CONTRACT OF LEASE

Know All Men By These Presents :

This Contract of Lease is made and entered into by and between :

(OWNER OF THE PROPERTY), TERESITA DELA CRUZ TORRES, hereinafter referred to


as the “LESSORS”, with Postal Address at 222 KADAKILAAN STREET, SAN ANTONIO, CAVITE
CITY.

JOHN PAUL R. TOPACIO, hereinafter referred to as the “LESSEE” ; with Postal Address at BRGY.
33, CAPT. NOVALES STREET, CARIDAD, CAVITE CITY.

WITNESSETH : That

WHEREAS, the LESSORS are the absolute owners of that PROPERTY situated in 789
BRGY. PECHAY-M., SAN ROQUE, CAVITE CITY.

WHEREAS, the LESSEE has offered to lease a portion of said property equivalent to
FIFTY (50) square meters. More or less, and the LESSORS have agreed to lease the same unto
LESSEE;

NOW, THEREFORE, for and in consideration of the foregoing premises ang the mutual
covenants hereinafter set forth, the parties hereby agree as follows:

1. PERIOD OF LEASE – This Contract shall be for a period of ONE (1) year(s) commencing
on MARCH 4, 2024 and ending on MARCH 3, 2025.

2. RENTAL RATES – That the rental shall be SEVEN THOUSAND PESOS (₱ 7,000)
per month ;

3. USE OF PREMISES – The leased premises shall be used by the LESSEE for operating
the business of a MOTORSHOP and other business related thereto ;

4. UTILITIES – The LESSEE shall be liable for the cost of water, electric and other
utility bills including expenses for the needed connection or installation thereof in the
leased premises ;

5. USE AND SUBLETTING – The LESSEE shall be allowed to sublease and introduce
any development ang improvement(s) within the leased premises subject to the written
consent of the LESSORS which should not be unreasonably withheld. Assignment or
transfer of this contract is not allowed ;

6. MAINTENANCE – The LESSEE acknowledges that the leased premises are in


good and tenantable condition and agrees to keep the same in such condition.
All necessary repairs on the premises shall be made and effected by the LESSEE
at the latter’s expense ;

7. COST AND PAYMENT – The LESSEE shall pay the LESSOR one(1) month
advance prior to taking occupancy of the premises, and one(1) months deposit as
a security deposit to cover the cost of any damages suffered by the premises
and cleaning. Such security deposit is non-refundable if the contract is unfinished.
Such security deposit will be returned to the LESSEE upon the end of these
agreement(s).

8. REAL PROPERTY CHARGES – Real estate taxes shall be for the account of
the LESSORS while all assessments and taxes that may be imposed on the
various installations introduced by the LESSEE on the leased premises shall be
for the account ;

9. COMPLIANCE WITH LAWS – In the conduct of business in the leased


premises, the LESSEE shall comply with all government laws and ordinances
relating to the use, occupation, sanitation and safety of the leased premises.
LESSEE shall hold the LESSORS free and harmless from any liability or suit
arising from or as a result of violation of such laws and ordinance ;

10. THIRD PARTY LIABILITY – The LESSEE shall also hold the LESSORS free
and harmless from all faults, responsibilities, damages and liabilities to any
person or property arising out of or as a consequence of the use of the leased
premises by the LESSEE, the latter’s personnel and guests ;

11. EXTRA JUDICIAL OF CONTRACT – In case of violation of any of the terms


of this Contract by the LESSEE, including the abandonment of the leased
premises without payment of appropriate rentals, the LESSORS shall have the
right to cancel this Contract extra-judicially by notarial notification of
cancellation, remove the padlock and enter the premises, remove the personal
properties found therein, and have the premises leased to other parties ;

12. TURN OVER OF PREMISES AT TERMINATION OF LEASE – The LESSEE


shall peacefully turn-over the possession of the leased premises to the LESSORS
at the end of the term of the lease or its cancellation, including all improvements
and installations introduced by the LESSEE therein without any cost to the
LESSORS.
