddi
school compound wall tender was given to the accused Budde Madukar, the accused not having sufficient
fund over the contract work of school compound wall and accused was given to the LW-1 to complete the
said compound wall work on LW-1 own expenses and the LW-1 along with village elders LWs-4 to 6 they
are open and inauguration on the compound wall the LW-1 completed the compound wall work after that
the tender final bill Rs 2,31,500/- was sanctioned in favour of the accused Budde Madukar when the LW-1
asked for the payment of compound wall work about two months back of Rs 2,31,500/- the accused
intentionally avoided to pay and dragging the matter lastly the LW-1 demanded the accused about the
payments amount on 27.04.2020 but the accused intentionally refused to pay the amount and accused was
threatened the LW-1 and told that what you can do you do but I will not pay the amount before the LWs-1
to 3 intentionally the accused was cheated them to LW-1 taking the advantage of the tender on his named
and amount also credited in his account Thus the accused Budde Madhukar s/o Budde Narayana,
age:40yrs, caste: Perika, occ: Contractor (civil), r/o Perkapally village of Thiryani mandal Dist Kuram Bheem
Asifabad has committed an offence liable for punishment U/Sec: 420 IPC. Therefore the Hon’ble
JFCM Court Utnoor is requested to issue summons to the accused person to appear in the court. Hence
the Charge,
