Subject: Legal Notice for Recovery of ₹2,00,000/- (Rupees Two Lakh


Only) Given for Business Purposes, with Interest and Compensation
for Delay

Dear Sir,

Under instructions and authority from my client, Mr. Akash Jaiswal


S/o Mr. Ganga Prasad Jaiswal, residing at 2 K.V Chopra Gali,
Khairabad, District-Sultanpur, U.P.-228001, I hereby serve upon you
the following notice:

1. That on 01.03.2021, you approached my client seeking financial


assistance for the purpose of funding your business activities.
Considering the mutual trust and longstanding relationship
between you and my client, my client agreed to lend you a sum of
₹2,00,000/- (Rupees Two Lakh Only). The transaction was
carried out in good faith, and my client fully expected the amount
to be repaid in a timely manner, as per your verbal and/or written
commitment.
2. That it was mutually understood that you would repay the full
amount within a reasonable period of one year from the date of
disbursement. You also agreed to utilize the funds solely for
business purposes and assured my client that repayment would
not be delayed beyond this agreed period. Despite this, no formal
agreement or acknowledgment of debt was signed by you, relying
entirely on the trust placed in you by my client.

3. That despite several follow-ups and repeated reminders through


phone calls, messages, and personal meetings, you have failed to
repay the principal amount. Additionally, you have neglected to
provide any valid reason or explanation for the inordinate delay.
This not only constitutes a breach of the verbal agreement but also
shows a complete disregard for your financial obligations.
4. That the delay in repayment has caused considerable financial
distress to my client, as these funds were earmarked for other
crucial purposes. My client has been put in a difficult position due
to your unjustified delay. Moreover, this has affected my client's
emotional well-being, causing immense stress and anxiety, which
could have been avoided with timely repayment.
5. That In light of the above facts, my client hereby demands the
following:

 Immediate repayment of the principal sum of ₹2,00,000/-


(Rupees Two Lakh Only), without any further delay.

 Interest on the said amount at the rate of 12% per annum,


calculated from the date the amount was lent till the actual date
of repayment.

 Compensation for the mental agony, stress, and financial loss


caused by your failure to repay the amount within the agreed
time, totalling ₹50,000/-, which shall also be payable within
the stipulated period.

6. That you are hereby informed that if the above-mentioned


amount, including the interest and compensation, is not repaid
within 15 days from the date of receipt of this notice, my client
shall be left with no other option but to initiate legal proceedings
against you. These proceedings may include, but are not limited
to:

a. Filing a civil suit for the recovery of the amount along with
interest, costs, and damages.

b. Initiating criminal proceedings under relevant sections of


the Indian Penal Code, including, but not limited to,
cheating and breach of trust, as your conduct amounts to
criminal liability.

7. That in the event that legal action is initiated, you will be liable for
all legal costs, court fees, and any additional expenses incurred by
my client in recovering the said amount.
8. That this legal notice serves as your final opportunity to settle the
matter amicably. I advise you to treat this matter with utmost
seriousness and urgency, as any further delay or negligence on
your part will only aggravate the situation and increase your
liability.
You are kindly requested to acknowledge receipt of this
notice and arrange for the payment of the aforementioned amount
within the stipulated time. Failure to do so will leave my client with
no choice but to pursue the matter through the appropriate
judicial channels.
