TERMS OF CONTRACT FOR CONTRACTUAL DEPUTATION

1. DESIGNATION “SAFETY ENGINEER”
2. NORMAL WORKING Normal working hours at site for “GEA” project shall be 10 Hours per day
TIME / OVERTIME (including 1 hour lunch break), 6 days a week. However, if work demands
Mr. XYZ shall occasionally, work beyond normal working hours and even
on weekly offs / holidays / in shifts. However, for hours worked beyond
normal working hours, NO overtime shall be paid by “MMK”, as the
salary includes compensation for hardwork. However, GEA may
consider grant of compensatory offs in lieu of extra hours worked if it is
permitted as per their company policy.
3. GROSS SALARY Total @ Rs. /- per month on pro-rata basis which includes basic salary @
Rs./-, house rent allowance @ Rs. /-, Conveyance allowance @ Rs./- and
Medical Allowance @ Rs./- Education Allowances – @ Rs. /- And Bonus
@ Rs./- per month.
4. PAID LEAVE STUCTURE TOTAL ELIGIBILITY LIMIT OF PAID LEAVES ON Remarks

 Submission of Medical Certificate is compulsory for

Pls. Mention the type of leave taken on the monthly Time sheet.
Leaves shall be credited proportionately on monthly basis.

5. ACCOMMODATION GEA shall provide free furnished Bachelor accommodation to Mr. XYZ
ALLOWANCES near Bhillai Project Site or Reimbursement of Bachelor accommodation
allowances shall be provided by MMK.
6. FOOD ALLOWANCES Included in Salary.

7. LOCAL GEA shall provide shared local transportation facility between pick-up
TRANSPORTATION point near place of residence & site for attending official work free of
charge.

8. MOBILIZATION / All travel expenses by III AC train / Luxury Bus for one return trip from
DEMOBILIZATION Bhilwara to Bhillai & back would be reimbursed by “MMK” against
submission of tickets. (Please preserve all the Original / Xerox of Bus
ticket). In case Mr. XYZ leaves the job before the completion of contract
period, the return train / bus fare will not be payable.
9 RETENTION MONEY NOT APPLICABLE.

10. DATE & MODE OF The total amount payable at the end of every month shall be paid to
PAYMENT Mr. XYZ by direct transfer to HDFC/ SBI account or by HDFC
Cheque payable at anywhere in India in 1st week of following month
after receipt of duly certified “Monthly Time Sheet” for the entire
month. Any deductions due to absenteeism or otherwise shall be
adjusted while releasing payment.
11. INSURANCE “MMK” shall take Personal Accident Insurance policy for Rs.3 Lacs
to cover Mr. XYZ. during the period Mr. XYZ is on this assignment.
“MMK” shall also cover Mr. XYZ under WC policy for appropriate
amount & also provide cover under group Mediclaim policy for Rs.
100,000/-.
12. RETENTION “MMK” shall retain 5% of gross salary or Rs. XXX/- every month,
whichever is lower and such total retained amount shall be paid to you
at the end of the contract including all extensions. However, if you
leave job before expiry of the contract without proper notice period or
if client terminates the contract due to your non-performance, retained
amount as mentioned above shall be forfeited.
13. EMPLOYEE PROVIDENT Contract Employee’s contribution @ 12 % of the Basic Monthly
FUND Salary would be deducted and Employer would pay an equivalent
amount for depositing with EPF authority.
14. ESIC Contract Employee’s contribution @ 0.75% of the Gross Monthly
Salary would be deducted and Employer would pay an amount
@3.25% of the Gross salary with ESI authority.- NOT APPLICABLE
IN THIS CASE SINCE GROSS SALARY IS MORE THAN
RS.21,000/- PER MONTH
15. DATE OF JOINING WITH EFFECT FROM 05.04.2021
16. LOCATION At Bhillai Project Site
17. DURATION OF CONTRACT As provided by our client M/s. GEA but presently given for the period
of Six months from the date of joining as mentioned above. The
period would be extended further based on requirement of M/s. GEA.
However, Mr. XYZ would continue to work till required by M/s.
GEA / MMK.
18. NOTICE PERIOD Mr. XYZ shall give 30 Day’s notice or equivalent amount, when he
desires to break this contract prematurely. “MMK” reserves the right to
terminate the contract at any point of time without any notice period if
Mr. XYZ’s performance/ behavior is not found up to the expectation of
GEA/MMK.
19. DEDUCTION OF TAXES We would follow all state and central laws for deduction of profession
tax, income tax and any other tax at source as applicable at the time of
making monthly payment.
20. JURISDICTION Any dispute arising out of execution of this contract can legally be
settled only at Mumbai within the purview of Bombay Jurisdiction.
P.S. : Monthly Salary includes dearness allowance and food allowance
Note : Salary will be paid considering total nos. of days worked including Sundays & holidays based on
approved Time Sheet.
