MOU - Husbandand Wife
AND
That First Party and Second Party to this Settlement were married as per Hindu rites
and rituals under the Hindu Marriage Act, 1955 on ___________________, before all
family members and friends, and went through a social cum religious marriage
ceremony on _____________________________ at _________________________.
That after the said marriage, some differences had arisen between the First Party and
Second Party.
That after the marriage, the parties owing to various differences and temperamental
incompatibility, have been living separately from each other and the arguments
between the parties are making their living situation with each other problematic and
challenging.
There is chance of reconciliation of marriage between the parties or resumption of
normal marital relationship in future if the husband agrees to behave sanely with his
wife and family members.
It is hereby agreed between the parties that the compromise shall be carried out in
successive stages with different obligations cast on the parties detailed more
elaborately hereunder:
1. That the husband shall abide by the terms of MOU and shall not use any form
of cruelties on wife and his child.
3. That further it has been agreed that all the cases pending between the parties
shall be withdraw by the respective parties, in terms of the settlement
agreement.
4. The parties hereto also agree that in the eventuality if either party fails to honor
the covenants under this MOU, he / she shall render himself/herself liable for
criminal prosecution and fine as deemed fit by the Hon'ble Court.
5. That both the parties have signed this Memorandum of Understanding with
their free consent, choice, and without any pressure, coercion or undue
influence.
6. This Settlement has been voluntarily arrived at between the parties with their
own free will and without any force, pressure or coercion and both the parties
are bound by the terms and conditions mentioned herein above.
7. That no part of statement is false in any respect nor concealed any material fact
by the parties. Both parties understand the consequences of making false
statement or concealing of material facts.
In witness whereof, the parties have affixed their respective signatures to this
Memorandum of Understanding at New Delhi on the date mentioned herein above.
